Supply of net active electrical energy by contractor, balancing group coordinator, low voltage with full administration of the information flow with ESO and assuming the cost of imbalances for 6 (six) objects (6 (six) measuring points)

The Contracting Authority will not pay any participation feein balancing group and penalties for surplus or shortage of imbalances. Information on the entry of the participant in a commercial register in the Member State in which it is established: Refer to Part IV "Selection Criteria" of the ENEDOP. * * * According to Annex XI to Directive 2014/24 / EC for the Republic of Bulgaria, the Register is Commercial register 2. Participants in the procedure and must have:

- license, issuedfor electricity trading pursuant to Article 39, Paragraph 1, Item 5 of the Energy Act and / or "Production of Electricity" pursuant to Art. 39, para. 1, item 1 of the Energy Act (ЗЕ).

A license is issued to a person with a registration equivalent to the one under Art. 40 para. 1 of the Energy Act under the legislation of another Member State of the European Union, under the conditions of para. 1-6 of-Art. 40 of the Energy Act - a decision of the SEWR to supplement the license with the rights and obligations related to the activity "coordinator of a standard balancing group" according to Article 39, paragraph 5 of the Energy Act

- registration in the Register of Balancing Group Coordinators of "Electricity System Operator" EAD. If registration is evident from a public and free registry, then it is enough to indicate it.

Correspondencethe participant with the specified requirements is certified in Part IV "Selection Criteria" by the EDECOP: details of the authority issuing the document, the number and date of issue of the relevant documents, the period of validity and the national databases in which shall contain the declared circumstance or the competent authorities which, under the legislation of the State in which the participant is involved-is required to provide information.- At the stage of concluding a contract, the participant selected as a contractor shall produce certified copies of the above-mentioned documents, except where the information is provided by direct and free access to a public register indicated at the time of filling of the eEEDOP.

This procurement does not require economic and financial requirements-Participant in the procurement procedure may be any Bulgarian or foreign natural or legal person or their associations as well as any other entity entitled to perform supplies under the legislation of the state in which it is established, which meet the requirements set out in the Public Procurement Act (PPL), and-the requirements of the contracting authority specified in the tender dossier. The participants are represented by the persons representing them by law or by authorized persons, which is evidenced by a document of authorization - original or a copy certified by the participant. The Contracting Authority shall remove from participation in a participant procedure for which there are grounds under Art. 54, para. 1 of the Public Procurement Act and Art. 55, para. 1, item 1, item 3, item 4and point 5 of the PPA. The assignor has the right not to remove a participant from the procedure in the case of Art. 55, para. 4 of the Public Procurement Act. Other grounds for termination: on the grounds of Art. 107 of the Public Procurement Act and a participant, for whom there are circumstances under Art. 3, item 8 of the Economic and Financial Relations Act with the companies registered in preferential tax jurisdictions, the persons related to them and their-actual owners. According to Art. 67, para. 1 of the PPA when submitting a tender, the participant declares no grounds for removal from the procedure and compliance with the selection criteria by submitting the EEDOP. Documents demonstrating the information specified in EEDOP may be required under the conditions of Art. 67, para. 5 and 6 of the PPA. According to Art. 67, para. 6 of the Public Procurement Act before concluding thea contract for a public contract, the tenderer designated as a contractor shall provide up-to-date documents certifying the lack of justification for the removal and compliance with the selection criteria. Documents shall also be submitted to subcontractors and third parties, if any. Participant for whom the grounds under Art. 54, para. 1 of the Public Procurement Act, has the right to present evidence that it has taken measures, -which ensure its reliability, despite the appropriate justification for removal. If the measures taken by the participant are sufficient to ensure its reliability, the assignor does not remove it. As proof of the reliability of the participant, documents under Art. 58 of the Public Procurement Act. Enforcement under Art. 111, para. 2 of the PPL is set at the amount of 1% (one percent) of the value of the public procurement contract. Guarantees are provided in one of the following forms:

1. cash amount; bank guarantee; • The documents relating to the participation in the procedure are submitted by the participant or his authorized representative - in person or by post or otherand a courier service with a registered shipment with a return receipt at the address indicated by the contracting authority. Documents shall be presented in sealed, opaque packaging. The bid submitted must be valid for at least 120 (one hundred and twenty) days from the final date for receipt of tenders. In the event of a new assignment of the assignor to the electricity distribution network, access and transmission contract with a network operator, this object / measurement point will be added to the assignor's sites. In case of termination of the sale of net active electrical energy to an object / measuring point, it will be taken out of the sites / measurement points of the assignor.
