4.1.1 Entry in the register

Business entities must be entered in the court, craft, professional or other appropriate register in the country of its establishment, shall be entered in the sections of the ESPD form for which information is requested in Part IV. Selection criteria for the economic operator, Section A. Ability to engage in professional activity.

In case the Contracting Authority requests verification of the information specified in the e-ESPD, the ability to perform professional activity of the economic operator referred to in point 4.1. is proven by: - - an extract from a court, trade, professional or other appropriate register kept in the Member State of establishment.

4.1.2. Authorization or Membership

G.the contracting entity must have proof of possession of the authorization or membership in the following organizations:

In case the Client requests verification of the information specified in the e-ESPD the ability to perform the professional activity of the economic operator referred to in point 4.1.2. the following shall be demonstrated:

If such documents are not issued in the country of establishment of the economic operator or if they do not cover all the circumstances, they may be replaced by a statement underor, if the affidavit under the law of the country concerned does not exist, a statement from the provider with a certified signature at the competent judicial or administrative authority, notary public or professional or commercial body in the country of establishment of the economic operator or the country of which the person is a national.
