The subject of the order is a comprehensive supply (sale and distribution) of high-methane gas type E (GZ-50) up to 3 consumption points through existing 3 gas connections. Total estimated gas consumedo by the Mine during the year is 11 830 MWh.

The subject of the order is a comprehensive supply (sale and distribution) of high-methane gas type E (GZ-50) to 3 consumption points through existing 3 gas connections. The total estimated amount of gas consumed by the mine during the year is 11 830 MWh.

ConnectionNo. 1: Wieliczka Park Kingi 1 - power ordered 2743 kWh / h estimated amount of gas consumed: 9 255 MWh for the needs of 3 gas boiler rooms located in the Wieliczka Salt Mine:

a) boiler room "Kuźnia", equipped with two Vitomax 200 condensing boilers HW Viessmann with one boiler capacity 1850 kW

b) boiler room "New Assortments" equipped with two Vitocrossal 300 HW Viessmann condensing boilerswith one boiler capacity 345 kW

c) Daniłowicz boiler room equipped with two Vitomax 200 HW Viessmann condensing boilers with one boiler power 785 kW

For Connection No. 1, 2 and 3: The ordering party is not releasedfrom excise tax based on art. 31b par. 2 of the Excise Duty Act (ie OJ of 2014, item 752).

The gas consumption forecast for individual connections serves only to compare offers and in no case does it constitute a commitment to purchase gas in the given amount from the Employer.

Supply of gaseous fuel will take place on the terms specified in the Act of 10.4.1997 Energy Law (OJ from 2012, item 1059), secondary legislation to this act and generally binding legal regulations.

Settlements will be based on current indications of measurement systems located in the following locations:

a) connection No. 1: Wieliczka Park Kinga 1 (supplies gas to the Mine's facilities, except for the Brewery soli)

b) connection No. 2: Wieliczka Park Kinga 1 (supplies gas to the buildings-Warzelni soli) - c) connection No. 3: Wieliczka Kosciuszki Square 10 - The Contractor, based on the Power of Attorney granted will be obliged to: a) report to the indicated Distribution System Operator for the execution of a contract for the sale of gas concluded with the Contractor,

b) actions in the field of pronouncing hitherto binding comprehensive gas sales contract, - c) representing before the relevant System OperatorDistribution emu in cases from

I. According to art. 22 ust. 1 of the Act on the award of the contract may apply to Contractors who meet the conditions for:

1) competence or entitlement to conduct a specific professional activity:

a. entry into one of the professional or trade registers kept in a Member State of the European Union, in which the Contractor has a registered office, specified in theconnector XI to Directive 2014/24 / U or meet other requirements specified in this Annex or entry to the Central Register and Information on Business Activity

b. current concession for running a business in the scope of trade (sales) with natural gas, issued by the President of the Energy Regulatory Office,

c. current concession to conduct business in the field of distributionnatural gas issued by the President of the Energy Regulatory Office - in the case of Contractors being the Operator of the Distribution System,

d. current agreement with the Distribution System Operator (DSO) for the provision of gas distribution services in the area where the place of natural gas collection is located - in the case of Contractors who are not owners of the distribution network.

2) economics situationor financial ordering does not establish a specific condition in this respect

3) technical or professional capacity - evidence of proper performance or performance within the last 3 years before the deadline for submission of bids, and if the period of business is shorter during this period, at least two natural gas supplies not less than PLN 500, 000.00 beach, with their value, subject, dates of completion or performance, and entities for which deliveries have been made or are made, and attaching evidence determining whether these deliveries have been made or are carried out properly, while the evidence referred to is references or other documents issued by the entity for which the delivery was or is being performedand if for a justified reason of an objective nature the contractor is unable to obtain these documents - a statement by the contractor. the conditions for participation in the proceedings will be made on the basis of the submitted documents set out in Part VIII of the specifications.

II. 1. The Awarding Entity will exclude from the proceedings for awarding public procurement of Contractors, wobec which the circumstances referred to in art. Paragraph 24

. 1 of the Act, subject to the provisions of art. 24 sec. 7 11 of the Act

2. The Employer will exclude from the proceedings for awarding public contractors, referred to in art. 24 sec. 5 points 1-8 of the Act, subject to the provisions of art. 24 sec. 8-9 of the Act

III. In order to initially confirm compliance with the conditions for participation in the proceedings and bThe Contractor is obliged to submit a declaration submitted in the form of a single European order document (hereinafter referred to as "EAT"), using means of electronic communication.

The Ordering Party does not set a specific condition in this respect - the Purchaser, prior to granting the order, will call the Contractor whose offer will be the highest rated, to submit inwithin 10 days, below statements or documents (valid as at the date of submission) confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion, subject to points 9 and 10:

1) with respect to competences or privileges to conduct professional activity by the Contractor: - a document confirming that the Contractor isentered into one of the professional or trade registers kept in a Member State of the European Union in which the contractor has its registered office or place of residence, - current license for running a business in the scope of natural gas trading, issued by the President of the Energy Regulatory Office, - current concession for conducting business in the field of distributionand natural gas, issued by the President of the Energy Regulatory Office - in the case of Contractors being the owner of the distribution network

- a statement of having a contract or a current contract with the Distribution System Operator (DSO) for the provision of gas distribution services in the area where the natural gas reception facility is located - for Contractors who are not Owners of the dis2) in relation to technical or professional capacity of the Contractor, a list confirming proper performance or performance within the last 3 years before the deadline for submission of bids, and if the period of business is shorter during this period, at least two natural gas deliveries with a value less than PLN 500, 000.00 each, including their value, pthe object, dates of completion or performance and entities for which deliveries have been made or are carried out, and attaching evidence determining whether these deliveries were made or are duly performed, while the evidence referred to are references or other documents issued by the entity, for which the delivery was or is performed and if for a justified reason aboutThe contractor is unable to obtain these documents in a subjective capacity - the contractor's statement. The Contractor is not obliged to submit the evidence referred to above, if the Ordering Party is an entity for whose delivery indicated in the list has been previously made. The list model is attached as Annex 4 to the specification.
