1 The contract may be applied for by the contractors who:

1.1 meet the conditions for participation in proceedings regarding competence or entitlements to-carrying out specific professional activities, if it results from separate regulations. The ordering party does not specify any special requirements in this respect.

1.2. they are not subject to exclusion from the proceedings based on art. 24 sec. 1 and par. 5 points 1 and 8 of the Public Procurement Law, hereinafter referred to as Pzp, and meet the requirements specified in the ToR.

2. In the course of examination of offers, the Employer will apply art. 24aa paragraphPzp. In order to demonstrate initially the lack of grounds for exclusion, referred to in art. 24 sec. 1 and par. 5 points 1 and 8 of the Public Procurement Law and in order to - initially demonstrate compliance with the conditions for participation in the proceedings, the Contractor is obliged to send in electronic form (with a qualified electronic signature) a statement in the form of a Single Europeanabout the Order Document (hereinafter referred to as "EAT"). The rules for sending E-JIA with electronic means of communication are specified in Chapter I, items 20 and 21 of the ToR.

3. The ordering party will exclude from the proceedings 3.1. The Contractor to whom the conditions specified in art. 24 sec. 1 with regard to art. 24 sec. 7 and art. 24 sec. 5 points 1 and 8 of the Public Procurement Law

3.2. Contractor who will not submit the required declarations or documentsub does not meet other requirements - specified in the Public Procurement Law and the ToR.

4. In order to demonstrate compliance with the conditions for participation in the procedure and no grounds for exclusion from the award procedure, the Contractor whose tender will be evaluated as the most advantageous will be required to submit the documents specified in the Regulation of the Minister of Development of 26.7.2016 on the types of documentswhich the contracting authority may demand from the contractor in the proceedings for the award of the contract, i.e. - 5 para. 1, 2, 3, 4, 5, 6, 9; - 7 para. 1 point 1, 2 and paragraph 3.

4.1. Contractors jointly applying for the order are obliged to appoint a representative to represent them in the proceedings for the award of the order or to represent them in the proceedings and to conclude a public procurement contract. F.nomocation should be attached to the offer. In the case of an offer submitted by entities acting jointly, whose offer will be evaluated as the most advantageous.

Each partner submits documents referred to in the Ordinance of the Minister of Development dated 26.7.2016 on the types of documents that the contracting authority may request from the contractor in proceedings for the award of the contract, i.e. - 5 ust. 1, 2, 3, 4, 5, 6, 9; - 7 para. 1 point 1, 2 and paragraph 3

5. All documents attached to the offer or supplemented in the course of its verification must be submitted in the form of original or photocopies certified for compliance with the original by a person authorized to make declarations of will on behalf of the contractor. If the entitlement arises from a separate power of attorney, they should be enclosed.

6. Each Contractor in theserminie 3 days from posting on the website (www.spcsk.pl) information referred to in art. 86 par. 5, shall provide the Ordering Party with a declaration of belonging or non-affiliation to the same capital group within the meaning of the Act of 16.2.2007 on competition and consumer protection (ie: Journal of Laws of 2015, item 184, 1618 and 1634) with other Contractors who submitted offers. In noteThe Contractor may provide evidence (documents or information) confirming that connections with another Contractor do not lead to distortion of competition in the procedure for awarding the order. The Employer does not specify any special requirements in this respect.

Contractor who is subject to exclusion pursuant to art. 24-paragraph. 1 points 13 and 14 and 16 of the Public Procurement Law or - point 11.1.1. and 11.1.2 of the ToR, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by an offense or fiscal offense, financial compensation for damage suffered or remedied, a comprehensive explanation of the facts andcooperating with law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The regulations referred to in the first sentence shall not apply if the Contractor, being a collective entity, has been convicted by a valid court verdict againstthe request for a contract and the expiry of the prohibition specified in that judgment has not expired. The Contractor is not subject to exclusion, if the Ordering Party, considering the weight and special circumstances of the Contractor's action, considers the evidence presented to be sufficient. The Ordering Party requires payment of the bid bond - the amount of the bid security divided into individual packages and detailed information on the payment-and the return of the deposit is included in the Specification of Essential Terms
