1. Oh uContractors who can apply are: 1. 1.1. meet the conditions for participation in the proceedings regarding the possession of competences or authorizations to conduct specific professional activities, provided that this obligation results from separate provisions: not applicable,

1.2. are not subject to exclusion pursuant to art. 24 paragraph 1 point 12 23 of the Public Procurement Law Act, hereinafter referred to as the "Act" or "Public Procurement Law" (withn. Art. 133 section 4 Public Procurement Law) and pursuant to art. 24 paragraph 5 points 1, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets / does not meet") and the absence of grounds for exclusion will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" in relation to all Contractors who submitted offers, and

b) documentntow and statements confirming the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion regarding the Contractor whose tender will be rated the highest.

3. The Awarding Entity requests the submission of:

3.1 a) At the stage of submitting bids from all Contractors:

a) the offer in accordance with the content of the offer form, constituting Annex No. 1 to IDW, Part I of the Terms of Reference;

b) single European order documentia (EAT);

c) power of attorney / power of attorney in accordance with the rules described in IDW.

3.1 b) The Awarding Entity will call the Contractor before the award of the contract, whose offer will be assessed as the most advantageous, to be submitted within a designated period, not shorter than 10 days, valid on day of submitting statements or documents confirming the circumstances referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents, aboutreferred to in items 6.1 b and 6.1 d IDW.

3.1 c) Each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1 c IDW.

3.1 d) Contractor having its registered office in the territory of the Republic of Poland, in relation to persons who reside outside the territoryof the Republic of Poland, to which the document referred to in item 6.1 b (a) IDW applies, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm that the condition referred to in point 1 point 1.1 has been met, the Contractor whose tender will be assessed as the most advantageous will present: not applicable.

5. The Awarding Entity will assess (if applicable) whether the technical capacity of other entities made available to the Contractorprofessional or financial situation or their financial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are grounds for exclusion for this entity, as referred to in art. 24 paragraph 1 item 13 22 of the Act (subject to Article 133 (4) of the Act) and Article 24 paragraph 5 points 1, 4 8 of the Act. The Awarding Entity will request presentation in relation to theseentities of relevant documents referred to in item 6.1.b of IDW.

1. If, for a justified reason, the Contractor cannot submit the documents required by the Employer in point III.1.3 point 2 of the announcement, the Employer allows the submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. concerningy respectively point III.1.3: The Contractor may rely on the technical or professional capacity or the financial or economic situation of other entities to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to the contract in question or part thereof, irrespective of the legal nature legal relations linking it with it, on the principles ofIDW (item 6.5 IDW, subject to the obligation to submit documents indicated therein).

3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he shall submit a relevant document or documents in accordance with the rules set out in point 6.6 of IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. Offershould be made in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. The offer together with the required documents should be prepared and submitted in accordance with the principles set out in the announcement, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from Wykthe ordering party in the contract award procedure and PPL

9. Required completion date of the contract:

The parties agree on the following terms for the Contractor to perform the subject of the contract (also collectively referred to as "works"):

1) providing the Employer with materials for the decision on determining the location of public purpose investment [hereinafter referred to as `materials for LICP decisions`] in within 50 days(in words: fifty) calendar days from the date of the conclusion of this contract;

2) handing over to the Ordering Party 2 copies of a color photocopy of the protocol from the coordination meeting on the location of the designed utilities network with map attachments (including 1 copy with borders marked on map attachments and plot numbers and precincts) and necessary materialsto obtain the right to dispose of the land, including a cross-section of the road lane showing the location of the planned and existing utilities network [hereinafter referred to as "materials for the area"], and if necessary (i.e. in the case of designing an existing or planned sewage or water supply network road) materials necessary for the Employer to obtaindeviations from the provisions of - 140 para. 8 of the Regulation of the Minister of Transport and Maritime Economy of 2.3.1999 on technical conditions to be met by public roads and their location [hereinafter referred to as "materials for derogation"] within 120 (in words: one hundred and fifty) calendar days from the date of the final delivery LICP decisions;

3) providing documentation to the Employerdesign-cost estimate (also called "design documentation" or "documentation") within 120 (say: one hundred and twenty) calendar days from the date of delivery by the Employer of the Contractor of documents confirming the right to dispose of the land for construction purposes for the proposed investment and consent to a deviation (in if necessary) or written information obtained from the Purchaserabout the need to start design work;

4) performing author`s supervision during the duration of construction works and on the dates of acceptance of these works. The contract in question is part of a larger contract in parts. Each part is the subject of separate proceedings in a framea contract awarded in parts (Article 32 (4) of the Act). The estimated value of the part does not exceed the amount specified in the regulations issued on the basis of art. 11 paragraph 8 of the Act. The estimated value of the entire contract exceeds the amount specified in the provisions issued under Art. 11 paragraph 8 of the Act.
