The subject of the order is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services in an estimated 7, 621 000 kWh, for a period of 12 months, from 1.1.2019 to 31/12/2019r., to the buildings belonging to the Ordering Party.

The subject of the order is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services in an estimated 7, 621 000 kWh, for a period of 12 months, i.e. January 1, 2019 to December 31, 2019, to the objects belonging to the Ordering Partythe elation of the planned electricity consumption is an estimated value, which does not reflect the real or declared use of electricity during the contract period and does not constitute a commitment to purchase energy in the given quantity and can not be the basis for any claims on the part of the Contractor . Actual settlements of used energywhich will be made monthly, based on current indications of metering and billing systems in the scope of: - distribution fees based on prices and rates of fees resulting from the tariff for electricity distribution services approved by the President of the Energy Regulatory Office; - energy fees based on electricity prices and commercial service fees in accordance with thisa tariff for electricity presented in the Contractor's offer. The Contractor is obliged to execute the order on terms and conditions specified in the relevant provisions of the contract, which will be introduced into the content of the public procurement contract. The supply of electricity and the provision of distribution services will take place under the conditions set out in the Act of 10.4. 1997 Energy Law (Journal of Laws of 2018 item 755, as amended), secondary legislation to this Act, in particular the Regulation of the Minister of Economy of 4.5.2007 on the conditions for the operation of the power system (Journal of Laws from 2007 No. 93, item 623, as amended), Regulation of the Minister of Energy of 29/12/2017 on detailed principles of shaping andcalculation of tariffs and settlements in electricity trading (ie Journal of Laws of 2017, item 2500) Tariffs for electricity of the Seller, Tariffs for electricity distribution services of the Distribution System Operator (OSD Tariff), Instruction of Movement and Operation of the Distribution Network ( IRiESD) and generally applicable legal regulations. As a result of the settlement of the proceedings-granting a public order, between the Contractor and the Ordering Party, an agreement will be concluded for a comprehensive supply of electricity to 24 facilities. A detailed description of the subject of the order is set out in Annex No. 1 to the ToR.

Contractors can apply for the award of the contract, who: 1) are not subject to exclusion, 2) meet the conditions for participation in the procedure. The Contractor must show that he has: a) aa concession issued by the President of the Energy Regulatory Office for conducting business activity in the scope of trade in electricity, referred to in the Act of 10.4.1997 Energy Law (consolidated text: 2018, item 755, as amended); b) the current license issued by the President of the Energy Regulatory Office for conducting business activities in the field of transmission or distribution of eelectricity law, referred to in the Act of 10.4.1997 Energy Law (consolidated text: 2018, item 755, as amended). In the event that the Contractor is not the owner of the transmission or distribution network, he is obliged to have a general contract for the provision of electricity distribution services concluded with the Operator S, applicable at least in the period from 01/01/2019 to 31/12/2019Distribution Service (OSD), which is located in the territory of the Grudziądz commune and the municipalities of the city of Grudziądz. In the case of Contractors jointly applying for the award of the contract, the conditions specified above will be met only if: 1) at least one of the Contractors will have a valid license issued by the President of the Energy Regulatory Officeconducting business activity in the scope of trade in electricity, referred to in the Act of 10.4.1997 Energy Law (Journal of Laws of 2018 item 755 with amendments) and 2) at least one of the Contractors will have current license issued by the President of the Energy Regulatory Office for running a business in the field of electric energy transmission or distributionreferred to in the Act of 10.4.1997 Energy Law (Journal of Laws of 2018, item 755, as amended), however, it is not required that each of the Contractors jointly applying for the award should have both concessions indicated above. 3. The Procurer will exclude the Contractor from the proceedings for the award of the contract, to which the conditions specified in art. 24 sec. 1 item 12-23 and arvol. 24 para. 5 point 1 of the Public Procurement Law. 4. Contractors jointly applying for the order shall appoint a representative to represent them in these proceedings or represent them in the proceedings and conclude a public procurement contract. 5. The Contractor shall attach to the offer valid as of the day of submitting the offers a statement constituting preliminary confirmation that the Contractor is not subject to exclusion and speconditions for participation in the proceedings. The Contractor submits the declaration on the form of the Single European Order Document, prepared in accordance with the specimen of the standard form specified in the European Commission's implementing regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as the "Single Document" or "EAT". The single document states fromswitch 4 to the ToR. The requirements for folding the EAT are included in Section XIII of the ToR.6. 7. The Contractor, within 3 days from the date of placing on the Ordering Party's website information referred to in art. 86 par. 5 of the Public Procurement Law, submits to the Ordering Party a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law, stateAnnex 5 to the ToR. 8. The ordering party in accordance with art. 24aa of the Public Procurement Law, will evaluate offers and then examine whether the Contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings. 9. Ordering prior to the order being called, the Contractor whose offer has been best assessed, to submit in the designated, not shorter10 days, valid dates as of the day of submitting statements and documents confirming fulfillment of the conditions for participation in the proceedings and no grounds for exclusion. 1. The contractor is obliged to secure its bid bond in the amount of PLN 20, 000.00 (in words: PLN twenty thousand and 00) 100). The bid bond must cover the entire period of being bound by the offer. 2.
