Factory supply of rotor and turbine gas meters for Polska Sp-łka Sp-łka Gazownictwa sp. Z o. O. for G400 and brand new turbine gas meters from G40 to G2500 for measuring gasfor earth groups E and L according to PN-C-04750: 2011 standards "Gas fuels. Classification, designation and requirements "(or equivalent) and PN-C-04753: 2011" Natural gas. The quality of gas supplied to customers from the distribution network. " (or equivalent).

The subject of the Order in Part 1 is the supply for the Ordering Party of brand new rotor gas meters with sizes from G10 to G400 up tomeasure of natural gas of groups E and L according to PN-C-04750: 2011 standards "Gas fuels. Classification, designation and requirements "(or equivalent) and PN-C-04753: 2011" Natural gas. The quality of gas supplied to customers from the distribution network. " (or equivalent).

Requirements to be met by the offered rotor gas meters:

1) Gas meters must be brand new and come from current production.

2) Gas meters musthave current documents allowing for issuing a Declaration of Conformity with Council Directive 2006/96 / EC of November 20, 2006

3) Gas meters must meet the requirements of PN-EN 12480: 2015 "Gas meters. Rotor gas meters "(or equivalent).

4) Gas meters must be delivered together with a certificate of initial verification together with the measurement results translated into Polish.

5) Gas metersthey must have protection against the illegal taking of gaseous fuel,

6) Gas meters must be characterized by consistent or better metrological repeatability and indication errors in the declared range of ambient and gas temperatures consistent or smaller than the requirements specified in PN-EN 12480: 2015 (or equivalent).

7) Gas meters must be made of corrosion resistant or security materialsbaked anti-corrosive, or be coated with paint.

8) Gas meters must meet the requirements of Directive 2014/34 / EU on the harmonization of the laws of the Member States relating to equipment and protective systems intended for use in potentially explosive atmospheres,

9) Gas meters must have clearly and permanently marked flow direction marked with an arrow between

10) Minimum ambient and gas temperature range required by the Employer: from -25 - C to 55 - C.

11) Gas meters must be able to work both horizontally and vertically. Changing the gas meter working position and the related need to rotate the gas meter counter must not damage the verification features.

12) Gas meters must be standard equipped with:

a) minimum 1reed switch low frequency pulse transmitter,

b) minimum 1 inductive low frequency pulse transmitter or other equivalent guaranteeing the correct transmission of pulses at a distance of not less than 50 m,

c) should be adapted to the installation of a high frequency transmitter.

13) For each gas meter be supplied:

a) three-way valve,

b) set of connecting bolts for connectionsof the gas meter with flanges of the piping system,

c) a set of gaskets matched to the flanges and the nominal pressure of the gas meter,

d) oil dedicated for a given gas meter in an appropriate quantity for a given gas meter,

e) a set of plugs or sockets enabling connection to the gas meter pulse outputs connecting wires of the gas volume calculator,

f) flat mesh filter.

14) Each gas meter supplied must be accompanied by a user manual in Polish containing at least descriptions of: purpose with technical characteristics, construction with drawing, method of assembly, operation.

15) Gas meters must have a guarantee granted by the Contractor for a minimum period of 3 years. . Offers with a guarantee period shorter than 3 years will be rejected as incompatible with the Terms of ReferenceZ.

16) According to art. 30 paragraph 4 of the Act, the Employer allows equivalent solutions described in the ToR by reference to standards, European technical assessments, approvals, technical specifications and reference systems referred to in art. 30 paragraph 1 point 2) and paragraph 3 of the Act.

A detailed description of the subject of the contract specifying the types of gas meters, technical requirements and quantities is included in Annex 1to the ToR.

I Contractors who can apply for the Contract:

1. They are not subject to exclusion from the procedure on the grounds referred to in art. 24 paragraph 1 point 12, 13 a) c), 14 (subject to point 7.1.3. Of the ToR) 23 of the Public Procurement Law, and also in the cases referred to in art. 24 paragraph 5 point 1 8 Pzp.

2. They have the competence or authority to conduct specific professional activitiesj, if it results from separate provisions. The Employer does not specify this condition in detail.

