The subject of the orders are forest management services as defined in art. 6 par. 1 point 1 of the Act of 28.9.1991 on forests (consolidated text: Journal of Laws of 2017, item 788 with further amendments: "Law on forests") including works on harvesting and skidding of timber, forest breeding, forest protection, fire protection together with the service of the Alarm-Instruction Point(PAD) and fire detectors, maintenance of necessary fire, educational and tourist infrastructure, use of a forest side, water melioration, seed production including tree and forest bush harvesting and forestry schooling, to be carried out in the Myszyniec Forest District in 2019.

Detailed description the work was included in the ToR.

The subject of the order was divided intoparts for three (3) parts (hereinafter: "Package") "

Package I: forestry: Białusny Lasek, Brzozowy Kąt, Czarnia, Rutkowo, Raw, Zdunek, Wykrot, Forest School Zawodzie, Emergency and dispositional point, fire brigade Birch Angle ;

Package II: forestry: Kadzidło, Podgorze, Dylewo, Karaska, Podgorze Fire Brigade;

Package III: forestry: Warmiak, Rudne, Serafin, Lipniki, fire brigade Dęba

I would. The ordering party requires a bid bond in the amount specified below:

For Package I in the amount of PLN 24, 000

For Package II in the amount of PLN 13, 000

For Package III in the amount of PLN 13, 000

The bid bond should be submitted before the deadline for submitting bids.

II. The bid bond can be contributed in one or more of the following forms:

1) money,

2) bank guarantees or societal bond guaranteescredit-related, but the surety is always a cash guarantee,

3) bank guarantees,

4) insurance guarantees,

5) sureties granted by entities referred to in art. 6b par. 5 points 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (consolidated text: Journal of Laws of 2018, item 110, as amended).

III. Deposit paid in cash nsend a bank account number to the bank account of the Ordering Party at bank PKO BP: 79 1020 3802 0000 1502 0049 8683 with a note: a deposit for the protection of the offer in the "Forest services in the Myszyniec Forest District in 2019, Package ___________________." The payment of a deposit in cash will be effective if it is credited to the given datebank account of the Employer.

IV. The bid security raised in a form other than money can be attached in original to the offer or placed in the original before the deadline for submission of offers at the headquarters of the Ordering Party (room No. 3 - secretariat). The bid bond must secure the offer for a given part of the order throughout the period of being bound by the offer.

V. The content of the bid bond / guarantee must contain the following itemsementy:

1) name of the principal (Contractor), beneficiary of the guarantee / surety (Ordering Party), guarantor (bank or insurance institution providing guarantees / sureties) and indication of their registered office,

2) specification of the claim to be secured by a guarantee / surety specifying order item

3) the amount of the guarantee / surety,

4) the obligation of the guarantor / guarantor to zapand unconditionally, the amount of the guarantee / surety at the first written request of the Employer in the circumstances specified in art. 46 ust. 4a PZP and art. 46 ust. 5 PPL.

VI. The offer of the Contractor, which will not bring the bid bond or will not secure the offer with an acceptable form of the bid bond within the prescribed period, will be rejected on the basis of art. 89 paragraph 1 point 7b of the PZP. 1. For the performance of the Subject of the Agreement, The Contractor will receive a remuneration determined based on the Offer expressed in Polish zlotys (PLN) gross. The amount of gross remuneration referred to in the preceding sentence is the value of the Subject of the Contract.

2. The amount of gross remuneration does not include works performed as part of the Option.

3. The remuneration due to the Contractor for the performance of the works constituting the subject of the awarded Orders shall be calculated on the basise the number of received works, according to unit prices given in the Offer Quotient included in the Offer.

4. Unit prices will not be subject to changes during the implementation of the Contract, subject to the provisions contained in the ToR. The Contractor hereby confirms that unit prices for the performance of individual works include all costs related to their performance.

5. The Employer will pay the Contractor-for work carried out in accordance with the care specified in the contract, confirmed in the Robot Pickup Reports, referred to in the ToR.

6. The Parties agree that the Ordering Party may deduct from its remuneration any cash receivables due from the Contractor under the Agreement, including in particular contractual penalties, damages for improper performance of the Subject of the Agreement, including compensation for damage exceedingamount of reserved contractual penalties, insurance costs of the Contractor and costs incurred by the Employer in connection with the Substitute Implementation.

7. The remuneration shall be payable upon receipt of the subject of the Order or part of the subject of the Order, based on the invoice.

8. The remuneration shall be the product of the unit prices indicated in the Offer Costing and included in the Offer for each individualce and the number of works carried out.

