Development of project-estimate documentation for the construction of a water supply network in ul. Interesting and ul. Szreniawska in the Wawer District of the Capital City of Warsaw (a detailed description is included in Part III of the ToR).

1. Contractors who:

1.1 meet the conditions for participation in the proceedings regarding possession of competences or powers may apply for the award of the contractto conduct specific professional activities, provided that this obligation results from separate provisions. Not applicable.

1.2. are not subject to exclusion pursuant to art. 24 paragraph 1 point 12 23 of the Public Procurement Law Act, hereinafter referred to as the "Act" or "Public Procurement Law" (from the provision of Article 133 (4) of the Public Procurement Law) and pursuant to Art. 24 paragraph 5 points 1, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "ełnia does not meet ") and the lack of grounds for exclusion will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document" EAT "in relation to all Contractors who submitted offers, and

b) documents and statements confirming compliance conditions for participation in the procedure and no grounds for exclusion regarding the Contractor whose bidderrta will be rated the highest.

3. The Awarding Entity requests the submission of:

3.1a) At the stage of submitting bids from all Contractors:

a) the offer in accordance with the content of the Bid Form, constituting Annex 1 to IDW, part I of the ToR;

b) single European order document (EAT);

c ) power of attorney / power of attorney in accordance with the rules described in IdW

3.1 b) The Awarding Entity will call the Contractor before awarding the contract, whoThe offer will be assessed as the most advantageous, to be submitted within a designated period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents referred to in items 6.1b and 6.1d IDW.

3.1 c) Each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days ofplacing on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c IDW.

3.1 d) Contractor having its registered office in the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland to whom the document referred to in point 6.1b item a applies IDW, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to afterthe statement of compliance with the condition referred to in point 1 point 1.1 The Contractor whose tender will be assessed as the most advantageous will submit: Not applicable.

5. The Awarding Entity will assess (if applicable) whether the technical or professional capacities made available to the Contractor or their financial or economic situation allow the Contractor to demonstrate compliance with the conditions for participation in the procedureand will examine whether there are grounds for exclusion against this entity, as referred to in art. 24 paragraph 1 point 13 of the Act (subject to Article 133 (4) of the Act) and art. 24 paragraph 5 points 1, 4 8 of the Act. The Awarding Entity shall request the submission of relevant documents referred to in item 6.1.b of IDW for these entities.

1. If for a justified reason the Contractor cannot submit the documents he requiresordering by the Employer in point III.1.3 point 2 of the announcement, the Employer allows submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. It applies accordingly to point III.1.3): The Contractor may confirm the fulfillment of the conditions for participation in the procedure, in appropriate cases and inon the subject of the contract, or part of it, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations that connect it with it, on the principles set out in IDW (point 6.5 of IDW, subject to the obligation to submit documents there) indicated).

3. If the Contractor has its registered office or place of residenceoutside the territory of the Republic of Poland, submits a relevant document or documents in accordance with the principles set out in point 6.6. IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be made in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. Offer together with requirementsThese documents should be prepared and submitted in accordance with the principles set out in the notice, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in the procurement procedure, and the PPA.

8. These proceedings are conducted under an open tender pursuant toaw art. 134 section 1 of the Public Procurement Law

9. The contract in question is part of a larger contract in parts. Each part is the subject of a separate procedure under the contract awarded in parts (Article 32 (4) of the Act). The estimated value of the part does not exceed the amount specified in the provisions issued under Art. 11 paragraph 8 of the Act. Estimated total value of the orderit commences the amount specified in provisions issued based on Art. 11 paragraph 8 of the Act.
