The main object of the framework agreement is the supply of electricity to the offices of the courts:

Requirement no. 1: Non-compliance with the situations stipulated in art. 164, 165 and 167 of Law 98/2016 on Public Procurement. The bidders / members of the association / subcontractors / third parties should not find themselves in the situations provided for in art. 164, 165 and 167 of Law 98/2016 on Public Procurement. The way in which the fulfillment of the requirement can be demonstrated:The bidders / associate members / subcontractors / third-party supporters will complete the DUAE with information related to their situation. The supporting documents, which prove the fulfillment of the assumed by the completion of the DUAE, valid at the moment of presentation (such as certificates attesting the lack of overdue debts, taxes or contributions to the consolidated general budget(local budget, state budget, etc.), respectively, equivalent documents, for foreign economic operators, the criminal record of the economic operator and the members of the administrative, management or supervisory body of the respective economic operator, or those having the power of representation, decision or control within it, as evidenced by the issuing certificate issued de ONRC / constitutive act; documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, as well as any other editorial documents, as the case may be, shall be presented at the request of the contracting authority only by the first ranked bidderthe intermediate rankings drawn up at the completion of the tender evaluation.
Requirement No.2: The bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 58-63 of the Law no. 98/2016. Liability statement on the absence of conflict of interest, completed in accordance with the model provided by the contracting authority in the Form sectionwill be deposited by all bidders with the DUAE. 1. The bidder will indicate in the offer that information from the qualification documents, the technical proposal and / or the financial proposal are confidential, classified or protected by an intellectual property right, since they include, but are not limited to, to these, technical and / or commercial secrets, established according to the law, and their disclosure would prejudice inthe legitimate torture of economic operators, particularly in terms of commercial secrecy and intellectual property. Confidential nature must be demonstrated by any means of proof. The winning bid will be the lowest bidder offer. If, after the stab. of the final ranking according to the award criterion, the evaluation commission finds that-there are two or more first-ranked offers, the CA will ask the economic operators for documents that contain new prices, the winning bid being the one that has the lowest price resulting from the re-listing.
