"S.N.T.G.N. Transgaz S.A. has in operation to monitor the chemical composition and physical quantities calculated from the chemical composition (upper and lower calorific value, Wobbe figure) a number of 90 gas chromatographs online model ABB NGC 8200 (8206 and 8209).

The contracting entity will conclude a framework agreement by which it acquires ABB NGC 8200 (8206 and 8209) model line ABB NGC 8206 and 8209, the estimated maximum value of the framework agreement being RON 3, 826, 240 without VAT. Estimated value of largest contract: 1 015 156 RON. Minimum quantities that can bethe subject of the framework agreement: 383 service provision (360 for revision works, 19 for electronic components replacement and 4 for intervention and accidental repairs). Maximum amounts to be covered by the framework agreement: 559 (360 for revision works, 19 for electronic components replacement and 180 for incidental and incidental repairs). Minthe following may be subject to the following contracts: 110 (90 for revision works, 19 for electronic components replacement and 1 for incidental repairs and repairs); maximum quantities that may be subject to the following contracts: 154 (90 for revision works, 19 for electronic components replacement and 45 for intervention and accidental repairs). rubof the following contracts: estimated 1 subsequent contract / year.

Both the economic operators participating in the procedure and the third party supporters, the subcontractors, as the case may be, should not find themselves in the situations stipulated in art. 177, 178 and 180 of Law no. 99/2016. The mode of fulfillment by which the fulfillment of the requirement can be demonstrated: DUAE will be completed, in accordance withwith the notification of ANAP no. 240/2016, both by the economic operators participating in the procedure and by third parties, subcontractors, as the case may be, with information related to their situation (bidders, third parties, subcontractors, as the case may be). The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted at the request of the entity accountonly by the bidder placed on the first place in the interim ranking made after the tender evaluation has been completed. These documents may be: (1) certificates of absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget at the time of their presentation; (2) the criminal record of the economic operator and memberthe management or supervisory body of that economic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 179 par.(2), art. 180 par. (2), art. 184 of Sector Procurement Law 99/2016

4) Other editing documents, as appropriate.

Foreign natural / legal persons wishing to participate in the proceedings shall submit any supporting evidence issued by the competent authorities of the country in which they are residents to prove the fulfillment of the requirement.

Both the econo operatorssmall participants in the procedure, as well as third party supporters, the subcontractors, as the case may be, should not be present in the situations provided by art. 73 of the Law no. 99/2016 on sector acquisitions. Based on the provisions of art. 186 of Law no. 99/2016 regarding the sector acquisitions, the economic operators submitting the tender must prove their personal situation (the registration form or the professional membership in accordance with the legal requirements of the country where the economic operator is established). In this regard, the operatorsthe economic tenderers must prove a form of registration under the law of the country of residence, show that the economic operator is legally constituted, is not in any of the situations of cancellation of the establishment, and that it has the professional capacity to perform the activities that are the object of the contract.

If 2 or more bids are ranked first, with equal scores, the contract will be awarded to the bidder whose the financial proposal has the lowest price. Where the initial submissions are equal, the contracting entity shall require theSEAP of a new financial proposal, and the contract will be awarded to the bidder whose financial proposal has the lowest price. Requests for clarification will be addressed by economic operators interested exclusively in the SEAP section Questions. We draw attention to the fact that the files attached to the clarification requests are visible to all participating economic operators. We recommend that they do not contain identification data that may disclose the identity of the requesting economic operators, otherwise they assume the disclosure of their identity. The contracting entity states that it will only respond to clarification requests from economic operators within the deadline set in the awarding documentation. In the case of joint offer all signatories hereAssociation Association will complete each DUAE separately with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE in sections III.1.1.a), III.1.1.b), III.1.3.a) shall be submitted at the request of the contracting entity. In the case of joint offer, technical and professional capacity is demonstrated by taking into accountof the cumulated resources of all members of the group. Requirements for the submission of specific authorizations to be found in Section III.1.3.a) are considered to be met if the economic operators who jointly participate in the III.1.1.a) procedure, the nominated subcontractor, if any, holds the required authorization and only with the condition that he execute the oppositefor which that authorization is requested. Bidders assume sole responsibility for the legality and authenticity of the SEAP loaded offer.
