The subject of the order is delivery to the facilities belonging to the ordering party of electricity with a total estimated volume of 10, 728, 00 MWh in the period from December 1, 2020 to December 31, 2020, according to with the provisions of the Act of 10.4.1997Energy Law (Journal of Laws of 2012, item 1059, as amended), hereinafter the EP, of which:

1. The subject of the order is the delivery of electricity to the facilities belonging to the Ordering Party with a total estimated volume of 10, 728, 00 MWh in the period from 1.1.2020 to December 31, 2020, in accordance with the provisions of the Energy Law of 10.4.1997 (Dz. U. of 2012, item 1059, as amended), hereinafter the EP, of which: - Zone I 2 098, 00 MWh

Zone II 1 240.00 MWh

Zone III 7 390.00 MWh

In zone I are included tariffs settled round the clock, which was specified in the price form (Annex No. 4 to SIWZ).

The above data is indicative only. The contractor should take into account the fluctuation in electricity consumption at the level (/-)10%.

List of collection points is attached as Annex 1 to the Terms of Reference.

The ordering party requests the following documents:

1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL Act, subject to art. 133 ust. 4 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

2. a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued onno earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular has obtained the legally required exemption, postponement or distribution of overdue installments payment or suspension in fullia the decision of the competent authority;

3. a certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the offer deadline or other document confirmthat the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the decision of the competent authority; excerpt from the relevant register or from central records and information about the activities of the gosif separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Public Procurement Law,

5. the Contractor`s statement that he has not been the subject of a final court judgment, or a final administrative decision on late payment of taxes, fees or social security or health insurance premiums orto issue such a judgment or decision on documentary evidence of the payment of such claims together with any interest or fines or to enter into a binding agreement regarding the repayment of such claims; the Contractor`s statement about the lack of a ruling against him as a preventive measure of the prohibition against applying for public orders;

7. statements of the Contractor about the lack of issuance against nƒ the final administrative decision on violation of obligations arising from the provisions of labor law, environmental law or social security regulations (basis: Article 24 paragraph 5 point 7 of the Act),

8. Contractor`s statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716);9. Contractor`s declaration of affiliation or lack of belonging to the same capital group in the case of being part of the same capital group. The Contractor may submit together with the statement documents or information confirming that connections with another Contractor do not lead to distortion of competition in the proceedings.