9. The remuneration shall be payable within 21 days of delivery of the correct invoice to the Contracting Party. The basis for issuing the invoice by the Contractor shall be Robot Records Reports

10. Subject to the provisions of item 13, the Remuneration shall be payable to the Contractor's bank account indicated in the invoice. The payment day is the day of the paymentbank account of the Employer.

11. The VAT tax will be calculated in the amount valid on the day of issuing the invoice.

12. The Contractor acknowledges that the Employer when paying Remuneration will apply the mechanism of split payment, referred to in art. 108a para. 1 of the Act of March 11, 2004 on tax on goods and services (consolidated text: Journal of Laws of 2017, item 1221, as amended).

13. Payment:

1) the amount corresponding to all or part of the tax amount resulting from the invoice received will be made to the Contractor's VAT account within the meaning of art. 2 point 37 of the Act of March 11, 2004 on tax on goods and services (consolidated text: Journal of Laws of 2017, item 1221, as amended),

2) the amount corresponding to the net sales value resulting from the invoice received is made on the invoicea bank statement or an account in a co-operative savings and credit union for which the Contractor's VAT account is kept.

14. The Contractor may not, without the prior consent of the Employer expressed in writing under pain of nullity, transfer to any third party any claims under the Agreement.

15. Making a payment to a bank account and a VAT account (within the meaning of Article 2, point 37-The Act of 11 March 2004 on the tax on goods and services (consolidated text: Journal of Laws of 2017, item 1221, as amended) of the consortium member indicated releases the Employer from liability towards all members of the consortium.

Contractors may participate in the proceedings, who are not subject to exclusion from the procurement procedure in the circumstances referred to in art. 24 sec. 1 pkt 12-23 PZP, art. 24 sec. 5 points 1 2 and 4 8 PPL. On the basis of:

1) art. 24 sec. 5 point 1 PZP ordering will exclude from the procedure for awarding a public contractor, in relation to which the liquidation has been opened, the court approved in the restructuring proceedings is foreseen to satisfy the creditors by liquidation of its assets or the court ordered its liquidationin the mode of art. 332 par. 1 of the Act of 15 May 2015 - Restructuring Law (consolidated text Journal of Laws of 2017, item 1508 as amended) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded a system approved by lawful court order, if the agreement does not provide for the satisfaction of the creditors by liquidating the assets of the bankrupt, unless the court ordered liquidationhis estate in the mode of art. 366 para. 1 of the Act of 28 February 2003 - Bankruptcy Law (consolidated text Journal of Laws of 2017, item 2344, as amended);

2) art. 24 sec. 5 point 2 of the PPL The Employer will exclude from the proceedings for awarding a public contractor who is in a way seriously in violation of professional duties, which undermines his integrity, in particular when the contractor as a result of intentionalhe did not perform the action or gross negligence, or improperly performed the order, which the Purchaser is able to prove by means of appropriate evidence, - 3) art. 24 sec. 5 point 4 of the PPL The Awarding Entity will exclude from the proceedings for awarding a public contractor who, for reasons attributable to him, did not perform or did not properly execute the earlier contract ina public order or a concession contract, concluded with the ordering party referred to in art. 3 par. 1 points 1-4 of PPL, which led to the termination of the contract or award damages;

4) Art. 24 sec. 5 point 5 of the PPL The Awarding Entity will exclude from the proceedings for the award of a public contractor who is a natural person who has been validly convicted of an offense against the employee's rights or a criminal offensenot against the environment, if the commission was punished with arrest, restriction of liberty or a fine not lower than 3000 zlotys;

5) Art. 24 sec. 5 point 6 of the PPL The Awarding Entity will exclude from the proceedings for awarding a public contractor's contract if an official member of its management or supervisory body, a partner of the company in a registered or partner society or a general partner-in a limited partnership or limited joint-stock partnership or a commercial proxy, a final offense referred to in Art. 24 sec. 5 point 5 PZP;

6) art. 24 sec. 5 point 7 of the PPL The Awarding Entity will exclude a public contractor from the public procurement procedure against which a final administrative decision has been issued on violation of obligations under labor law, environment protection law orsocial security concessions, if a fine of not less than 3000 zlotys was imposed by this decision.

7) Art. 24 sec. 5 point 8 of the PPL The Awarding Entity will exclude from the proceedings for awarding a public contractor who has violated obligations relating to payment of taxes, fees or social security or health insurance premiums, which the Purchaser is able to demonstrate by means of appropriate measuresevidence, except in the case referred to in Article 24 sec. 1 point 15 of the PPL, unless the contractor has made payment of taxes, fees or social or health insurance contributions with interest or fines or has made a binding agreement regarding the repayment of these amounts.
