Electricity supply

Subject of this public procurement:

Main Site: Objects listed in Appendix 1 and Appendix 2 to Section XI of the procurement documents

The procurement covers the supply of net active electricity for a period of 12 (twelve) months for the objects specified in Appendix No. 1 and Appendix No. 2, detailed in the Regulationssection XI of the procurement documents. The estimated quantity for the whole order is 14 600 mWh, distributed as follows:

- 14 230 mWh net active electricity for the objects described in Appendix No 1, which have installed meters for hourly electricity reading,

- 370 mWh net active electric power energy by standardized load profile for the objects inventoryus in Appendix # 2, which have installed meters without hourly accounting for electricity.

The order execution should start from the date of registration of the first load schedule. The participants in the procedure may be persons who are licensed as electricity traders according to Art. 39 of the Energy Act (EA) and are registered with the status of "active" as cocoordinator of a standard balancing group according to the requirements of Art. 58 of PTEE in the public register under Art. 65 of PTEE.

2. To demonstrate compliance with the selection criteria:

2.1. When submitting a tender, the tenderer declares compliance with the set requirements through the EEOPP by filling in, respectively: Part IV, "Selection Criteria", Section A "Eligibility", field "Entry in the relevant professional registerstr ", indicating:

- number, validity, date and issuer of a license certifying his / her right to conduct" electricity trading ", including rights and obligations related to the activity" standard balancing group coordinator "issued by the Energy and Water Regulatory Commission (EWRC);

- a link to access the relevant documents in case they are available through public free of chargen register;

- identification number (EIC code), under which the participant is registered and has the status of "active" in the public register under Article 65 of the TEU, of the coordinators of a standard balancing group maintained by the independent transmission operator ESO EAD .

2.2. Upon conclusion of the contract, the tenderer selected as the contractor shall submit:

- a certified copy of a valid license to perform the activitylektric energy ", including rights and obligations related to the activity of" coordinator of a standard balancing group "in accordance with the EA and other relevant regulatory acts, as well as with the administrative acts issued by the EWRC only when the circumstances of the relevant license or similar documents are not accessible to the Contracting Authority through official or public register or not mThey can be provided by direct and free access to the Member States` national databases. 67, para. 5 of the Public Procurement Act

The contracting authority does not set requirements.

1. The contracting authority shall remove from participation in the procedure a participant for whom there are any grounds, listed below occurring before or during the procedure:

1.1. has been convicted by a judgment which has entered into force, for a crime under Art. 108a, Art. 159a - 159d, Art. 172, Art. 192a, Art. 194 217, Art. 219-252, Art. 253-260, Art. 301-307, Art. 321, 321a and Art. 352-353f of the Criminal Code;

1.2. has been convicted by a judgment which has the force of res judicata for a crime similar to those referred to in paragraph 1.1. in another Member State or a third country;

1.3. there are obligationsfor taxes and duties. insured installments within the meaning of Art. 162, para. 2, item 1 of the TSCC and the interest thereon, to the state or municipality at the registered office of the assignor and the participant, or analogue. obligations under the law of the State in which the participant is established, evidenced by an effective act of a competent authority;

1.4. has been found to:

(a) have provided a false content-related documentvalidation of the lack of grounds for removal or fulfillment of the selection criteria; has been found to have entered into force. decree or judgment, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 118, Art. 128, Art. 228, para. 3, Art. 245 and Art. 301-305 of the Labor Code or Art. 13, para. 1 of ZTMTM or analogue. Obligations established by a deed of comp. body according to the law of the country in which the participant is established.

1.6. there is a conflict of interest that cannot be resolved.

1.7. there is inequality in the cases under Art. 44, para. 5 of the Public Procurement Act;

2. The grounds under item 1.1., 1.2. and 1.6. apply to personsthose who represent the participant, the members of the management and supervisory bodies and others. persons authorized to exercise control over decision-making by those authorities.

3. The grounds for exclusion under this section shall also apply where the tender is submitted by a grouping for any of the participants in which the said circumstances exist.

4. The participant for whom the circumstances ofitem 1., may submit evidence that he has taken measures that guarantee its reliability, in accordance with Art. 56 of the Public Procurement Act

5. When submitting the offer, the tenderer shall declare the absence of grounds for removal by submitting an EDES.

6. In order to prove the lack of grounds for removal, the participant selected as a contractor shall submit the documents referred to in Art. 58 of the Public Procurement Act

7. The contracting authority shall removeof the procedure and:

7.1. a participant who does not meet the selection criteria or does not meet the other criteria. condition specified in the notice of contract or documentation;

7.2. a tenderer who has submitted a tender that does not meet the pre-announced conditions of the contract;

7.3. participant who submitted an offer that does not meet the requirements related to the protection of the environment, social andlabor. law, applicable collective agreements and / or provisions of international, environmental, social and labor law, which are listed in Appendix No. 10 PPL;

7.4. participant who has not submitted the justification under Art. 72, para. 1 of the PPA or whose offer was not accepted in accordance with Art. 72, para. 3-5 of the Public Procurement Act;

7.5. participants who are related persons within the meaning of - 2, item 45 of the Public Procurement Act;

7.6. participant who is registered in jurisdictionsI prefer. tax regime (APRM) or is controlled by a person who is registered with the DPRR or participates in a civil society / consortium in which a company, register is involved. in the SEA (pursuant to Art. 3, item 8 of ZIFODRUPDRTCLTDS), unless any of the exceptions under Art. 4 ZIFODRIPDRKTLTDS);

7.7. a participant found to be in error based on incorrect dataArt. 4 of ZIFODRUPDRTLTDS (according to Article 5, Paragraph 1, Item 3, item "a" of ZIFODRUPDTLTDS).

7.8. The contracting authority avails itself of the opportunity given to it in Article 104, paragraph 2 of the Public Procurement Act and provides that the commission shall carry out the evaluation of the bids of the participants prior to the preliminary selection.
