The object of the contract is elaboration of the Feasibility Study and the Technical Implementation Project for the Exploration Road project Constanta Tulcein accordance with the requirements of the Terms of Reference and the relevant legislation.

Within the CTR Elaboration Feasibility Study and Technical Implementation Project for the Exploration Road project Constanta - Tulcea will be carried out and the following will be elaborated: • The Feasibility Study, taking into account the applicability of the legislator(Norms, Norms, Standards, Laws, etc.); • Preparation of Support and Assist documentation for the Beneficiary to support the financing application; • • Execution of the Project for the Authorization of the Construction Works (PAC) and technical assistance until obtaining the authorization construction by the Beneficiary (CNAIR); • The Technical Implementation Project (PTE) taking into account(Norms, Norms, Standards, Laws, etc.); • Documents for the award of the works; • Technical assistance granted to the Beneficiary during the execution of the procurement procedure for the execution of the Works

Conf. 20 of the CTR of services, which may be interrupted by the CTR, shall, without limitation, be limited to the modification of the Contracting Parties; schimb / modif legis / normative / STAS / norms / orders / instructions / etc .; (MT, MFE, Central and / or Local Institutions, ARR, Beneficiary, MIA, SRI, Certified Verifiers, Authorized Entities / Authorities) etc.), the term of delivery of the report / delivery (documents / documentation), poor mobilization of therestatorului; replace person nominated by the Provider for full CTR; replace / introduce subcontractors; application of the law on historical monuments, road safety audit, PUZ development, research requirements and archaeological works. Modifs will be the real CTR sign if they are contracted, only if they do not represent modest subst within the meaning of Art. 221 par. (7) of L98 / 2016.

Prel roughly CTR may be true as foreseen in Article 20 of the Service CTR. More information on CTR - See Appendix 1 to DA.

To demonstrate the fulfillment of the qualification criteria / requirements:

I. The sole Tender / Associate Bidder / Subcontractor / Tenderer must prove that it does not comply with the provisions of Art. 164 of Law no. 98 / 2016.

In this regard, Oferthe sole contractor / Associate Bidder / Subcontractor / Supportive Tertiary will complete the DUAE - Part III "Exclusion Reasons" - Section A "Reasons for Criminal Offenses."

Also, the Bidder ranked first after applying the award criterion prior to awarding the contract, shall submit, at the request of the Contracting Authority, the following supporting documentsza / confirms non-compliance with the situations stipulated in art. 164 above, both for the Single Offeror / Associate Offeror and for the Supported Subcontractor / Territory stated in the offer:

- the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator, or of the which have power of representation, decisionor control within it, as evidenced by the certifying certificate issued by the ONRC / Act of incorporation, - other editorial documents, as appropriate. The sole Tender / Associate Bidder / Subcontractor / Tenderer must prove that it does not comply with the provisions of Art. 165 of Law no. 98 / 2016.

In this respect, the Single Offeror / Associate Bidder / Subcontractor / TertuSupporter will complete the DUAE - Part III "Exclusion Reasons" - Section B "Reasons for Paying Taxes or Social Security Contributions."

Also, the bidder ranked first after applying the award criterion, prior to awarding the contract, will present, at the request of the Contracting Authority, the following supporting documents proving / confirming non-actionin the situations provided for in art. 165 above, both for the Single Offeror / Associated Offeror and for the Supported Subcontractor / Tertiary stated in the offer:

A. Romanian legal persons must submit: - a certificate of fiscal attestation regarding the fulfillment of the obligations to pay the taxes, of the contributions to the consolidated general budget, from which the shortage has occurredof the outstanding debts at the moment of its presentation B. Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country of origin (fiscal attestation certificates, criminal records, other equivalent documents, etc.) have fulfilled the obligations to pay taxes, duties or contributions to the budget gin accordance with the national law of the country of residence of the sole vendor / associated offeror / subcontractor / third party or the country in which the sole bidder / associated offeror / subcontractor / supporter is established. From the editorial documents submitted, there must be a lack of overdue debts at the time of their presentation. [...]

III. Athe sole trader / Associate Bidder / Subcontractor / Supporter shall prove that it does not comply with the provisions of Art. 167 of the Law no. 98 / 2016.

In this respect, the Single Offeror / Associate Bidder / Subcontractor / Supporter will complete the DUAE - Part III "Exclusion Reasons" - Section C "Reasons for Insolvency, Conflicts of Interest or Professional Misconduct."the same tenderer / Associate Bidder / Subcontractor / Supporter shall submit Form C "Statement of non-compliance with the provisions of Article 60 paragraph (1) of Law 98/2016", in accordance with the model presented in the Forms section. Requirement 1 The bidder must demonstrate that the total annual turnover was at least 7, 000, 000 Lei in each of the financial years 2016, 2017 and 2018.

Requirement 1 - continued

1) The deadlines specified in the Payment Agreement are justifiedthe complexity of the road infrastructure project (projects of major interest), as well as the financial circuits of the funds involving several state institutions, 2) the duration of the contract is 24 months starting from the starting date of the contract, 3) In order to complete DUAE, bidders will use the editable form provided by the Contracting Authority in SEAP, andin accordance with the model published by ANAP by the Notice of 1.9.2016. 5) The person who considers himself / herself injured by an act of the contracting authority may refer the National Council for the Solution of the Complaints to the cancellation the act of the Contracting Authority, its obligation to issue an act or to take remedial measures, preciting and for the recognition of the claimed right or of the legitimate interest, within 10 days, according to the provisions of art. 8 par. (1) lit. a) of Law 101/2016. For the judicial settlement, the person who considers himself / herself injured can appeal to the competent court, according to the provisions of art. 49 of Law 101/2016. To resolve the objection formulated in the conditions of art.8 or art. 49 of Law 101/2016, under the sanction of its rejection, the person who considers himself / herself injured should be a precaution in advance under the conditions provided by art. 61 index 1 of Law no. 101 / 2016.

Condition:

The conclusion of the public procurement contract is conditioned by obtaining / approving the financing of services from funds from the state budget and / or European funds nthe signing of the contract is possible only if the provisions regarding the commitment of the expenditures from the budgets that fall under the legislation on the public finances are observed. If, for any reason, the obtaining / approval of the financing of services from funds from the state budget and / or European non-reimbursable funds is not achieved, the Authoritythe Contractor shall apply the provisions of Art. 212 para. (1) lit. c) the second sentence of Law 98/2016, which is impossible to conclude the public procurement contract. Although at the date of initiation of this public procurement procedure there is no signed financing agreement, the Contracting Authority estimates that it will obtain the financing required to sign the contract in the second semester of 2019.
