The subject of the order is to prepare a feasibility study for the task" Construction of the 2nd technological line in InSteel Processing with Recovery of Energy at PGE EC S.A. Elektrociepłownia Branch in Rzesz-w ".

The subject of the order is the preparation of a feasibility study for the task" Construction of the 2nd technological line in the Thermal Processing Installation with Energy Recovery at PGE EC S.A. Elektrociepłownia Branch in Rzesz-wie ". The detailed scope is specified in the Specification of Essential Terms of the Contract.

1. Contractors who may apply for the award of the Contract:

1) are not subject to exclusion pursuant to Article 24 paragraph 1 item 12 23 of the Act of 29.1.2004 Public procurement law (i.e. Journal of Laws of 2019, item 1843), hereinafter referred to as the Public Procurement Law, subject to Article 133 (4) of the Public Procurement Law and shall not be excludedu pursuant to art. 24 paragraph 5 point 1 of the Public Procurement Law

2. In order to demonstrate that the Contractor has met the conditions for participation in the procedure and to demonstrate that there are no grounds for exclusion, the Contractor is required to submit, together with the offer, the current statement as at the date of submitting the offers, referred to in art. 25a section 2 of the Public Procurement Law, in the form of a single European order document (EAT) according to the ordinance ofCommission Commission Regulation (EU) 2016/7 of 5.1.2016 establishing the standard form for the single European procurement document (OJ EU L3 / 16). The information contained in JEDZ constitutes preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. The Employer expects the Contractor to submit a general statement on meeting the conditions of participation in the EAT formin the proceedings in section α in Part IV EAT.

3. In order to demonstrate the lack of grounds for exclusion, the Contractor is obliged to submit within 3 days of placing on the website the information referred to in art. 86 section 5 of the PPL Act, a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the PPL Act

4. Based on Article. 26 section 1 of the Public Procurement Law, in order to demonstrate that the conditions for participation in the procedure have been met and to demonstrate that there are no grounds for exclusion, the Awarding Entity, before awarding the contract, will call the Contractor whose tender has been rated the highest to be submitted within a designated period of not less than 10 days, within the following documents:

a ) information from the National Criminal Register, to the extent specified in art. 24 paragraph 1 pkt 13 14 of the PPL Act, subject to art. 133 section 4 of the PPL Act valid as at the submission date (issued not earlier than 6 months before the submission deadline);

b) information from the National Criminal Record, in the scope specified in art. 24 paragraph 1 point 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

c) an excerpt from the relevant register or from the centerother records and information on economic activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Public Procurement Law;

d) the Contractor's statement that he has not issued a final court judgment or a final administrative decision regarding arrears with the payment of taxes, fees or insurance premiumssocial or health services, or in the event of the issuance of such a judgment or decision of documents confirming the payment of such receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these receivables;

e) the Contractor's statement that he has not been ordered to prevent him from applying for public procurement.

Ordersthe investor does not impose specific requirements for this condition.

1. The contracting authority informs that the public procurement procedure will be conducted using the PGE CG purchasing system. To submit an offer in the procedure, the Contractor is obliged to register in the PGE CG purchasing system available at: https://www.swpp2.gkpge.pl. Other information about the systempurchasing and submitting offers are included in the ToR.

2. The content of the Terms of Reference with attachments is available on the website of the Employer in the SWPP2 PGE system, https://swpp2.gkpge.pl.

3. The contractor may, to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contract or part thereof, rely on technical capabilitiesor the professional or financial or economic situation of other entities, regardless of the legal nature of the legal relations which it has with him.

4. The Contractor, which relies on the abilities or situation of other entities, must prove to the Employer that in carrying out the contract, he will have the necessary resources of these entities, in particular together with the offer presenting the commitment of these entitiesiotow to make available to him the necessary resources for the implementation of the order.

5. The Contractor, who refers to the resources of other entities, in order to demonstrate the lack of existence of grounds for exclusion and compliance with them, to the extent that he refers to their resources, the conditions for participation in the proceedings, also submits together with the JEDZ offer regarding these entities and on request Employerrelevant documents in accordance with the ToR.

6. The offer validity period is 60 days from the date of the offer submission deadline.

7. The contracting authority envisages the application, in accordance with art. 24aa of the PPL Act, reverse procedure (i.e. first evaluate the bids and then examine whether the Contractor whose bid was rated highest is not subject to exclusion and meets the conditions for participation inprocedure.)

8. The contracting authority allows the possibility of amending the public procurement contract on the terms set out in the draft contract annexed to the ToR.

9. The Employer informs that detailed information on the protection of personal data was included in item 32 of the Terms of Reference.
