The subject of the order is the gradual supply of standard diesel oil tankers in the amount of 810 m for Miejski Zakład Komunikacji Sp. z o.o. in Oświęcim.

The subject of the order is successive suppliesand tank trucks for standard diesel oil in the amount of 810 m. Diesel oil should comply with the Polish Standard: PN-EN 590 A1: 2017-06 and the amendment to the Polish Standard PN En 590 A1: 2017-06 / Ap1 "Fuels for motor vehicles Diesel oils Requirements and test methods "and the Ordinance of the Minister of Economy of October 9, 2015 regarding quality requirements for liquid fuels (Journal of Laws of2015, item 1680), but the provisions of the Regulation are mandatory.

A detailed description of the subject of the contract can be found in the Specification of Essential Terms of Order (SIWZ) in Chapter III.

1. Contractors who can apply for the contract who:

1) are not subject to exclusion,

2) meet the conditions for participation in the procedure specified by the contracting authority in the contract notice, andin point 3 of this chapter of the ToR.

2. Grounds for exclusion:

2.1. Obligatory grounds for exclusion.

The contractor may apply for the award of the contract and is not subject to exclusion from the procedure due to the circumstances listed in art. 24 paragraph 1 points 12-23 of the PPL (obligatory grounds for exclusion), subject to Art. 133 section 4 of the Act.

2.2. Optional grounds for exclusion, for whichch referred to in art. 24 paragraph 5 of the Public Procurement Law

- According to art. 24 paragraph 5 point 1 of the Public Procurement Law, the contracting authority provides for the exclusion from the proceedings of a contractor with respect to which liquidation has been opened, if the arrangement approved by the court in restructuring proceedings provides for satisfaction of creditors by liquidation of its assets or the court ordered the liquidation of its assets pursuant to art. 332 paragraph 1of the Act of 15.5.2015 Restructuring Law (Journal of Laws of 2016, item 1574, as amended) or whose bankruptcy was announced, with the exception of the contractor who, after the declaration of bankruptcy, entered into an arrangement approved by a final court decision, if the arrangement does not provide for satisfaction of creditors by the liquidation of the assets of the bankrupt, unless the court ordered the liquidation of his assets under art. 366 section 1 of the Actof 28.2.2003 Bankruptcy Law (Journal of Laws of 2016, item 2171, as amended)

- In accordance with art. 24 paragraph 5 point 8 of the Public Procurement Law, the contracting authority provides for the exclusion from the procedure of a contractor who has violated obligations regarding taxes, fees or social security or health insurance contributions, which the contracting authority is able to demonstrate by appropriate means of evidence, except forreferred to in paragraph 1 point 15, unless the contractor has made payments of taxes, fees or social security or health insurance contributions together with interest or fines or has entered into a binding agreement on the repayment of these debts. to be submitted: documents in accordance with Regulation Ministra Rozwoju of 26.7.2016 regarding documents that can be requested by the contracting authority from contractors in the procurement procedure (Journal of Laws 2016, item 1126 as amended) $ 5 points 1, 2, 3, 4, 6.

Conditions for participation in the procedure:

Contractors who meet the conditions for participation in the procedure regarding: competence or powers to conduct specific competitions may apply for the public contractprofessional activity, unless it results from separate provisions; the contractor will meet this condition if it demonstrates that it holds a license to trade in liquid fuels (Journal of Laws of 2016, item 2039).

In order to confirm that the contractor has met the conditions for participation in the procedure or criteria for selecting existing competences or powers to conduct specific activities, the contracting authority will call contractorto be submitted: documents in accordance with the Regulation of the Minister of Development of 26.7.2016 regarding documents that can be requested by the contracting authority from contractors in the procurement procedure (Journal of Laws 2016, item 1126, as amended) $ 2 para. 1 point 1.

The Contractor meets the condition, if in a period not longer than the last 3 financial years, and if the period of business is shorter - in this period:

1) achieved in each of the last 3 years before the deadline for submission of bids, and if the period of business is shorter - in this period, net sales revenue of at least PLN 3 000 000;

2) has financial resources or creditworthiness in amounting to at least PLN 360, 000;

3) has civil liability insurance in respect of the business related to itwith the subject of the contract in the amount of at least PLN 360, 000.

In order to confirm that the contractor has met the conditions for participation in the procedure or the selection criteria for existing competences or powers to conduct specific activities, the contracting authority will call the contractor to submit: documents in accordance with the Regulation of the Minister of Development of 26.7. 2016 regarding the documents that can be requestedgive the contracting authority from contractors in the procurement procedure (Journal of Laws 2016, item 1126, as amended) $ 2 item 2 points 1, 3, 4.

I Information on contractors having their registered office or place of residence outside the territory of the Republic of Poland, referring to the provisions of the ToR, chapter XIV, sections 4, 5, 6.
