Purchase of fuels liquid for the needs of NASK PIB company cars

1. The subject of the order is the gradual purchase of liquid fuels, i.e. bezo gasolinecatch oil PB 95, diesel oil (hereinafter referred to as "fuels"), engine oil (suitable for engines in company cars), windscreen washer fluid (summer and winter), car chemistry, small car accessories for company cars used by the Employer and the possibility of payment for washing cars at station automatic car washes, and for bringing them intoll motorways and toll roads (called non-fuel items). The purchase will be carried out at the fuel stations indicated by the Contractor located in Poland, at which the Contractor will provide the Purchaser with the possibility of making purchases in a non-cash form, on the terms specified in the contract, which will be concluded as a result of the settlement of these proceedings.

1. Subject ofthe purchase of liquid fuels, i.e. unleaded PB 95 gasoline, diesel oil (hereinafter referred to as "fuels"), engine oil (suitable for engines in company cars), windscreen washer fluid (summer and winter), car chemistry, small car accessories for company cars used by the Employer and the possibility of paying for washing pcars at station automatic car washes, and paying tolls for highways and toll roads (called non-fuel items). The purchase will be carried out at fuel stations indicated by the Contractor located in Poland, at which the Contractor will provide the Purchaser with the possibility of making purchases in a non-cash form, on the terms specified in the contract, which will be concluded inthe outcome of these proceedings.

2. The term of the contract: 48 months from the date of signing the contract or until the maximum contract value has been exhausted, whichever comes first. The total deadline for completing the order (including the option right) may not exceed 72 months.

1. Contractors who can apply for the contractmeet the condition of participation in the proceedings regarding:

1) competence or authorization to conduct specific professional activities, if it results from separate provisions:

The Contractor should have a current license for trading in liquid fuels (OPC), issued by the President of the Energy Regulatory Office, in accordance with art. 32 section 1 point 4 of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2019 afterz. 755 with later as amended).

Statements or documents confirming that the Contractor meets the conditions for participation in the proceedings:

a) current concession for trading in liquid fuels (OPC), issued by the President of the Energy Regulatory Office, in accordance with the Energy Law of 10.4.1997 ( i.e. Journal of Laws of 2019, item 755, as amended).

The Employer does not allow submission of variant and partial bids.

The Employer does not provide for settlement in foreign currency.

The Employer does not provide for electronic auction. referred to in art. 29 paragraph 3a of the Public Procurement Law regarding employment of persons

Employer not prenvisages the requirements referred to in art. 29 paragraph 4 of the Public Procurement Law regarding employment of persons.

The Employer does not reserve the obligation for the Contractor to perform key parts of the contract personally.

The Employer does not allow the submission of an offer in the form of electronic catalogs or attach electronic catalogs to the offer.

The Employer does not envisage the conclusion of a framework agreement and does not establish a dynamic purchasing system.

The Employer, acting pursuant to Art. 24aa of the PPL Act, will first evaluate the offers and then examine whether the Contractor whose offer has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure.

The contract may be awardedContractors who are not subject to exclusion from the procurement procedure on the basis of art. 24 paragraph 1 point 12 23 of the PPL Act and para. 5 points 1 3 and 8 of the PPL Act

At the request of the Employer, the Contractor is obliged to submit the following statements or documents confirming the lack of grounds for exclusion:

1) current information from the National Criminal Register regardingin art. 24 paragraph 1 point 13, 14 and 21 of the Public Procurement Law;

2) a current certificate of the competent head of the tax office confirming that the Contractor is not in arrears with tax payments;

3) a current certificate of the relevant local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document;

4) excerpt from the relevant register or from centlegal records and information on business activities, if separate provisions require an entry in the register or records;

5) the Contractor's statement that he has not issued a final court judgment or a final administrative decision regarding arrears with payment of taxes, fees or social or health insurance contributions;

6) statements of the Contractor about the lack of judgment against him youthe body of a preventive measure of the prohibition to apply for public contracts;

7) the Contractor's declaration of non-payment of local taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (i.e. Journal of Laws of 2018 item 1445, 1588, 1669).

Within 3 days of posting on the website, i.e. the information platform referred to in art. 86 section5 of the Public Procurement Law, provides the Employer with a declaration of belonging or not belonging to the same capital group.

The offer validity period is 60 days.

The offer is a completed and signed "Offer" form prepared on the basis of the template constituting Annex 1 to Volume I of the SETC-IDW together with:

the price form prepared on the basis of the template constituting Annex 2 to Volume I SIWZ-IDW.

To the offer, the Contractor is obliged to attach the JEDZ statement valid as at the date of submitting the offers, as well as other statements or documents referred to in the ToR.
