Operation of the water supply network within the commune of Suchy Las

The subject of the orders is the operation of the water supply network within the commune of Suchy Las. A detailed description of the subject of the order is presented in Volume II of this SIWZ [Description of the subject of the order]

Main Site: I. The area of exploitation of water supply networks covered-Under the contract in the Suchy Las

Aquanet commune, the Contractor undertakes, throughout the term of this Agreement, to maintain the Equipment in a condition ensuring their full efficiency and uninterrupted capacity to deliver water in the required quantity and under appropriate pressure by Aquanet; good quality in a continuous and reliable manner as well as for ongoing operation of the Officez oo, and in particular to carry out the following actions:

- supervision and direct service of Devices,

- performing cleaning and auxiliary works, the subject of which will be devices and real estate, on which the devices are located,

- maintenance and performing ongoing repairs of the Equipment specified in the SIWZ,

- carrying out, at least once a year, inspection and maintenance of external fire hydrantsIn accordance with the Ordinance of the Minister of Internal Affairs and Administration of 24.7.2009 on fire-fighting water supply and fire roads in the quantities specified in the SIWZ,

- maintenance of water ambulance, guaranteeing immediate action in case of finding or reporting by third party (including recipients of Aquanet services) any irregularities in funarranging the Equipment, - observing the environmental protection regulations in force in the scope of functioning of the Equipment, - ensuring the delivery of water of the quality corresponding to the applicable standards and regulations, - supervision over the Objects security according to the current security status of the Facility. Contractors who are not subject to exclusion from the award procedure may participate in the proceedings-orders in the circumstances referred to in art. 24 sec. 1 item 12-23 of the PPL with exclusion referred to in art. 133 ust. 4 Pzp, art. 24 sec. 5 points 1, 5, 6, 8 Pzp and meet the conditions for participating in the proceedings, concerning: a) the competence or entitlements to conduct a specific professional activity, if it results from separate regulations, the Ordering Party does not make any specific requirements regarding the description of sp(b) the economic or financial situation, the Employer does not make specific requirements to describe the fulfillment of this condition, participation in the process. c) technical or professional capacity .2. In order to confirm the lack of grounds for exclusion from the proceeding and to confirm that the conditions for participation in the proceedings are met, the contractor will be obliged toedit the ordering party with the following statements and documents, in terms specified in detail in the relevant terms of reference (hereinafter: "SIWZ"): a) the contractor's statement as a preliminary confirmation of compliance with the conditions of participation in the procedure set out in the ToR and no grounds for exclusion, submitted on the uniform European form order document (hereinafter "EAT"), whichThe model is defined in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard uniform European order document (EU L series, 2016, No. 3, page 16); EAT along with any attachments should be submitted in electronic form with a qualified electronic signature until the deadline for submitting offers to: jedz@aquanet.pl b) excerpt from the relevant registeror from central records and information on business activities, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 Pzp; c) certificate of the competent head of the tax office confirming that the contractor is not in default of paying taxes, issued not earlier than 3 months before the deadlineat the submission of offers or other document confirming that the contractor has entered into an agreement with the competent tax authority on the right to repay these receivables, together with any interest or fines, in particular obtained legally permissible, postponement or spreading into installments of overdue payments or suspension in full implementation of the decision of the competent authority ; (d) a certificate of proper terraino organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with competent authority in casesI repayment of these receivables together with possible interest or fines, in particular obtained the legally required exemption, deferral or installment payment of overdue payments or suspension in full of the implementation of the decision of the competent authority; e) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act and, regarding conviction for offense to custody, to the extent determined by the ordering party on the basis of art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submission of bids, f) a statement of the Contractor regarding the lack of grounds for exclusion specified in art. 24 sec. 1 item 15 and 22 of the PPL and art. 24 sec. 5 points 5-6 PPL (attachment No. 5 to the Terms of Reference). Documents concerning foreign contractors have been publishedo described in paragraphs 7.4.-7.6. SIWZ.

The ordering party does not set specific requirements regarding the description of compliance with the condition of participation in the proceedings in relation to the condition regarding economic and financial capacity

1. In order to confirm the lack of grounds for exclusion from the procedure for granting the order in the circumstances referred to in art. 24 sec. 1 point 23 PPL, the contractor will be required to submit a declarationnot about belonging or not belonging to the same capital group. The contractor should submit the said declaration within 3 days from the date of placing by the Ordering Party on the website, information referred to in art. 86 par. 5 Pzp. The pattern of the statement is contained in Annex 4 to the ToR. 2. In the procedure for ordering communication between the Ordering Party and the Contractorcami is carried out through the postal operator within the meaning of the Act of November 23, 2012 Postal Law, in person, through a messenger, fax or using electronic means of communication within the meaning of the Act of 18.7.2002 on the provision of electronic services, taking into account the form requirements laid down below. 3. In the proceedings, the declaration is made in fwritten or electronically, with the exception that EAT should be sent in an electronic form with a qualified electronic signature. The statements of entities submitting a joint bid (Article 25a (6) of the PPL) and entities making the potential available (Article 25a paragraph 3 point 1 of the PPL) submitted on the EAT form should be in the form of an electronic document, signed with qualified subpersonelectronic files by each of them to the extent that they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. 4. The electronic communication means used for submitting EAT by the Contractor is e-mail. Note! Placing an EAT along with an offer on a data carrier (eg a CD, a pendrive) or writing is inadmissible, because it does not constitute its submission with the use ofelectronic communications within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services. 5. EAT along with any attachments should be submitted in an electronic form with a qualified electronic signature until the deadline for submitting offers to the following address: jedz@aquanet.pl 6. The information to be provided in EED has been described in detail in point 7.1.a) of the ToR. 7. Detailsthe lead instruction regarding the submission of the EAT in electronic form can be found in item 8.8 of the ToR. 8. The complete offer must include: - a) the offer form (Annex 1 to the Terms of Reference), b) in case of signing the offer by proxy and, in the case of contractors applying for granting the order, the power of attorney, c) in the case of relying on the capabilities of another entity commitment of thisotu to give the contractor the necessary resources for the needs of the order.4. The SIWZ is available free of charge on the Employer's website (www.aquanet.pl) from the moment of publication of this announcement on the order in the Official Journal of the European Union, in accordance with art. 42 par. 1 Pzp. At the same time, the contracting authority informs that it will not provide the contractors with SIWZ in paper form.5.-The offer binding period is 60 days.
