1. The subject of the order is comprehensive delivery and sale of high-methane natural gas (group E).

Main Site: Sitaniec-Wolica K. Zamościa,

Comprehensive supply and sale of high-methane natural gasof this (group E) - to the Boiler House No. 6, ib. 3391 In M. Sitaniec-Wolica, K. Zamość,

1. The Contractors, who:

1) may not be excluded under the provisions of art. 24 sec. 1 point 12-23 of the Public Procurement Law and art. 24 sec. 5 points 1, 5, 6, 8 Public Procurement Law Acts,

2) meet the conditions for participation in proceedings regarding: a) competences or entitlements to conduct specific activities withas far as it is required by separate regulations - 1) current license issued by the Energy Regulatory Office for natural gas trading covered by this contract, in accordance with the requirements of the Act of 10.4.1997 Energy Law (Journal of Laws of 2017, item. 220, as amended),

2) the current license issued by the Energy Regulatory Office for conducting operations in the field of natural gas distributionon this order, in accordance with the requirements of the Act of 10.4.1997 Energy Law (from 2017, item 220, as amended), applies to Contractors who are DSOs - or a statement that as at the date of submitting the offer, the Contractor has a contract enabling the sale of natural gas via the distribution network concerns Contractors who are not the owners of the distribution network. - Contractors jointly applyrequesting the award of a contract with regard to the requirements regarding the competence or entitlements to conduct a specific professional activity, they should meet you with Contractors who jointly act, who will actually implement part of the order to which performance is required to possess statutory rights. In order to confirm initially that the Contractor is not subject to exclusion, he must submit an akas at the day of submitting bids, a declaration submitted in the form of a Single European Order Document (EED), attachment No. 5 to the Terms of Reference, to the extent indicated by the Ordering Party in the notice of procurement and SIWZ. The information contained in the EED will constitute a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings. - drawn up in accordance with Formularthe Single Order Document constituting Annex No. 2 to the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form of the European order document (Official EU L 3/16) to the extent indicated in Annex No. 5 to the SIWZ. 3. Performer, who intends to entrust the execution of a part of the order to subcontractors, in order to demonstrate the lack of existence of grounds for exclusion from participation in the proceedings, submit the EJM referred to in paragraph 1 for these subcontractors

4. The ordering party shall call the Contractor whose tender has been best assessed before submitting the order, to submit within the prescribed, not shorter than 10 days, the valid date as atń submission of the following documents listed in Section III.1.2. ie

1) the current license issued by the Energy Regulatory Office for natural gas trading covered by this contract, in accordance with the requirements of the Act of 10.4.1997 Energy Law (Journal of Laws from 2017, item 220, as amended) );

2) current license issued by the Energy Regulatory Office for conducting distribution activitiesji natural gas covered by this order, in accordance with the requirements of the Act of 10.4.1997 Energy Law (from 2017, item 220, as amended) applies to Contractors who are DSOs - or a statement that as of the day of submitting the offer, the Contractor has the contract enabling the sale of natural gas through the distribution network concerns Contractors who are not the owners of the distribution network

3) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the Act and convictions for offenses on custody in the scope specified by the Employer pursuant to art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

4) a certificate from the competent head of the tax office confirming thatthe creditor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submitting bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally binding exemption, postponing or spreading overdue installments-payment or suspension in full of the decision of the competent authority; - 5) certification of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before the deadline ofa tender offer or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of such receivables together with any interest or fines, in particular he obtained the legally required exemption, postponement or spreading overdue installments or suspension in full of the decision of the competent authority ;

6) excerpt from the relevant register orfrom central records and information on business activities, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act or will not call if it is obtained by means of free and publicly accessible databases of details of public registers;

7) the Contractor's statement about the lack of the issuance of rights to itthe verdict of the court or the final administrative decision on the late payment of taxes, fees or social security or health insurance premiums or in the event of issuing such a verdict or decision documents confirming the payment of these claims together with any interest or fines or a binding agreement regarding repayment of such receivables position patternand Annex 6 to the ToR,

8) the Contractor's statement that the final judgment of the conviction court has not been issued for violation of liberty or a fine to the extent specified by the awarding entity on the basis of art. 24 sec. 5 points 5 and 6 of the Act - the model is attached as Annex 6 to the ToR,

9) the Contractor's statement about the lack of a decision against him as a preventive measure for the prohibition to apply forpublic model exemptions constitute Annex 6 to the ToR;

The contractor will be bound by the offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

2. The Contracting Authority informs that in the present proceedings Article 24aa paragraph 1 of the Public Procurement Law, ie the Ordering Party will first evaluate the offers and then examine whether the Wykothe winner, whose offer has been assessed as the most advantageous, is not subject to exclusion.

3. Along with the offer, the Contractor is obliged to submit:

1) a current declaration on the day of submitting offers submitted in the form of a Single European Order Document (EIN) Annex No. 5 to the Terms of Reference, to the extent indicated by the Ordering Party in the notice of procurement and the ToR. Information contained in EATthey will constitute a preliminary confirmation that the Contractor terms of participation in the proceedings; prepared in accordance with the Single Order Document Form constituting Annex No. 2 to the Commission Implementing Regulations (EU) 2016/7 of 5.1.2016 laying down a standard form of the European order document (Official Journal EU L3 / 16) to the extent indicated in Annex No. 5 to the ToR. 2) ftender offer, constituting Annex No. 1 to the ToR,

3) price form / e, constituting the Annex / and No. 2.1, 2.2, 2.3, 2.4, 2.5 to the ToR,

4) power of attorney or legal authorization in the original or in the in the form of a notary certified copy, given to the person / persons signing / signing the offer, if the right to represent the Contractor in the above-mentioned scope does not result directly from the registration documentester.

4. When joining the proceedings, the Contractor is obliged to pay a bid bond in the amount of: - for part of the order No. 1 450.00 PLN (in words: four hundred fifty PLN 00/100), - for part of the order No. 2 PLN 29, 000.00 (in words: twenty nine thousand PLN 00/100), - for part of the order No. 3 PLN 150.00 (in words: one hundred and fifty PLN 00/100), - for part of the order No. 4 PLN 450.00 (in wordsie: four hundred and fifty PLN 00/100) - for part of the order No. 5 PLN 12, 000.00 (in words: twelve thousand zlotys and 00/100)
