Construction supervision services. Design cost estimate and get everythingApprovals, opinions, decisions, studies, attestations and permits required by applicable law (hereinafter referred to as Task I), and author's supervision over the project (hereinafter referred to as Task II) for the construction of small retention facilities with accompanying infrastructure Podanin Forest District. The subject of the order was divided into 2 parts. Ordering requiresPayment of the bid bond in the amount specified below for Part:
a. Part 1 in the amount of 900.00 zł
b. Lot 2 in the amount of PLN 250.00
The bid security should be submitted before the deadline for submission of bids. The bid bond may be submitted in one or more of the following forms: a. cash,
b. Bank guarantees or surety bonds of a savings and credit union, except that the surety of the cashier is always afterWith cash,
c. Bank guarantees,
d. Insurance guarantees,
e. Sureties provided by entities referred to in Art. 6b para. 5 pts. 2 of the Act of 9 November 2000 on the creation of the Polish Agency for Enterprise Development (Journal of Laws of 2016, item 359, as amended). Payment must be made by bank transfer to the bank account of the Purchaser at Bank ZachodBefore WBK SA and Chodzież Branch No. 14 1090 1317 0000 0000 3100 3726 with a note: bid bond to secure the offer in proceedings for the "execution of design documentation of small lowland retention facilities nr. post. SA.270.2.1.2017 part ... "Payment of the bid bond in cash will be effective if within the stated deadline it will be credited to the bank account of the Ordering Party.This will take place on the bank account indicated in writing by the contractor in the bid form (Appendix No. 1 to SIWZ). From the content of the deposit submitted in the form of: bank guarantee, bank guarantee, insurance guarantee or sureties granted by the entities referred to in art. 6b para. 5 pts. 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise DevelopmentThis should be unconditional, on the first written request submitted by the Ordering Party at the time of binding the offer, the guarantor's obligation to pay the Purchaser the full amount of the bid security in the circumstances specified in Art. 46 sec. 4a and Art. 46 sec. 5 PZP.
5. The bid security lodged in a form other than money may be enclosed in the original with the offer or deposited in the original before the deadline.Offer of bids at the registered office of the Contracting Authority (Podleśnictwo Podanin, Podanin 65, 64-800 Chodzież, room 19). The bid bond must secure the offer for the duration of the bid bond. The Contractor's offer, which does not contribute the bid bond or will contribute the bid bond in the wrong way, will be rejected on the basis of art. 89 sec. 1 pt. 7b) PZP.
6. The contents of the bail bond must include the following elements:
a. Name of the giver-The contractor (the Contractor), the beneficiary of the guarantee / suretyship (the Ordering Party), the guarantor (bank or insurance guarantee / surety) and their seat,
b. Determination of the claim, which is to be secured by the guarantee / surety of the object of the order,
c. Amount of guarantee / surety,
d. Liability of the guarantor / guarantor to pay unconditionally and nIrrevocably the amount of guarantee / guarantee on the first written request of the Orderer in the circumstances specified in Art. 46 sec. 4a PZP and Art. 46 sec. 5 PZP.
1. The applicable form of remuneration in accordance with the specification of the relevant terms of the contract and the contractor's chosen offer is lump-sum compensation. The remuneration fixed in this form is unchanged and the Contractor will not demandPay higher salary
3. VAT on goods and services will be charged to invoices in accordance with applicable regulations. If there is a change in VAT there will be a change in gross remuneration. Flat fee includes all costs related to the performance of the subject matter of the contract, including. Costs:
a) obtain the necessary opinions and arrangements (external and internal), b) others-Costs necessary for proper performance of the subject matter of the contract. The settlement for the object of the contract will be made by two invoices:
a) first (for design documentation) after the execution and delivery of the documents in accordance with chapter 3 5 SIWZ,
b) the second (for author's supervision over construction works) after the protocol of the unobstructed reception of construction robots by the Purchaser,
1. RewardIt will be paid within 14 days of delivery of the correctly issued invoice to the Purchaser. The basis for invoicing by the Contractor will be the Receipts of the robot
2. VAT will be charged on the date of the invoice. The Contractor may not, without the prior consent of the Ordering Party expressed in writing under pain of nullity, transfer to a third party whatever he knows.Loans resulting from the implementation of the order
4. Making a payment to the bank account of the nominated member of the consortium releases the Purchaser from liability to all members of the consortium. Contractors may be involved in the procedure, who are not subject to exclusion from the procurement procedure in the circumstances referred to in Art. 24 sec. 1 pt. 12-23 of the PZP, art. 24 uSt. 5 pt 1 2 and 4 7 PZP. Based on:
1) art. 24 sec. 5 pt 1 PZP Ordering Party shall exclude from the procedure for awarding a public contractor, in relation to which the liquidation was opened, in a court approved restructuring agreement is intended to satisfy the creditors by liquidation of his property or the court ordered liquidation of his property pursuant to art. 332 uSection 1 of the Act of 15 May 2015. Restructuring Law (Journal of Laws, item 978, as amended) or declared bankrupt, except for a contractor who, after bankruptcy, has entered into an arrangement approved by a final court decision if the arrangement It does not provide for the satisfaction of creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets under the procedure of art. 366 sec. 1 usThe Bankruptcy Act of 28 February 2003 (Journal of Laws of 2005, item 233, as amended); 24 sec. 5 pt 2 PZP, the contracting authority shall exclude from the public procurement procedure a contractor who has seriously violated his professional duties in violation of his duties, which undermines his integrity, in particular when the contractor has failed or failed to act as a result of deliberate or gross negligence.The applicant has completed the order, which the contracting authority is able to demonstrate by means of appropriate evidence. 24 sec. 5 pt 4 PZP, the contracting authority shall exclude from the contracting procedure a contractor who, for reasons attributable to him, fails to perform or improperly performed an earlier contractual agreement or a concession contract concludedWith the contracting authority referred to in art. 3 sec. 1 point 1-4 PZP, which led to the termination of the contract or award of damages; 24 sec. 5 pt 5 PZP, the Purchaser shall exclude from the public procurement procedure a contractor who is a natural person who has been sentenced for an offense against the rights of the employee or an offense against the environment.The sentence of imprisonment, restriction of liberty or fines not lower than 3000 zlotys have been imposed; 24 sec. 5 pt 6 PZP, the contracting authority shall exclude from the public procurement procedure the contractor if the acting member of his managing or supervisory body, co-operative in the public or partner or general partner in the limited partnership or limited partnership or prokUrenta has been legally convicted of the offense referred to in art. 24 sec. 5 pt 5 PZP;
6) art. 24 sec. 5 pt. 7 PZP, the contracting authority shall exclude from the public procurement procedure the contractor, against whom a final administrative decision was issued concerning the breach of obligations under labor law, environmental law or social security regulations.This decision fines not less than 3000 zlotys;
