Subject The order is a successive supply of diesel oil and ethylene PB 95 for the Ordering Party, for a period of 36 months, including:

1. The subject of the order is the successive supply of diesel oil and ethylene PB 95 for the Ordering Party, for a period of 36 months, including: - a) Task 1 - delivery of diesel oil in the amount of 6, 006 m for a period of 36 months

- code CPV 09134100-8

b ) Task 2- supply of Pb 95 ethyline at 705 m for 36 daysmonths

- CPV code 09132100-4

For refueling and resale.

2. The fuel supplied must meet all quality requirements specified in: - a) regulations issued on the basis of art. 3, par. 2, point 1 and art. 5 of the Act of 25.8.2006 on the fuel quality monitoring and control system (Journal of Laws of 2016, item 1928) and in particular in Regulation Ministra Gospodarki from 9/10/2015 regarding quality requirements for liquid fuels (Journal of Laws of 2015, item 1680), and Regulation of the Minister of Energy of 1 December 2016 regarding quality requirements for sulfur content for oils and types of installations and conditions in which heavy fuel oils will be used (Journal of Laws of 2016, item 2008),

b) current Polish Standards: PN-EN 590 for diesel; PN-EN 228 for gasoline Pb 95,

c) as well as must comply with the standards and regulations amended in the course of delivery.

3. The place of delivery is: the registered office of the Ordering Party, at ul. Piłsudskiego 29, 21-400 Łukow, POLAND.

4. The delivery will be made on the order submitted by fax, telephone or e-mail in the quantity indicated by the Ordering Party, on the date (dateand hour) indicated by the ordering party. Deliveries will be received between 6:00 and 22:00 (Monday to Friday) and 7:00 7:00 (Saturday).

5. Expected size of one diesel supply - 22 m, Pb 95 - 4.6 m. Expected total volume of deliveries on a monthly basis: diesel oil - 215 m, Pb ethyline 95 22 m,

6a. Estimated approximate order size ondiesel oil with improved low temperature properties over the entire period covered by the procurement 100 m.

7. At the Ordering Party`s request, delivery will take place on Sundays and on public or church holidays. Deliveries will be made by the Contractor`s means of transport and at the cost of the Contractor (transport costs are covered by the Contractor).

9. The Ordering Party reserves the right to reduce or increaseamount of fuel deliveries depending on the needs of the Ordering Party up to 20% in relation to the entire order. The change in the quantity of the general order will not change the terms of the contract. The contractor can not demand from the customer ordering the exact quantities of fuels indicated in this specification and should take into account possible deviations, as accurate prediction of the quantity of fuel ordered isimpossible. The Employer will not be liable for placing orders in an amount smaller or larger than indicated in this specification.

10. The orderer requires that the fuel be supplied by road tankers that meet the requirements set out in the Act of 19.8.2011 on the transport of dangerous goods (Journal of Laws of 2019 item 382), equipped with devicesmeasuring the quantity of fuel delivered

11. The Contractor is responsible for the fuel ordered until it is discharged into the Ordering Party`s tank.

12. The payment for the fuel will take place within 30 days from the date of the Contractor`s delivery. The order will be performed for 36 months from the day of conclusion of the contract, - the Contractor is obliged to provide fuel with a cold blocking temperaturera adapted to the season and air temperature. In the case of very low temperatures predicted, the contractor will be required to deliver fuel with a cold filter blocking temperature not exceeding 30C. The fuel should be transported under conditions ensuring its proper quality, including protection against low temperatures. The contractor is obliged to provide the ordering party, with every delivery of the quality certificate of the delivered fuel.

Contractors who have the current license for trading in liquid fuels issued by the President of the Energy Regulatory Office may apply for the order, in accordance with the Act of 10.4.1997 Energy Law (Dz.U. 2018.755 i) - Contractors have a minimum annual turnover for fuels shown for 2018 in the amount not lessPLN 10, 000, 000.

You are insured against civil liability in respect of your business related to the subject of the order for a guarantee sum of no less than PLN 10, 000, 000.

In the event that two or more Contractors jointly apply for this order, these conditions must be met independently by at least one of these Contractors.

In the proceedings for grantingordering communication between the Employer and Contractors is done using the miniPortal https://miniportal.uzp.gov.pl/, ePUAP https://epuap.gov.pl/wps/portal and e-mail. The Employer appoints the following persons to contact the Contractors: Mr. Jan Lisiecki, tel. 48 257983155, e-mail: sekretariat@pks.lukow.pks Contractor intending to take part in the proceedings for grantingpublic speaking, must have an ePUAP account. The contractor holding an account on ePUAP has access to the following forms: submission, modification, withdrawal of the offer or application and to the communication form. Technical and organizational requirements for sending and receiving electronic documents, electronic copies of documents and statements and information provided using them are described in the regulationsamina of using the miniPortal and the ePUAP Regulations. The maximum size of files sent via dedicated forms for: submission, modification, withdrawal of the offer or application and for communication is 150 MB. The date of submission of the offer, applications, notifications, electronic documents, declarations or electronic copies of documents or statements and other information shall bedate of their transfer to ePUAP. The identifier of the proceedings and the public key for a given order award procedure are available on the list of all proceedings on the miniPortal and constitute Annex 3 to this ToR. The Contractor submits an offer / application for admission to participate in the proceeding, hereinafter the "application" via the Form for submission, modification, withdrawal of the offer or applicationavailable on ePUAP and also available on the miniPortal. The public key necessary to encode the offer by the Contractor is available to contractors on the miniPortal. In the bid / application form, the Contractor is obliged to provide the ePUAP mailbox address, on which correspondence related to the proceedings will be kept. The offer / application should / should be made in Polishm, while maintaining the electronic form in the pdf, .doc, .docx, .rtf, .xps, .odt data format. and signed with a qualified electronic signature. The manner of submitting an offer / application, including encryption of the offer, is described in the Regulations for the use of miniPortal. The offer / application should be submitted in the original. Any information constituting a trade secret within the meaning of the Act of 16.4.1993 oncombating unfair competition, which the Contractor reserves as a company secret, should be submitted in a separate file along with marking the "Annex representing business secret" and then with the files constituting the open part compressed into one archive file (ZIP). include the Single European Order Documentin an electronic form with a qualified electronic signature, and then together with the files constituting the offer to be compressed into one archive file (ZIP). The Contractor may, before the deadline for submission of tenders, change or withdraw the offer via the Form to submit, change, withdraw the offer or application available on ePUAP and also made available on the miniPortal. In all correspondence related to the present proceedings, the Employer and Contractors use the number of the advertisement (BZP, TED or ID of the proceeding).
