6.3. If the contractor is established or locatedresiding outside the territory of the Republic of Poland, instead of the documents referred to in: a) point VI.6.2b of the SIWZ shall provide information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has a registered office or place of residence, the person concerned is information or document, to the extent specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law - issued not earlier than 6 months before the deadline for submitting bids,

b) point VI.6.2 c) The ToR shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that: - no liquidation has been opened or bankruptcy declared - issued nnot earlier than 6 months before the deadline for submission of tenders.

6.4. If in the country in which the contractor has its registered office or place of residence, the documents referred to in point VI.6.3 of the ToR are not issued, they are replaced by a document containing the contractor`s statement, indicating the person or persons entitled to its repor the statement of the person to whom the document was to be applied, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the seat or place of residence of the contractor or place of residence of that person. Entries regarding deadlines for issuing documents, as per point VI.6.3. Terms of Reference.

6.5. Contractor havingregistered office on the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in point VI.6.2b) of the ToR, submits the document referred to in VI.6.3.a) SIWZ, to the extent specified in art. 24 sec. 1 points 14 and 21 of the Public Procurement Law If in the country where the person whose document was to reside is in the place where he / she resides, nosuch documents are issued, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or professional self-government or economic authority competent for the place of residence of that person. Entries regarding deadlines for issuing documents, in line with point VI.6.3a) of the ToR

6.6. The contracting party demands from the contractor whory relies on the abilities or situation of other entities under the terms of art. 22a of the UPZp, submission of documents mentioned in point VI.6.2.a) to e) of the ToR.

The ordering party does not require a requirement.

6.7. The contracting authority does not request the contractor to present the documents listed in point VI.6.2.a) to e) of the ToR concerning subcontractors, he intends to entrust the track with the execution of a part of the order, and which is not an entity on whose capacity or situation the contractor relies on the principles set out in art. 22a uPzp.

6.8. In the case of joint application for contractors: - - EAT each contractor jointly applying for the order. These documents are to confirm the lack of grounds for exclusion to the extent that keach of the contractors shows no grounds for exclusion, - EAT each submitted by the contractors jointly applying for the order. These documents confirm fulfillment of the conditions for participation in the proceedings in the scope in which each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings - 6.9. Documents to be submitted by the contractor to confirm that the subject matter of the order corresponds to the requirementspecified by the Employer

1) The completed and signed Technical Parameters List printed according to the appendix No. 4 to the Terms of Reference,

6.10. The ordering party shall call the Contractor whose bid has been the highest rated, to submit within the prescribed period, not shorter than 10 days, valid as of the date of submitting statements or documents referred to in item VI.6.2. b) to e) SIWZ) and VI.6.9. The ToR, subject to art. 26 par. 6 uPp.

6.11. If the contractor fails to submit the statement referred to in point VI.6.2a) of these ToR, statements or documents confirming the circumstances referred to in art. 25 para. 1 uPzp, or other documents necessary to conduct the proceedings, statements or documents are incomplete, contain errors or bthey will address the doubts indicated by the ordering party, the contracting authority will call for their submission, supplementation and correction by the date indicated by them, unless despite submitting them the offer of the contractor would be subject to rejection or the procedure would have to be annulled - 6.12. In the scope of non-regulated SIWZ, the provisions of the Regulation of the Minister of Development of 27.7.2016 on type are applicabledocuments that can be requested by the contracting party from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126, as amended). Contractors may participate in the proceedings who are not subject to exclusion from the public procurement procedure in the circumstances referred to in art. 24. paragraph 1 point 12-23 uPzp. and in art. 24. paragraph 5 points 1 uPpp.

Point VI. 6.2. List of statements ordocuments confirming the lack of grounds for exclusion:

a) valid as of the date of submitting offers a declaration in the form of a Single European Order Document (hereinafter: EAT) in the scope indicated in Annex 2 to the Terms of Reference - The information contained in the statement will provide preliminary confirmation that the contractor is not subject to exclusion. b) information from the National Criminal Register in the scope ofeated in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Act, issued not earlier than 6 months before the deadline for submitting bids,

c) excerpt from the relevant register or central records and business information, if separate regulations require entry in the register or records in order to confirmation of the lack of grounds for exclusion pursuant to art. 24 sec. 5 pt 1 uPzp,

d) declaration madea person who fails to issue a final court decision or a final administrative decision on defaulting taxes, fees or social or health insurance premiums, or in the event of a verdict or decision confirming the payment of such claims together with any interest or fines or the conclusion of a binding agreements in casesNot repayment of these debts, - e) a statement by the contractor about the lack of a ruling against him as a preventive measure of the prohibition to apply for public orders, - f) Contractor, within 3 days of posting on the website information referred to in Article. 86 par. 5 uPzp, shall provide the Ordering Party with a declaration of affiliation or lack of belonging to the same capital group of whichreferred to in art. 24 sec. 1 point 23 of the Act on Enforcement Annex No. 5 (a or b) to the ToR. With the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure.
