Electricity.

Unlimited tender for the supply of electricity to units:

1. Radzymin commune - pl. Tadeusza Kościelski 2, 05-250 Radzymin,

1. The Contractor is obliged to pay a bid bond in the amount of:

1) for part 1 of the order 60, 000.00 PLN (in words: sixty thousand zlotys, 00/100),

2) for part 2 of the subject of the contract 120, 000.00 PLN (in words: one hundred twenty thousand zlotys, 00/100),

3) for part 3 of the subject of the contract, 155, 000.00 PLN (in words: one hundred and fifty thousand zlotys, 00/100);

2. The Contractor shall provide a bid bond in the amount corresponding to the part of the order for which he submits the offer. The bid bond must be submitted before the deadline for submission of offers in one or several of the forms specified in 45 par. 6 of the Public Procurement Law, depending on the contractor's choice, i.e.

1) in money by bank transfer to the Employer's account,

2) inbank guarantees or guarantees of the Social Credit and Savings Association, however, the surety is always a cash guarantee,

3) bank guarantees,

4) in insurance guarantees,

5) sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2018-Pos. 110 with later d.).

4. The bid bond must cover the entire period of being bound by the offer and the beneficiary must be the Purchaser's Proxy. The bid security paid in cash must be paid by transfer to the following account:

Voltra Energy Sp. z o.o., ul. Krasnobrodzka 5, 03-214 Warsaw, account number: 23 8769 0002 0361 2091 2000 0010 note: "Wadium - Unlimited tender: Purchase of electricity --Purchase Group No. XVIII / 2018 Voltra ".

5. The Purchaser considers the requirement to make a bid bond in cash if the bank account of the Ordering Party is recognized by the amount of the bid bond before the deadline for the submission of bids. the bid bond document shall contain at least the elements listed in paragraph 6 and its othe charter will be lodged at the seat of the Ordering Party's Plenipotentiary located in Warsaw, ul. Krasnobrodzka, building B, 03-214 Warszawa, POLAND before the deadline for submitting offers.

6. The bid bond document should contain at least the following elements:

1) name and exact address of the guarantor (guarantor, insuring entity),

2) specification of the name of the proceedings for which it is issuedis a document,

3) the obligation of the guarantor (guarantor, insuring entity) to irrevocably and unconditionally, on first demand, payment to the beneficiary (Ordering Party) a designated amount of money corresponding to the amount of the bid security, in the event of any of the circumstances listed in art. 46 ust. 4 a and art. 46 ust. 5 of the Public Procurement Law,

4) Obligation of guaranteesta (guarantor, subject of the policyholder) to pay the full amount of the bid bond within no more than 21 days counting from receiving from the Ordering party the first written request for payment,

5) Period of validity of the bid bond - which must coincide with the binding date of the offer indicated in SIWZ.

7. The offer of the Contractor who will not pay the bid bond up to the deadline for submitting bids, in the amount ofdelineated in paragraph 1, in the form or forms referred to in paragraph 2, or for the entire period of being bound by the offer will be rejected.

8. The Awarding Entity shall return the bid security to all contractors immediately after the selection of the most advantageous tender or cancellation of the procedure, with the exception of the contractor whose offer has been selected as the most advantageous, subject to paragraph 13

9. Contractor whose offer fromthe last selected as the most advantageous, the Ordering Party will return the deposit immediately after concluding the public procurement contract.

10. Bid bond deposited in money will be returned by the Employer together with interest resulting from the bank account agreement on which it was stored, less the costs of running the account and bank commission for transferring money to the bank account indicated infrom the contractor. The tender deposit in a form other than cash will be returned by the Purchaser by submitting the original document.

11. The Contractor whose offer will be chosen will lose the bid bond with interest for the Ordering Party in the event that: -1) refuses to sign the contract regarding this order under the conditions specified in the offer,

2) conclusion of the contract regarding this order stmaking impossible due to reasons attributable to the Contractor.

12. The Contracting Authority shall retain the bid bond with interest, if the contractor in response to the call referred to in art. 26 par. 3 and section 3a of the Public Procurement Law, for reasons attributable to him, he did not submit documents or declarations confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law, a statement about whichreferred to in art. 25a section 1 of the PPL Act, powers of attorney, or did not agree to correct the error referred to in art. 87 par. 2 point 3 of the Public Procurement Law, which resulted in the inability to select the offer submitted by the contractor as the most advantageous one. The Contracting Authority shall demand that the bidder re-pay the bid bond, to which the bid bond was returned pursuant to para. 7, if as a result of a settlement fromhis tender was selected as the most advantageous. The contractor will be obliged to pay the bid bond within the time specified by the Ordering Party.

1. The contractor may apply for awarding the contract, which:

1) is not subject to exclusion from the Proceedings on the basis of the circumstances indicated in: a) art. 24 sec. 1 of the Public Procurement Law, b) art. 24 sec. 5 points 1 and 8 of the PPL Act

2) meets specified pby the Ordering Party, the conditions for participation in the Procedure, referred to in paragraph 2

2. The contractor who meets the conditions for participation in the proceedings referred to in art. 22 ust. 1b of the Public Procurement Law, i.e.: 1) has competences or entitlements to conduct a specific professional activity, if it results from separate provisions.

The ordering party will recognize the condition asIf the Contractor shows that he has a current license to conduct business in the field of energy trading in accordance with the Energy Law Act of April 1997 (ie, Journal of Laws of 2018 item 755) confirming the possession of licenses to conduct electricity trading ( this condition of participation in the proceedings applies to all Częśthe subject of the order).

In the case of a joint offer the document is submitted by the Contractor submitting the joint offer, which within the consortium will be responsible for the implementation of the tasks covered by the concession.
