By contracting for these services of rental of industrial vehicles with driver, the proper maintenance activity will be carried out throughproviding with cranes for the repair of mechanical and electrical defects, respectively with tugs for transporting large parts and subassemblies, with dump trucks and trucks for continuous supply with different spare parts and materials, transport for repairs of different subassemblies, evacuation of different materials from quarries and other points working, under difficult conditions dthere is a road and on rough terrain that appear in the production process at the excavation machines and the coal and tailings transport facilities for deposits or tailings dumps, from the mining quarries of Rovinari, Tismana, Pinoasa, Peşteana, Jilţ Nord and Lupoaia; with a car necessary. having character technical and a progr. of work according to the annex to the specification no. 108 / 08.01.2020.

(1) Declaration on own responsibility regardingfailure to comply with the provisions of art.177, 178, 180 of Law no.99 / 2016 - Form will be completed. DUAE integrated regarding the reasons for exclusion from the procedure, as the case may be, both by the tenderer, associate, subcontractor, and third party.

(2) Declaration on his own responsibility regarding the non-classification in a conflict of interest situation as regulated with an exemplary title in art.73of Law no.99 / 2016 - A declaration will be completed. The persons holding decision-making functions within the contracting entity are: President of Boza Sorinel Gheorghe Directorate, Members of Burlan Daniel, Balacescu Ovidiu, Vasile Dan and Balalasoiu Constantin, Director of Financial Accounting - Popescu Adriana-Luminița, Director of Dobritanu Gheorghe Mining Directorate, The Director of the Support Services Department Iacob Dumitru, the Deputy Commercial Director Dadalau Grigorie, the coordinator of the Law and Corporate Governance Directorate - Danielerban Daniela, the Head of the Contractual Discipline Service Lazar-Andrei Mihaela, the Head of the Works-Services Acquisition Services (3). will present the integrated DUAE form according to art. 202paragraph (1) of Law 99/2016, this being attached to the participation notice on the SEAP portal (www.e-licitatie.ro). The integrated DUAE will be completed regarding the reasons for exclusion from the procedure, as the case may be, both by the tenderer, associate, subcontractor, and third party. 1) If 2 or more offers / lot areranked on the first place with equal scores, for the division, the evaluation commission will ask the bidders in this situation new financial proposals, which will be transmitted electronically in SICAP;

2) The bidders have the right to request clarifications regarding the mandatory contractual clauses. If following the clarifications these clauses will be amended / modified, they will be notifiedeconomic operators until the deadline for submission of tenders. No modifications of the obligatory contractual clauses after the deadline for submission of tenders are allowed;

3) Op. ec. bidders have the right to deposit. several nominations / individual and / or common offers or to be nominated as subcontractors on several different lots, related to the same award procedure, prohibitionsprovided by art. 180 lit. a) and b) of Law 99/2016 referring to the submission of tenders within the same / same lots related to a tendering procedure. Prev. art. 180 paragraph (1) lit. d) of Law 99/2016, "The contracting entity excludes from the award procedure any economic operator that is in any of the following situations: ... (d) the contracting entity has sufficesentities reasonable indications / concrete information to consider that the economic operator has concluded agreements with other economic operators aimed at distorting competition in or in connection with the procedure in question ... ";

4) Any amendments to the specific contractual clauses of the draft agreement -frame / contract will be submitted with the offer The amendments made after the submission ofthe edges will not be taken into account.
