Services will be purchased through this contract ( Preparation of technical execution project with execution details (P.Th. DE), technical documentation for obtaining the opinions, including obtaining them, documentstechnical notice for obtaining the building permit (DTAC), technical documentation for organizing the execution of the works (DTOE), technical verification of the technical documentation and technical assistance from the designer during the performance of the contract) whose estimated value is as follows:

Main Site: Buzau City, Buzău county, Cazarma 3177 Buzău.

Contract: 2018. I. 3177 Buzău "Swimming pool and obstacle course in Cazarma 3177 Buzău" Preparation of technical execution project with execution details (P.Th. DE), technical documentation for obtaining the permits, including obtaining them, technical documentation for obtaining the building permit ( DTAC), technical documentation for organization of works execution (DTOE), technical verification of theof the technical documentation and technical assistance from the designer during the performance of the contract.

Requirement no. 1:

The bidder / the associated bidder / the supporting third party / the subcontractor must not be found in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The way to fulfill the requirement is to present the DUAE, including associates / third supporters / subcontractorsaccording to art. 193 para. (1) of Law no. 98/2016 (consult the DUAE user guide elaborated by ANAP available at www.anap.gov.ro). The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked first after applying the award criterion on the tenderof the admissible ones, together with the associate, subcontractor, third party supporter, if applicable.

The economic operators will present as supporting documents:

- certifying certificates regarding the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget) at the time of presentation,

- criminal record of the economic operator and al the members of the administrative, management or supervisory body of the respective economic operator or of those with power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 asmoothly. (2), art. 167 para. (2) and art. 171 of Law 98/2016 on public procurement,

- other documents, as the case may be.

Requirement no. 2:

- Declaration regarding the non-classification in the situations provided in art. 60 of Law no. 98/2016. The declaration will be presented together with the DUAE, by all participants in the award procedure (tenderer, associate, subcontractor and third party supporter)

Persons withdecision functions within the AC are: Dănuț Ungureanu, Adrian Rădeanu, Gabriel Grosu, Marius Neacşu, Mihail Bădiţa, Vali-Laurențiu Joghiu, Ovidiu Gheorghe, Ciprian Muşescu, Lia Nicoara, Mariana Marin.

Note: they will be excluded from the award procedure all the bidders who were in the situations provided in art. 60, 164, 165 and 167 of Law no. 98 / 2016.

Documentelo submission / presentation will be allowedr requested in this section in any of the forms: original / legalized copy / legible copy with the mention "in accordance with the original".

Failure to submit DUAE at the time of the offer (including for the associate, subcontractor and third-party supporter) entails its rejection as unacceptable.

Se they will submit, together with the DUAE, the following documents: the firm commitment of the supporting third party from which the way resultseffectively in which it will materialize its support, the subcontracting agreement and / or the association agreement, as the case may be. Failure to submit them together with the DUAE constitutes the basis for requesting clarifications for any form inaccuracies of the information contained in the sections of the DUAE, both of the tenderer and of the subcontractor / supporting third party, this being necessaryto ensure the proper conduct of the award procedure.

Requirement no. 3:

The economic operator participating in the procurement procedure must prove a form of registration according to the law of the country of residence from which it appears that it is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that has the professional capacity toperform the activities that are the subject of the contract. In this sense the object of activity of the economic operator must allow the execution / corresponds to the activities that are the object of the contract. The requirement also applies to subcontractors and / or third-party supporters who complete the information related to their situation at the level of a distinct DUAE.

Professional risk insurance. The limit of liability insured is the value offered for achieving the objective. According to the provisions of Law 163/2016 amending Law 10/1995 regarding the quality in construction the warranty period is established according to the categories of importance of the cons.tricks established according to the law and will have a minimum duration of 3 years for the constructions classified in the category of importance C, consequently the limit of liability insured is for the entire duration of the guarantee, and the limit of liability insured is the offered value.

Specify the average turnover annual. The average annual global turnover for 2016, 2017, 2018 must bewas worth at least 1 500 000, 00 RON. The requirement was established in accordance with art. 172 para. (1) lit. b) of Law no. 98/2016 in order to obtain a confirmation that the economic operators who demonstrate that they have the average annual global turnover according to the request have the capacity to manage and to complete the procurement contract to be awarded.
