Cerinta nr. 1:

The bidders, third parties and subcontractors must not find themselves in the situations provided by art. 177, 178, 180 of Law no. 99/2016, according to Form 4 in the "Forms" section.

Mode of accomplishment:

- DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation.to prove the fulfillment of the assumed by the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked first in the intermediate rankings drawn up at the completion of the evaluation of the bids. These documents may be:

1) certificates of absence of debts related to the payment of taxes, duties or contributions to the general consolidated budgett (local budget, state budget, etc.) outstanding at the time of presentation. It will be specified that foreign legal / natural persons wishing to participate in the procedure will present any editorial documents issued by the competent authorities of the country where they are residents proving the fulfillment of the outstanding obligations regarding the payment of taxes and insurance social, to m(2) the criminal record of the economic operator and of the members of the management, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control therein, as they result from the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents proving itthe fact that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on Public Procurement; 4) other editing documents, as the case may be.

Requirement no. 1

The supporting documents proving the fulfillment of the assumed by the DUAE are to be presented to the soldiersquoting the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the tender evaluation.

The validity period of the tenders: 90 days from the deadline for submission of tenders

Notes:

(a) The contracting entity has the right to request the tenderers, in exceptional circumstances, before the expiry of the validity period of the tender, (b) The tenderer has the obligation to communicate to the Contracting Entity if he or she does not agree with the above(c) The bidder who disagrees with the extension of the offer's period of validity shall be deemed to have withdrawn its offer, without this losing the guarantee of participation.
