In the open procedure can participate participant who meets the requirements of art. . 10, para. 1 of the Public Procurement Act. The Assignor does not have the right to create a legal entity when the participant selected as a contractor is a union of physical and / or legalpersons. Where the participant is a consortium which is not a legal person, a document must be submitted showing the legal basis for the formation of the grouping with a duration not shorter than the term of performance of this contract. The document must contain:

1. rights and obligations of the members of the grouping; allocation of responsibilities between the members of the grouping; activities, which will be performed by each member of the grouping.

The assignor removes from the procedure the participant for whom the grounds under Art. 54, para. 1, item 1-7 of the Public Procurement Act, Art. 55, para. 1, item 1, items 4 and 5 of the Public Procurement Act and Art. 107 of the Public Procurement Act, as well as the circumstances under Art. 3, item 8 and Art. 4 of the Economic and Financial Relations Act with companies registered in jurisdictions with preferential tax regime, controlthe persons they have taken and their actual owners and the presence of circumstances under Art. 69 of the Law for Counteracting Corruption and for Removal of Unlawfully Acquired Property. Any member of the grouping which is not a legal person, subcontractors and third parties must meet the relevant selection criterion and there are no grounds for disqualification from the procedure. According to art67, para. 1 of the PPL when submitting the tender the participant declares the lack of grounds for removal from the procedure and compliance with the selection criterion by submitting the enEEDOP. Where the participant is a grouping which is not a legal entity, a separate ENDED shall be submitted for each member of the consortium when submitting the tender. When a participant has indicated that it will use subcontractors and /When submitting the tender, each participant shall be given a separate EEDOP. Documents demonstrating the information specified in the enEEDOP may be required additionally under the conditions of Art. 67, para. 5 of the Public Procurement Act. According to Art. 67, para. 6 of the Public Procurement Act before the conclusion of a public procurement contract, the tenderer designated as a contractor shall present current documents certifying missingthe grounds for removal from the procedure and compliance with the selection criteria. Documents are submitted for each member of the grouping which is not a legal entity and subcontractors and third parties, if any.

When signing the contract, the tenderer designated as contractor shall provide a guarantee for the performance of the contract at the rate of 3% the value of the contract excluding VATthe execution fee is represented in one of the following forms: a) an unconditional irrevocable bank guarantee in the original; or b) a received cash amount paid to a current account of the NRIC: IBAN: BG53CECB97903319100900, BIC: CECBBGSF, bank: CCB AD, certified by a payment order, or

C) insurance, which ensures the performance by covering the contractor's liability - in the original.the terms and conditions for the detention and release of the performance guarantee shall be laid down in the contract for the award of the public contract.
