Electricity.

The subject of the order is the supply of electricity to MASTER Odpady i Energia Sp. z o.o. to the Międzygminny Zakład Kompleksowy Komeremalnych Odpadow Komunalnych (MZKZOK) in Tychy in the tariff group B21 and to the low voltage points in tariff groups: 5 points C11 and 1 point C12A.

In MZKZOK two cogeneration units were installedCHP type HE-KEC-LG329-B electric power 332 kWel (640 kW electric installed) each for the production of renewable electricity and heat from biogas produced in dry horizontal methane fermentation and one aggregate PETRA 460C type 3560 APL CCH with an electrical power of 300 kVA / kWel (installed electrical 440 kW) for the production of renewable electricity and heatfrom a landfill biogas, with a total installed electric capacity of three 1720 kW cogeneration units.

The contracting authority holds a license issued by the President of the Energy Regulatory Office by decision of 19.3.2007 no. WEE / 958/13756 / W / 3/2007 / LW (with later changes) for the generation of electricity for the period from 20.3.2007 to 31.12.2025.

The ordering party is not the final buyer in reasonof the Excise Duty Act and is a taxpayer of excise duty, as an entity holding a concession for the production of electricity.

2. Order subject:

1) The subject of the order is the delivery of electricity in accordance with the applicable regulations, quality standards of the Energy Law Act (ie OJ of 2017, item 220, as amended), and executive provisions, in particularof the Ordinance of the Minister of Economy of 4.5.2007 on specific conditions for the operation of the power system, for points in tariffs B21, C12a and C11 for MASTER Odpady i Energia, 43-100 Tychy ul. Local 11.

2) Forecasted demand for electricity during the order execution period, ie until 31/12/2019 (16 months)

• for medium voltage consumption points, about 10, 000 MWh (for 16 months).

MZKZOK produces renewable electricity and heat from biogas.

Predicted production over a period of 16 months at a level of 3, 200 MWh to 8, 000 MWh.

All energy produced in the first row will be used for the MZKZOK supply, and the surplus will be sold to the operator.

Destination of purchased energy - own use MZKZOK.

• for pointo low voltage consumption:

Total consumption planned over a period of 16 months for the picking point in the tariff group: - C12A active peak: 1.7 MWh, off-peak heating activity: 4.8 MWh,

- C11 45 MWh.

Input size the volume of electricity is the estimated value based on the current consumption and production. The Contracting Authority reserves the right to reduce or increase totalof the volume of electricity, in relation to the amount specified in point 2. Any change in the estimated consumption specified in point 2 will not result in additional costs for the Purchaser, except for the actual amount of electricity consumed according to the prices specified in the tender documentation.

3) Ordering party for the collection point in tariff group B21 has separated energy sales contractselectricity distribution and distribution services as well as electricity sales and distribution services contracts (comprehensive agreements) for points in tariff groups Cx, as shown below:

4) The Contractor as part of the implementation of the subject of the order is required tonotification of the indicated DSO to execute the contract for the sale of electricity concluded with the contractor, termination of existing comprehensive contracts and representation of the contracting authority before the relevant DSO in matters related to the conclusion of a contract for the provision of distribution services pursuant to the power of attorney.

5) Employer with a collection point in the tariff group B21, declares, andthe measurement system is adapted to the TPA rule.

6) The Awarding Entity did not sign annexes regarding loyalty and promotional programs.

7) The current seller for the electricity consumption points covered by the proceedings is PGE Obrot S.A., TAURON Sprzedaż sp. o.o. and TAURON Sprzedaż GZE Sp. z o.o.

8) All electricity consumption points covered by the proceeding are located in the areanie Operator Systemu Dystrybucyjnego TAURON Dystrybucja SA

9) The Purchaser will make available all data possessed as necessary in the seller change procedure. • Bid bond:

1. A deposit should be paid in the amount of PLN 50, 000.00 (in words: fifty thousand zlotys 00/100) by on 29.6.2018 to 10:00. The date of the funds' influence on the ordering party is decisive. A) in money by bank transfer to the bank account-Environmental Protection No. 66154011282001704349770004.

b) bank guarantees or socially lending savings bank guarantees (except that the surety is always a cash guarantee), bank guarantees, insurance guarantees, sureties granted by entities referred to in art. 6b par. 5 point 2) of the Act of 9.11.2000 for the establishment of the Polish Development Agencyoju Entrepreneurship.

2. The bid bond can be paid in one or several forms.

3. If the contractor makes a deposit in the form of a bank guarantee, insurance guarantee or surety:

1) the guarantee / guarantee document drawn up in a foreign language should be submitted together with the translation into Polish,

2) guarantees / sureties must be subject to Polish law; all disputes regarding the guarantee / porthey will be settled in accordance with Polish law and subject to the jurisdiction of Polish courts.

4. In the case when the contractor makes a deposit in the form of a bank guarantee or insurance guarantee, the following must in particular be explicit: a) the obligation of the guarantor (bank, insurance company) to pay the entire amount of the bid security irrevocably and unconditionally at the first requestego (beneficiary of the guarantee) containing a statement that there were circumstances referred to in point 3 without confirming these circumstances,

1) obligation of the guarantor / guarantor (eg bank, insurance company) to pay the entire amount of the bid security irrevocably and unconditionally at the first request of the ordering party (beneficiary of the guarantee / surety Master Waste and Energy Ltd) containing a statementthat the circumstances referred to in item 7 occurred, without confirming these circumstances,

2) the term of the guarantee / surety, which can not be shorter than the date of binding the offer.

5. The ordering party will reject the offer of the Contractor if he does not bring the bid bond or bring the bid bond in an incorrect manner.

6 The bid bond paid in cash will be stored on the bank account.

7. Purchaserstops the bid bond with interest, if:

1) the contractor whose offer was selected:

a) refused to sign a public order contract on the terms specified in the offer,

b) it was impossible to conclude a public procurement contract for reasons attributable to his side,

2) contractor, in response to the call referred to in art. 26 par. 3 and 3a of the Act, for reasons lyingon his side, he did not submit declarations or documents confirming the circumstances referred to in art. 25 ust. 1 of the Act, the statement referred to in art. 25a para. 1 of the Act, powers of attorney or did not agree to correct the mistake referred to in art. 87 par. 2 point 3 of the Act, which made it impossible to select the offer submitted by the contractor as the most advantageous one. Employer returnand a bid bond to all contractors immediately after the selection of the best offer or cancellation of the proceedings, with the exception of the contractor whose offer has been selected as the most advantageous, subject to point 9 p. 2.

9. The contractor whose offer has been selected as the most advantageous, the contracting party returns the deposit immediately after the conclusion of the public procurement contract and bringing theguarantee the due performance of the contract if its application was requested.

10. The Contracting Authority shall immediately return the bid bond at the request of the contractor, who withdrew the offer before the deadline for submission of tenders. The ordering party requests that the bid bond be reimbursed by the contractor, who has been refunded on the basis of point 10, if as a result of the final settlement of the appeal his offer was selected as the mostzystniejsza. The Contractor shall pay the bid bond within the time specified by the ordering party.

12. If the bid bond is paid in cash, the orderer will return it with interest resulting from the bank account agreement, on which it was kept less the cost of running the account and the bank commission for transferring money to the contractor's account. The offer should include the account number on which zThe contractor is to return the bid bond.
