CPV Description: Electricity - Selection of Active Electricity Provider and Low Voltage Balancing Coordinator for the needs of the Regional Health Insurance Fund - Gabrovo The fulfillment of the subject of the procurement includes the following main activities:

Main Site: The Administrative Building of the Regional Health Insurance Fund - Gabrovo. The fulfillment of the subject of the order involves the following main activities:

1. Preparation-of all necessary documents for registration of the sites of the contracting authority on the free electricity market and execution of the full procedure for their registration. Inclusion of the assignor as an indirect member of the contractor's balancing group pursuant to the Electricity Trading Rules (PTFE), without the contracting entity paying a registration and participation fee. Energy monitoring, progmonitoring the customer's electricity consumption and compiling hourly consumption schedules. Notification of registration of hourly schedules in MMS of ESO, as well as carrying out all necessary activities related to the participation of the assignor on the free electricity market according to PTFE, EE and PIPE; Delivery of required quantities of net active electrical energyto the low voltage referred to in paragraph 2.4 of section II of this documentation, with possible deviations in the positive or negative direction. The estimated amount of electricity does not oblige the client to use it. The Contracting Authority reserves the right to change the quantity used depending on the need, as the contractor undertakes to deliver the required quantity-electricity per day, per month and throughout the delivery period

5. The projected 12-twelve-month active electricity is determined on the basis of the measured amounts of electricity consumed over a 12-month period and is estimated at 77, 000 kWh divided by tariff zones in roughly 74% of the daily area, 26 % Night Rate Zone. Participants should hold an electricity trading license with rights and obligations of a standard balancing group coordinator, in accordance with Art. 39 of the Law on Energy, issued by the Energy and Water Regulatory Commission (KEVR).

To certify the compliance with the above requirement, the participants fill in Part IV, point A, item 2 in EEDOP, where they submit information onthe heavy license issued by the KEWR

2. Participants should be registered with ESO as an electricity trader and coordinator of a standard balancing group with code number and status "active." To verify compliance with the above requirement, the participants complete part IV (A) (2) in EEDOP, where they present information about the existing registration in ESO as an auctionand as a co-ordinator of a standard balancing group with a code number and an active status of 3. The participant must have completed at least two activities with an object and volume identical or similar to those of the order for the last three years on the submission of the tender ..

Based on Article 67, Paragraph 5 of the PPA, the contracting authority may at any time require the participants to submit a-the documents proving the information provided in EEDOP according to Art. 64, para. 1 of the Public Procurement Act, where this is necessary for the lawful conduct of the procedure. The tenderer designated as a contractor shall, before concluding the contract, furnish documents proving its conformity with the criteria of suitability for professional and technicalskiing and professional abilities under Art. 67, para. 6 of the Public Procurement Act as follows:

4.1. Under item 1. a certified copy of a valid electricity trading activity license shall be submitted, including for the activity of the "Standard Balancing Group Coordinator" in accordance with the Energy Act and other relevant legal acts, as well as with the administrative acts issued by the Commission for energy and water regulation(KEVR).

4.2. Under item 2 a certified copy of a document issued by ESO EAD for available registration as an electricity trader and as a coordinator of a standard balancing group with a code number and status "active" shall be submitted under item 2.

4.3. presents a list of services that are identical or similar to the subject of the public contract, indicating the values, dates and recipienttogether with proof of delivery ..

5. In the case of unions that are not legal entities, compliance with the selection criterion under item 1 shall be proven by one or more of the participants in the grouping and the compliance with the selection criteria under items 2 and 3 shall be proved by each participant in unification. Where subcontractors participate, the requirements set out apply to the subcontractorsin terms of the share and the type of activities it will perform.

The assignor does not impose requirements regarding the economic and financial status of the participants. Origin of an insurance policy for insurance that ensures the performance by coverage by the insurer of the contractor's liability.

When the selected contractor is a non-legal entityEach of the partners may be the principal of the bank guarantee, respectively the importer of the amount of the guarantee or the holder of the insurance.

When the guarantee is presented in the document according to the type in which it is presented, the subject of the contract shall be explicitly stated, for which the guarantee is presented. The conditions under which the performance guarantee is withheld or released shall be settled-with the public procurement contract. The Contracting Authority releases the performance guarantee without interest for the period during which the funds have been legally staying with it.

The retention and release of the performance guarantee.

The terms and conditions under which the performance bond is retained or discharged are governed by the between the contracting authority and the contractor within the framework of the contractThe award of the public procurement contract shall not be concluded before the designated contractor to submit a performance guarantee.

Removal of the participants in the procedure.

The Contracting Authority shall remove from participation in the procedure for the award of a public contract a participant for whom the grounds under Art. 54, para. 1 of the Public Procurement Act and the circumstances indicated by the contracting authority under Art-Art. 55, para. 1, 3, 4 and 5 of the PPA as well as when it is established that it is a company registered in a preferential tax jurisdiction or controlled by such a company or one of the members of the grouping is registered or controlled by a registered a company entity, unless there is an exception under Art. 4 of the Law on Economic and Financial Relations with Companies, registeredand in jurisdictions with preferential tax regime, the persons controlled by them and their actual owners, as well as when the participant is a related person within the meaning of - 2, item 45 of the Supplementary Provisions of the Public Procurement Act with another participant in the procedure. as the coordinator of a balancing group, the contractor should:

- predict the consumption of the sites of the assignor and carry out the planningand to negotiate the specific quantities of active net electricity under the Electricity Trading Rules, - - prepare hourly daily electricity supply schedules, taking into account the expected hourly load for the objects, - send the hourly daily schedules to the system for administering the market of its electricity operator- provides balancing liability by settling the deviations from the requested amounts of electricity for each settlement period in the hourly daily delivery schedules and their payment, all costs / revenues from the balancing of the sites of the the contractor is at the expense of the contractor.

In addition, he should:

- not provide edocuments and information about the execution of the contract, and not to use information that has become known to him in the performance of his obligations under the contract, - to issue original invoices for the actually consumed quantities of net active electrical energy at low voltage reported by the funds for commercial metering at the sites of the contracting entity according to ATEX and PIRES, - to complythe provisions and rules laid down in the Energy Efficiency Directive, the WATER and the orders of the transmission and distribution system operators so that it is not removed as a registered electricity trader and balancing group coordinator, - accept the contracting authority's right to join new sites and to make a change in the estimated quantity in a positive or negative direction according to-the need arisen for the entire duration of the contract
