The purpose of this award procedure is to purchase equipment for the development of the interlocking and access control systems of the ELI-NP facility, as required in the specifications. The interlocking and access control systems in the experimental areas of the ELI-NP facility are an integral part of the personnel protection system that carries out itsactivity within the facility. To improve the level of safety in the operation of equipment, interlocking, access control, as well as the necessary safety measures when using laser systems will be achieved with the help of systems controlled by PLCs (Programmable Logic Controller). The products covered by this procurement contribute significantly to the improvementoccupational safety and health measures in the operation of the laser system and experimental equipment, and the products in the specifications represent the physical and software support on which to develop and adapt the interlocking system of equipment in the ELI-NP facility and the access one in the experimental areas.

The purpose of this award procedure is the acquisition of equipment for the development of interlocking and access control systems of the ELI-NP facility, respectively PLC components vacuum system.
To demonstrate the fulfillment of qualification criteria / requirements will be presented:
1 . the sole tenderer / associated tenderer / subcontractor / supporting third party must demonstrate thate falls within the provisions of art. 164 of Law no. 98/2016, for each lot.
In this sense, the sole bidder / associated bidder / subcontractor / third party bidder will complete the DUAE part "Reasons for exclusion" section A.
The bidder ranked first in the intermediate ranking prepared at the end of the evaluation offers, will present for each lot separately, at the request they havethe contracting authority, the following edifying documents that prove / confirm the non-compliance with the situations provided in art. 164 above, both for the sole tenderer / associated tenderer, and for the supporting subcontractor / third party declared in the tender:
- the criminal record of the economic operator and of the members of the administration, management or supervisory body of the respective oeconomic operator or those who have the power of representation, decision or control within it, as it results from the ascertaining certificate issued by ONRC / the constitutive act;
- other edifying documents, as the case may be;
2. the sole tenderer / the associated tenderer / the subcontractor / the supporting third party must prove that it does not fall within the provisions of art. 165 of Law no. 98/2016, for each
In this sense, the sole bidder / associated bidder / subcontractor / supporting third party will complete the DUAE part "Reasons for exclusion" section B.
The bidder ranked first in the intermediate ranking prepared at the end of the bid evaluation, will submit for each lot separately, at the request of the contracting authority, the following edifying documents proving / cconfirms the non-compliance with the situations provided in art. 165 above, both for the sole bidder / associated bidder, and for the supporting subcontractor / third party declared in the bid:
A. Romanian legal entities must present certificates of fiscal attestation regarding the fulfillment of the obligations to pay taxes, fees or contributions to the general consolidated budget (local budget, state budget, etc.), from which to show the lack of outstanding debts at the time of presentation of these certificates;
B. foreign legal entities will present any supporting documents issued by the authorized institutions of the country of origin (tax attestation certificates, criminal records, other equivalent documents, etc.) proving that they have fulfilled their payment obligations.taxes, duties or contributions in accordance with the national law of the country of residence of the sole tenderer / associate tenderer / subcontractor / supporting third party or of the country in which the sole tenderer / associated tenderer / subcontractor / supporting third party is established. The edifying documents presented must show the absence of outstanding debts at the time of presentationthereof;
3. the sole tenderer / associated tenderer / subcontractor / supporting third party must demonstrate that it does not fall within the provisions of art. 167 of Law no. 98/2016, for each lot.
In this sense, the sole bidder / associated bidder / subcontractor / supporting third party will complete the DUAE part "Reasons for exclusion" section C.
The bidder ranked first in ranking iIntermediate prepared at the end of the evaluation of the tenders, will present for each lot, at the request of the contracting authority, the following edifying documents:
- certificates / records / edifying documents proving / confirming the non-compliance with the situations provided in art. 167 para. (1), both for the sole tenderer / associated tenderer and for the supporting subcontractor / third partydeclared in the tender (if applicable)
- edifying documents proving the fact that the sole tenderer / associated tenderer, as well as for the subcontractor / supporting third party declared in the tender are included in the provisions of art. 167 para. (2), art. 171 of Law no. 98/2016 on public procurement (if applicable)
- other edifying documents, as appropriate
Single bidder / bidder asthe contractor / subcontractor / supporting third party must not be found in the situations provided in art. 59-60 of Law no. 98/2016. The decision-makers within the contracting authority are:

Note 1: in order to demonstrate the fact that it does not fall into one of the situations provided in art. 164, 165 and 167 of Law no. 98/2016, the tenderer ranked first in the intermediate ranking prepared at the end of the evaluation of tenders, shall submit, at the request of the contracting authority, any building document in the country of origin or in the country where the tenderer is establishedt, such as certificates, criminal records or other equivalent documents issued by the competent authorities of the respective country according to art. 168 para. (1) of Law no. 98/2016, both for the sole tenderer / associated tenderer, as well as for the third party supporters and subcontractors declared in the tender
Note 2: in case the documents mentioned above are not issued in the country of origin or in the country in which establishes the sole bidder / associated bidder / subcontractor / supporting third party or these documents do not cover all the situations provided in art. 164, 165 and 167 of Law no. 98/2016, the sole tenderer / associated tenderer / subcontractor / supporting third party will submit either a declaration on its own responsibility or, if in the respective country there are no legal provisions regarding the declarationon his own responsibility, an authentic statement given before a notary, an administrative or judicial authority or a professional association that has competences in this respect.
Special warnings:
1. Failure to submit the DUAE together with the offer (including for the associated bidder / supporting third party / subcontractor) will lead to its rejection as unacceptable;
2. The following will be submitted with the DUAEe documents: the firm commitment of the supporting third party which results in the effective manner in which its support will materialize, the subcontracting agreement and / or the association agreement, as the case may be. DUAE, will be presented in copy with the mention "according to the original".
The documents in alyour language other than Romanian will be presented in a copy with the statement "according to the original", accompanied by an authorized translation into Romanian.
The economic operators submitting the offer must prove a form of registration under the law of the country of residence it appears that the economic operator is legally constituted, that it is not in any of the situations of annulment of constitutedas well as the fact that it has the professional capacity to carry out the activities that are the object of the contract, for each lot separately. selection "section A.
The bidder ranked first in the interim rankingdrafted at the end of the evaluation of the tenders, will present for each lot, at the request of the contracting authority, the supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certificate issued by the Trade Register Office at the territorial court, attesting that the object the contract has correspondence in the activityto the tenderer / associate tenderer / subcontractor, for the part of the contract he is performing. For foreign legal entities, supporting documents shall be submitted proving a form of registration in accordance with the legal provisions of the country in which the tenderer is established, which shall show the information requested by the contracting authority. The documents presentede must be real / valid on the date of their presentation. Other minimum information that must be found in the ascertaining document are:
- legal identification data (name, headquarters, unique registration code),
- main and secondary activities,
- legal representatives
Documents sent following the request of the contracting authority for the demonstration of those declared in DUAE, willbe presented with the words "in accordance with the original".
Documents in a language other than Romanian will be presented in copy with the words "in accordance with the original", accompanied by an authorized translation into Romanian.
Note 1: in case of an association, present documents for each of the members of the association. For the fulfillment of the requirement it is sufficient that the object of activity of each memberbe in accordance with the part of the contract that will be performed.
Economic operators will also take into account the information presented in the document "Instructions to tenderers", attached to the section "Attached documents" that make up the award documentation from SEAP.
