Contracting Authority S.P.A.S. Constanta will conclude the framework agreement for a period of 42 months, with a maximum of 3 economic operators, having as object "Electricity supply" for all consumption points in the administration of the Public Social Assistance Service Constanta - Main Site: Constanta.

The electricity supply will be made in compliance with the quality parameters according to the standards issued by the National Regulatory Authority for Energy and in the increased safety conditions imposed by the legal regulations in force.

The electricity supply will be made at the places of consumption mentioned in Annex Ia the specifications.

During the 42-month framework agreementthe following contracts will normally be awarded for 6 months or for a maximum of 12 months, depending on the needs of the contracting authority and the budget availability. estimated for 42 months is: 2 148, 965 MWh (613, 990 MWh annually).

Amount / maximum value for lowest contract(minimum 6 months) 159 456, 27 RON, VAT not included

Amount / Minimum value for lowest commission after 31/12/2018 (maximum 6 months): 117 859, 06 RON, VAT not included .

Maximum value for the largest subcategory contract: (12 months): 318 912, 55 RON without VAT.

Information and formalities necessary for evaluating if requirements are met:

1) Tenderers, third-party suppliers and subcontractors must not find themselves in the situations referred to in art. 164, 165, 167 of Law 98/2016. The supporting documents proving the fulfillment of the undertaken by the completion of the DUAE are to be presented on the groundcontracting authorities only by the tenderers placed on the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be: - a certificate of absence of overdue debts regarding the payment of taxes, duties or contributions to the general consolidated budget local budget, state budget, etc.) at the time of presentation,

- casithe judicial authority of the economic operator and the members of the management, management or supervisory body of the respective economic operator or those having the power of decision or control representation within it as it results from the certifying certificate issued by the ONRC /

- documents that prove that the economic operator can bethe exemption provided for in Art. 166 par. (2), art. 167 paragraph (2), art. 171 of the Law no. 98/2016,

- other edifying documents as the case may be;

2) Non-compliance with the provisions of Art. 59 and 60 of Law no. 98/2016 (conflict of interest) - Each participant in the procedure shall submit a declaration on non-compliance with the provisions of art. 59 and 60 of Law no. 98/2016 attachedDUAE.

An economic operator that participates on its own and does not rely on the capabilities of other entities to meet the qualification and selection criteria will complete one DUAE.An economic operator that participates on its own but relies on the capabilities of one or more other entities (third party / subcontractors) is responsible for filing its own DUAE as well as a separate DUAE for each of the entities on which is based.

If the groups of economic operators, including temporary associations, participate in the procedure together, a separate DUAE must be presented containing the required information for each of the economic operators participating in the group.

DUAE will be transmitted electronically in SEAP in XML format signed with extended electronic signature.

At the request of the contracting authority, bidders placed on the first three places in the interim ranking listt When finalizing the evaluation of the submitted bids, according to the award criterion, it presents the supporting documents indicated in the data sheet in order to prove the ones assumed by the DUAE ..
