Delivery and assembly of heat pumps as part of the project "Renewable energy sources in the Municipality of Lubochnia"

Reference Number: RI.9.271.Pzp.2018

The subject of the order is the delivery and assembly of heat pumps in under the project "Renewable energy sources in the Lubochnia Commune"

Main Site: Land of the commune of Lubochnia.

Supply and installation of heat pumps includes:

1) delivery and-assembly based on technical documentation of 8 sets of ground heat pumps with power from 11 kW to 19 kW.

2) execution of boreholes for introduction of the court (not covered by co-financing)

3) utilities of the ground source heat pump

4) heat pump connection to an existing central heating, hot utility water installation, electrical and water supply installation

5) supply and installation of thermal energy buffers-from 300 to 800 liters

6) delivery and assembly of fittings, devices and other elements according to the technological scheme,

7) installation of the control system

8) execution of the installation

9) filling the installation

10) commissioning the installation

11) training of users to the principles of correct operation of the heat pumps made, along with the development of detailed operating instructions and their transfer of useŸ, 12) supplementing and sealing the cavity after cable penetrations, making cold water pipes, hot c.o. and electrical necessary to connect to the designed system;

13) monitoring system execution

14) mechanical ventilation.

The detailed description of the subject of the order is included in Annex 8 to the Terms of Reference:

1. You can apply for the orderthe offenders who are not subject to exclusion and meet the conditions of participation in the proceedings specified by the awarding authority,

2. The ordering party does not set specific requirements regarding the fulfillment of the condition regarding competences or entitlements to conduct a specific professional activity, if it results from separate provisions - 3. The contractor is excluded from the contract award procedure in relation toTorego occurs in any of the circumstances referred to in Article 24 sec. 1 point 12-23 of the PPL,

4. The Contracting Authority provides for the grounds for exclusion indicated in art. 24 sec. 5 points 1, 2, 4 and 8 of the Act,

5. The contractor is obliged to attach to the offer a statement valid as of the day of submitting bids constituting preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the proceedingsNIU.

6. The statement referred to in point 5 The Contractor is obliged to submit in the form of a single document drawn up in accordance with the specimen of the standard form set out in the implementing regulation of the European Commission 2016/7 of 5.1.2016 issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as "Single Document" or "EAT" acc. Annex 4 to the ToR,

7. performerand within 3 days from the date of placing information on the website of the ordering party, referred to in art. 86 par. 5 of the Act (information from the opening of tenders), is obliged to provide the orderer with a statement on belonging to or lack of belonging to the same capital group, referred to in art. 24 sec. 1 point 23 of the Act. In the case of belonging to the same capital groupthe contractor may submit together with the declaration documents or information confirming that connections with another contractor do not lead to distortion of competition in the procedure. The pattern of the declaration is attached as Annex 5 to the ToR,

8. From the Contractor, which relies on the abilities of other entities on the terms specified in art. 22a of the Public Procurement Law, the Employer requires presentation in respect of these entities tothe instruments listed in Chapter VII, paragraph 3, 3) SIWZ.

9. The Contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it relies on their resources, the condition of participation in the proceedings also consists of EED regarding these entities

10. In the case of contractors jointly applying for the award of the contract:

a) None of them may be subject to exclusion due to non-compliance with the conditions referred to in art. 24 sec. 1 and par. 5 points 1, 2, 4, 8 of the Public Procurement Law, while fulfillment of the conditions for participation in the Contractor's proceedings are shown in accordance with Chapter V, para. 1 SIWZ. The Ordering Party does not specify a special way of meeting the condition by Contractors jointly applying for the order.

B)you The document referred to in Chapter VII, para. 1 point 1 and 2 of the SIWZ. is submitted by each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion, c) Declaration of non-membershipto the same capital group, each of the contractors, d) They are obligated, at the request of the contracting authority, to submit documents and statements referred to in Chapter VII, para. 3 point 2 and 3 of the ToR, with the documents and statements referred to: - in Chapter VII, para. 3 points 2 SIWZ shall submit respectively the contractor / contractors who / indicate the fulfillment of the condition in the scope and on the principlesdescribed in Chapter V, paragraph 1 SIWZ,

- in Chapter VII, para. 3 points 3 of the SIWZ is submitted by each contractor.

The ordering party does not set specific requirements to meet this condition. • Continued item III. contained in Section III.1.3):

16. If the contractor is established or resides outside the territory of the Republic of Poland, instead of a document about whichin a) Chapter VII, paragraph 3, point 3) lit. a) SIWZ - shall submit information from the relevant register or in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned by the information or document, in the scope referred to in Article 24 sec. 1 point 13, 14 and 21, issued not earlier than 6 months before the deadline for submitting offers;

b) Chapter VII, paragraph 3, point 3) lit. b) d) The ToR shall submit a document or documents issued in the country in which the Contractor has his registered office or place of residence, confirming that: - he is not in arrears with paying taxes, fees, social security or health insurance contributions, or that he has signed an agreement withthe competent authority regarding the repayment of such receivables along with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or withholding in full the decision of the competent authority, - its liquidation has not been opened or bankruptcy has been announced. . Documents referred to in Chapter VII, para. 6 lit. a) and lit. b) tiret second SIWZ should be issued not earlier than 6 months before the deadline for submission of tenders. Documents referred to in Chapter VII, paragraph 6 lit. b) first indent of the SIWZ should be issued not earlier than 3 months before the deadline for submission of tenders. If in the country in which the contractor has a registered office or place of residence or a place of residence has a person whose document tothe document referred to in paragraph 6 - above, it is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person whose document was to be submitted, filed by a notary or before a judicial, administrative or professional self-regulatory or economic authority competent fordue to the registered office or place of residence of the contractor or place of residence of that person. The provision of Chapter VII, paragraph 7 of the ToR shall be applied accordingly.

19. The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in Chapter VII paragraph 3 point 3 lit. a) SIWZ, submits dokument referred to in Chapter VII, paragraph 6 lit. a) SIWZ, to the extent specified in art. 24 sec. 1 point 14 and 21 Public Procurement Law. If there is no such document in the country in which the person concerned has a place of residence, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or self-governmental bodyor economic center competent for the place of residence of that person. The provision of Chapter VII, paragraph 7 of the ToR shall be applied accordingly.

20. The Contractor is obliged to pay a bid bond in the amount of:

PLN 10, 000.00 (say: ten thousand zlotys).

21. The two-month period specified in Section IV.2.6) should be understood as 60 days counted from the date set for submitting bids,

22. The contractor whose offer fromlastly considered the most advantageous, it will be required to provide a performance bond of 10% of the gross price of the offer (including VAT),
