Amount of the participation guarantee: the guarantee is constituted according to art. 35, GD 395/2016, valid 60 days from the deadlineLimit for submitting bids. 1.Non Incorporation in the provisions of art.164 of Law no.98 / 2016 regarding the public acquisitions.

The framing of the situation stipulated in art. 164 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.
2. Non-compliance with the provisions of art. 165 of the Public Procurement Law no.98 / 2016.
The economic operator will fill in the corresponding requirement in the DUAE form in the documentation-award. The classification in the situation provided by art. 165 of the Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract.
3.Nonconcerning the provisions of art. 167 of the Law no. 98/2016 on Public Procurement.
The economic operator will fill in the appropriate requirement in the DUAE form in the documentation atribuire. The framing of the situation stipulated in art. 167 of the Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.
The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the tenderersIs the first 3 places after applying the award criterion, until the conclusion of the Award Procedure Report, art. 196 par.
