The Contractor will meet the condition if he proves that he has a valid operating licensein terms of trade in liquid fuels to the extent necessary to execute the order issued by the President of the Energy Regulatory Office pursuant to the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2012, item 1059 as amended) .

a) The Contractor will meet the condition if he proves that he has third party liability insurance in respect of his business related activities.with the order for a guarantee sum of not less than PLN 1, 000, 000 (in words: one million zlotys)

b) the Ordering Party requires the Contractor to prove that he has financial resources in the amount of at least PLN 500, 000.00 (in words: five hundred thousand zlotys) or creditworthiness in the amount of at least PLN 500, 000.00 (in words: five hundred thousand zlotys).

By entering this proceedings, kawhen the Contractor is obliged to pay a bid bond in the amount of PLN 440, 000 (in words: four hundred and forty thousand zlotys). Reliance on resources of other entities: 1) The Contractor may, in order to confirm compliance with the conditions of participation in the procedure, in appropriate situations and in relation to a specific order, or part thereof, rely on technical or professional abilities or financial situationeconomic or other entities, irrespective of the legal nature of the legal relationships that it has with it. 2) The Contractor, which relies on the abilities or situation of other entities, must prove to the Ordering Party that, when performing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary instructions forfor the needs of the order placed in the original or a copy certified for compliance with the original by a notary public. 3) The contractor, which relies on the financial or economic situation of other entities, is jointly and severally liable with the entity that committed to provide the resources, for damage suffered by the orderer as a result of not sharing these resources, unless for failure

4) The Awarding Entity will assess whether providing technical or professional capacity to the contractor by other entities or their financial or economic situation allows the contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there is a ground of exclusion for that entity referred to in art. 24 sec. 1 item 13-22 of the PPL and art. 24 sec. 5 pkt 1 and 8 Pzp. Contractors jointly applying for the award of the contract: 1) Contractors may apply for the award of the contract. 2) The contractors shall appoint a representative to represent them in the proceedings for the award or representation in the proceedings and conclusion of the public procurement contract. 3) If the offer of contractors appearing jointly is chosen, orderBefore concluding the agreement on the public procurement contract, the contractor is required to cooperate with these contractors if it has not been submitted together with the offer. 4) In the case of contractors jointly applying for the award of a contract, each of the conditions for participation in the procedure set out in point 7.2. at least one of these contractors or all of these Contractors must meet at least one. None of the contractorsjointly applying for the order may not be subject to exclusion from the proceedings. 5) None of the contractors appearing jointly can be subject to exclusion. The Employer will assess the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion from the procedure according to the formula does not meet. In the event that the values specified in the documents submitted for confirmationIf the conditions for participation in the proceedings are met, they will be expressed in foreign currencies, to be assessed in PLN (PLN) according to the average NBP exchange rate for a given currency to PLN on the day of placing the order in the Supplement to the Official Journal of the EU. On 25.5.2018, the Regulation of the European Parliament and of the Council (2016/78) of 27 will enter into force.4.2016 on the protection of natural persons in relation to the processing of personal data and on the free flow of such data and repeal of Directive 95/46 / EC.
