Implementation of forest management services in the area of the Forest District of Kolumna in 2019-2022

The subject of the contract is forest management services in accordance with the definition in art. 6 par. 1 point 1 of the Act of 28.9.1991 on forests (hereinafter referred to as the "Forest Act") covering works in the field of farmingand protection of the forest, fire protection, harvesting and skidding of wood as well as works in the Animal Husbanding Center, seed production and advance and specialist soil preparation to be carried out in the Forest District in 2019-2022.

Making services from of forest management in the Tuszyn and Szczukwin Forests. followingthe types of works fall within the scope of the subject of the order:

According to art. 24. para. 1. from the procedure for awarding the order is excluded:

12) the contractor who did not show compliance with the conditions of participation in the procedure or was not invited to negotiate or submit initial offers or offers, ub did not show no grounds for exclusion;

13) a contractor who is a natural person who has been validly convicted of a crime: a) referred to in art. 165a, art. 181-188, art. 189a, art. 218-221, art. 228-230a, art.250a, art. 258 or art. 270-309 of the Act of 6.6.1997 Penal Code or art. 46 or art. 48 of the Act of 25.6.2010 on sport, b) of a terrorist character, referred to in art. 115 - 20acts from 6.6.1997 Penal Code, c) fiscal, d) referred to in art. 9 or art. 10 of the Act of 15.6.2012 on the consequences of entrusting work to foreigners staying against the provisions of the territory of the Republic of Poland;

14) the contractor, if a member of its management or supervisory body, a partner of a company in a registered partnership or a general partner in the societya mandate or limited joint-stock or commercial proxy was convicted for the offense referred to in points 13;

15) of the contractor for whom a final court judgment or final administrative decision was issued on the payment of taxes, fees or social security or health insurance premiums, unless that the contractor made payment of taxes, fees or social insurance contributions dueor (ii) a contractor who, as a result of intentional or gross negligence, misleads the purchaser when submitting information that he is not subject to exclusion, fulfills the conditions for participation in the proceedings or objective and non-discriminatory criteria, hereinafter referred to as 'sel. criteria'"), or who has concealed this information or is unable to produce the required documents;

17) a contractor who as a result of reckless or negligent information misleading the ordering party, which could have a significant impact on decisions taken by the ordering party in the procurement procedure;

18) a contractor who unlawfully influenced or attempted to influence activities with(19) the contractor who took part in the preparation of the contract award procedure or employee, as well as the person who performs work on the basis of a contract of mandate, work, agency or other contract; contracts for the provision of services, participated in the preparation of such proceedings, unless causedthis distortion of competition may be eliminated in other ways than by excluding the contractor from participation in the procedure;

20) a contractor who concluded other agreements with other contractors to distort competition between contractors in the contract award procedure, which the contracting authority is able to demonstrate using appropriate evidence,

21) the contractor being a subject of the collection ofiorowego, in relation to which the court has ruled that it is forbidden to apply for public orders under the Act of 28.10.2002 on the liability of collective entities for criminal acts;

22) the contractor for whom the preventive measure was ordered to prohibit applying for public orders; ) contractors who, belonging to the same capital group, within the meaning of the Act of 16.2.2007 ooprotection of competition and consumers, separate offers, partial offers or requests to participate in the procedure, unless they prove that the links between them do not distort competition in the procurement procedure.

Orderwaiving the exclusion of the Contractor based on art. 24 section 5 of the Public Procurement Law - List of statements or documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion. A To assess compliance with the conditions for participation in the proceedings and the lack of grounds for exclusion referred to in Art. 24 sec. 1 item 12-22, the Contractor is obliged to send it to the deadline of submissionand offers EAT in electronic form with a qualified electronic signature. Declarations of entities submitting the offer / application jointly and entities making the potential submitted on the EAT form should be in the form of an electronic document, signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to incontent of art. 22 ust. 1 PPE sets

2. The electronic communication means used for depositing EAT by the contractor is e-mail. Attention. Placing an EAT along with an offer on a data carrier (eg a CD, a pendrive) is unacceptable, as it does not constitute its submission using means of electronic communication within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services.

B The ordering party, before awarding the contract, will call the contractor whose offer has been rated the highest, to submit within the prescribed period (not shorter than 10 days), valid at the day of submitting the following statements or documents:

B.1 confirming fulfillment of the conditions for participation in the proceedings in the scope of technical capacity orb professional: list of services and the list of devices indicated in paragraph III.1.3) announcements - B.2 confirming no grounds for exclusion from the proceedings:

a) information from the National Criminal Register in the scope specified by 24 sec. 1 point 13. 14 and 21stawy, issued not earlier than 6 months before the deadline for submitting bids or requests for participation in the proceedings.

B) statementcontractor for failure to issue a final court judgment or final administrative decision against him or her, in the event of late payment of taxes, fees or social security or health insurance premiums or in the event of such a decision or decision confirming the payment of such claims together with any interest or fines or conclusion of a binding agreements in-on the repayment of these receivables ..

c) the contractor's statement about the lack of a decision against him as a preventive measure for the prohibition of applying for public orders, - The offer validation period is: 60 days.

1. With the offer form (original) prepared according to of Appendix No. 1 of the Terms of Reference, please submit: - 1) a power of attorney to represent, if the offer is submitted by a plenipotentiary, if it is not a result of an excerpt fromof the relevant register or from the Central Register and Information on Economic Activity

2) In the case of submission of an offer by a consortium, civil partnership or natural persons acting jointly, attach the original power of attorney authorizing signing the bid to represent in the procedure submitting the bid or representing them in progress- the power of attorney should be submitted in the original or a photocopy confirmed for compliance with the original by a notary public. 3) the list of persons indicated in para. III.1.3) announcement - 4) an obligation of a third party or another document serving to demonstrate the availability of the potential to the contractor by a third party in accordance with point 7.3. SIWZ,

Ordering party in accordance with art. 24aa paragraph1 of the Public Procurement Law reserves the right to evaluate offers first, and then to investigate whether the contractor whose tender was rated as the most advantageous is not subject to exclusion and fulfills the conditions for participation in the proceedings - Documents relating to entities located outside the territory of Poland and residents outside the territory of the Republic of Poland, see points 7.6 - 7.8-The ToR at the publication address indicated in the introductory part of the announcement
