Electricity supply for Szczucin commune and other units

Reference Number: GPK.271.1.2018

1. The subject of the order is the supply of electricity with a total estimated volume of 3 885 680 kWh.

Main Site: Area of the Commune of Szczucin

1. Electricity supplyshall comply with the provisions set out in the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) and in accordance with executive provisions issued to that Act, in particular with the standards of service quality recipients specified in the Ordinance of the Minister of Energy of 29/12/2017 on the detailed rules of shaping and calculating tariffs-and settlements in the trade in electricity (consolidated text: Journal of Laws of 2017, item 2500).

2. The distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the appropriate Distribution System Operator, i.e. Tauron Dystrybucja S.A.

3. Requirements for the Contractor:

The Awarding Entity will grant the power of attorney selected in the Contractor's proceedings to:

3.1. applications on behalf ofOrdering the sales contract to the Distribution System Operator in order to implement the concluded electricity sales contract,

3.2. representing the Ordering Party in the process of changing the seller.

4. Attachment No. 2 to SIWZ indicates distribution parameters (contracted capacity / tariff group), which may be subject to change during the term of the contract for the sale of electricity within tariff groups atin the SIWZ and offers quoted in the offer form.

5. The amount of electricity volume specified in item 1 is the estimated value based on the current consumption. The Contracting Authority reserves the right to reduce or increase the total amount of electricity purchased in relation to the quantity specified in point 1, caused by reduced or increased electricity consumptionin the amount corresponding to the actual needs of the Employer, regardless of the estimated consumption forecast. The Contractor shall not be entitled to any claim for not charging the anticipated amount of electricity by the Employer. Possible change in the estimated consumption specified in point 1 will not result in additional costs for the Ordering Party, outside the settlementiem for the actually consumed amount of electricity according to the prices specified in the contract. The occurrence of the circumstances referred to will result in a corresponding reduction or increase in the remuneration due to the Contractor under the Agreement.

In order to confirm compliance with the condition regarding competences or entitlements to conduct a specific professional activity, if it results from separate provisions, orderingy demands:

1) an important license to conduct business in the field of electricity trading, issued by the President of the Energy Regulatory Office, in accordance with art. 32 of the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) - the Contractor will demonstrate that:

a) has a current license to conduct business in the field of electricity tradingby the President of the Energy Regulatory Office, pursuant to Art. 32 of the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) - Note: In the case of submitting an offer by Contractors jointly applying for the award of contract, each of these Contractors jointly appearing, which will execute the order in the scope of deliveries, the execution of which requires the rights indicatedIn order to confirm fulfillment of the condition regarding the economic or financial situation, the Ordering Party shall demand:

1) information of a bank or a social savings and credit union confirming the amount of funds held or the creditworthiness of the Contractor during the period not earlier than 1 (one) month before the deadline expiresat the submission of offers,

2) documents confirming that the contractor is insured against civil liability in the scope of the business related to the subject of the order for a guarantee sum determined by the ordering party

If for a justified reason the Contractor can not submit documents regarding the financial or economic situation required by the Employer, can make a different one-a document that sufficiently confirms fulfillment of the condition of participation in the procedure described by the Employer. The ordering party sets a deposit for the entire subject of the order in the amount of PLN 25, 000.00 (in words: twenty five thousand zlotys).

2. The Contractor is bound by the offer for a period of 60 days

3. The Contractor shall submit a uniform European order document (EED) in accordance with art. 25a mouthof 29.1.2004 Public Procurement Law (Journal of Laws of 2017, item 1579 with later amendments), hereinafter referred to as the Act, using means of electronic communication via e-mail to the e-mail address: zamowienia.publiczne @ umigszczucin.pl - in an electronic form, with a qualified electronic signature, by persons authorized to represent the entities to which it relates, at a later date-until the deadline for submitting bids expires.

4. Declarations and documents to demonstrate compliance with the conditions of participation in the proceedings and no grounds for exclusion The Contractor is required to submit in a form consistent with the provisions of - 14 of the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedings for ordering (Dz.U. 2016, item 1126), hereinafter referred to as the "document regulation" and in relation to the EAT requirements set out in Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form for a single European order document (Dz.UE L 3 / 16, 6.1.2016).

5 The Awarding Entity will exclude the Contractor from the proceedings in the circumstances specified in Article 24 para.1 and worth 24 sec. 5 points 1, 2 and 8 of the Act

6. A list of statements or documents to demonstrate the absence of grounds for exclusion, which the Employer will demand pursuant to art. 26 of the Act:

1) documents and statements referred to in - 5 items 1-6, 9 of the Regulation on documents;

2) documents or statements referred to in - 7 and 8 of the Regulation on documents - if the Contractor has headquartersb domicile outside the territory of the Republic of Poland or if the person whose document relates is residing outside the territory of the Republic of Poland;

3) the statement referred to in - 5 p. 10 of the Regulation on Documents

6. Detailed information on the manner of preparing and submitting the offer and JEDZ are specified in the ToR.

7. The contracting party foresees the usee the procedure to be followed, referred to in art. 24aa of the Act.