3. They are in a proper economic and financial situation.

4. They have specific technical or professional skills, i.e. they show that in the last three years before the deadline for submission of tenders, and if the period of business activity is shorter - during this period, they have completed (and in the case ofperiodic or continuous benefits are also provided by) deliveries of rotor or turbine gas meters (depending on the part of the order for which the offer is submitted) with a total total minimum value at least equal to the indicated amount for a given part of the order

II. The assessment of compliance with the above conditions will be made using the formula "meets-does not meet", based on information contained in JEDZ, a statementattachments and documents to be provided by the Contractors to confirm compliance with the conditions for participation in the procedure and the lack of grounds for exclusion from the procedure. For preliminary confirmation of compliance with the condition of participation in the procedure specified in point 6.1.2. The Terms of Reference will suffice for the Contractor to submit a proper statement in JEDZ in Part IV: Qualification criteria, section α.

IIAnd the Contractor may rely on the technical or professional ability or financial or economic situation of other entities to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contract, or a part thereof, regardless of the legal nature of the legal relations with it .

IV Together with the offer made on the form ofemercury constituting Annex 2 to the ToR, the Contractor submits:

1. Current statement as at the date of submitting bids to the extent indicated in these ToR in the form of a Single Document (EAT);

2. Justification of business secret, if the Contractor reserves the business secret in accordance with point 12.13 SIWZ.

3. Appropriate powers of attorney;

4. In the event that the Contractor relies on capabilities or sythe tuition of other entities - an obligation on those entities to make available to him the necessary resources for the implementation of the contract;

5. Document confirming payment of the bid security (details regarding the bid security were explained in section 10 of the ToR),

6. Documents referred to in - 8.3 of the ToR.

Offer with declarations referred to in points 8.1.1. - 8.1.2. above, the Contractor submits the requirementsow specified in points 8.4. and 8.6. - 8.11. SIWZ.

The offer with attachments and EAT should be submitted via the PSG Purchasing Platform.

V. The contracting authority informs that it will carry out the proceedings in accordance with art. 24aa of the Public Procurement Law.

The Employer does not specify this condition in detail.

Contractors are excluded from the procedure in the cases referred to in art. 24 paragraph 1 point 12, 13 a) c), 14 (with reservationpoint 7.1.3. SIWZ) 23 Pzp,

I. The Awarding Entity, before awarding the order, will call the Contractor whose bid has been best rated to be submitted within a designated period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph 1 Public Procurement Law, i.e.: Documents referred to in point III 1.3. of this announcement;

2) Inforation with KRK in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 Public Procurement Law and, regarding conviction for an offense to imprisonment, to the extent specified by the contracting authority pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months before the expiry of the time limit for submission of tenders (subject to the content of Article 133 (4) of the Public Procurement Law);

3) a certificate from the competent Head of Tax Office confirming thate the contractor is not in arrears with payment of taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines;

4) a certificate of the local organizational unit of ZUS or KRUS or another documentntu confirming that the contractor is not in arrears with payment of social or health insurance contributions, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these receivables with any interest or fines;

5) an excerpt from the relevant register or from CEiDG, if separate provisions require an entry in the register or records to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 item 1 of the Public Procurement Law;

6) the contractor`s statement that he has not issued a final court judgment against him or a final administrative decision on late payment of taxes, fees or social security or health insurance contributions, or in the event of suchego of the judgment or decision of documents confirming the payment of these receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of those receivables;

7) the contractor`s statement that there was no decision against him as a precautionary measure forbidding public procurement;

8) statements contractors about the failure to issue a final court judgmentwith a convict for an offense of restriction of liberty or a fine to the extent specified by the contracting authority pursuant to art. 24 (5) points 5 and 6 of the Public Procurement Law;

9) the contractor`s statement that he has not issued the final administrative decision regarding the breach of the obligations arising from the provisions of labor law, environmental protection law or social security provisions to the extent specified bye from the ordering party pursuant to art. 24 paragraph 5 point 7 of the Public Procurement Law;

10) the contractor`s declaration of non-payment of local taxes and fees, referred to in the Act on local taxes and fees;

11) the contractor`s declaration of belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the contractor may submit with a declarationdocuments or information confirming that links with another contractor do not lead to a distortion of competition in the proceedings.

II. III. The Contractor, within 3 days from the date of posting on the website the information referred to in Article 86 para. 5 Public Procurement Law, provides the Employer with a declaration of belonging or not belonging. to the same capital group.
