Procurement and replacement of 4 escalators, including design and assembly, from the stationis under Basarab 1, Izvor and Timpuri Noi subway, respectively dismantling and installing new awnings in the Izvor and Timpuri Noi stations

Request no. 1 Declaration on non-compliance with the provisions of art. 177, 178 para. (1) and (2) and art. 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: the DUAE is completed by the economic operators participating in thewith information about their situation. This document will be completed by each of the tenderers / associated tenderers / proposed subcontractors / third party supporter.

At the request of the contracting entity, the supporting documents proving the fulfillment by the economic operators of the ones declared in the DUAE will be mandatory submitted by the first ranked bidder.

The right documentsthe following may be: - - Certificate of absence of debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation, - The judicial record of the economic operator and the members of the administration, management, supervision of the economic operator, those with power dis the representation, decision-making, control within it, as it results from the certifying certificate issued by the ONRC / constitutive document,

- Where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. 99/2016 on public procurement,

- Other editing documents, as appropriate.

At(including the associate / subcontractor) entails rejection of the offer as unacceptable.

Once the offer has been submitted and the DUAE, the tenderer has the obligation to submit the subcontracting agreement and / or the association agreement. foreigners will present any editorial documents issued by the competent authorities of the country in cthey are resident to prove the fulfillment of the obligations to pay the taxes / taxes / contributions to the state budget and the local budget, in accordance with the legislation of the country of residence.

If in the country of origin or in the country where it is established that the tenderer does not issue documents of the kind referred to in the first paragraph or that the documents are not concerned-all the situations provided in art. 177, 178, 180, a declaration shall be accepted on the tenderer's own responsibility or, in the absence of legal provisions on the declaration on his / her own responsibility, a genuine declaration given to a notary, an administrative or judicial authority or a professional association with competencies in this respect.

In the case offoreign legal entities, the documents shall be accompanied by a certified translation in the Romanian language. Any economic operator in any of the situations referred to in art. 177, 178, 180 of Law no. 99/2016, which draws the exclusion from the award procedure may provide evidence, within the meaning of para. (3) of art. 184 of Law 99/2016, showing that the measures taken by him-are sufficient to demonstrate their credibility in terms of the reasons for exclusion, with the proper application of the provisions of para. (4) and (5) of the same article.

Tenderers may collect certificates and obtain tax and fee information to the consolidated state budget / local budget from the National Agency for Fiscal Administration General Directorate FPublic Procurement and their respective municipalities.

Requirement no. 2 For the purpose of carrying out the verifications provided in art. 71, art. 72 and art. 73 of Law no. 99/2016, a declaration on own responsibility for failure to comply with the situations referred to in Art. 73 letter d) and e) of the Law no. 99/2016, according to the model presented in the "Forms" section.

The bidder, if it is made up of an association involving several economic operators, will sign a declaration obliging that if the joint offer is declared winner will legalize the association and the legalized association agreement will be presented the purchaser, in original, inathe date of signing the contract. The model of the Association Agreement is presented in the section "Forms"; 5) The bidder is not entitled within the same procedure:

(a) to submit two or more individual and / or joint offers under the exclusion of all bids in the competition (b) submit an individual / joint bid and be nominated as a subcontractor within a-other offers, subject to the exclusion of the individual offer or, as the case may be, of the one in which the bidder is associated.

Requests for clarifications and their answers to this tender documentation will address exclusively to SEAP / SICAP in the section dedicated to that sense in the notice of participation. The contracting entity will not comply with the requestby means of communication other than that established by the awarding documentation. Therefore, in order to submit requests for clarifications regarding the awarding documentation, economic operators must register in SEAP / SICAP.

Requests for clarification will be submitted within the deadline set by the contracting entity according to the provisions of art. 172 of Law no. 99/2016. The contracting entity will only respond to requests for clarifications addressed by the deadline set.
