The contracting authority will respond clearly and fully to all clarification requests / additional information on the 10th day before the deadline for submitting bids. Estimated quantities for the framework agreement:

- Minimum quantity (gasoline) = 98, 820 liters,

- Maximum quantity (gasoline) = 197, 640 liters,

- Minimum quantity (diesel) = 216, 600 liters,

- Maximum quantity(gasoline) = 433 200 liters.

Estimated quantities for the largest subsequent contract:

- Minimum quantity (gasoline) = 8 235 liters,

- Maximum quantity (gasoline) = 98 820 liters, 050 liter,

- Maximum quantity (diesel) = 216 600 liters

The value of the largest subsequent contract is 1 590 352, 94 RON without VAT.a no. 1

The bidders must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE umay be submitted, at the request of the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

These documents may be: - - Certificate of absence of debts in respect of taxes, contributions or contributions to the consolidated general budget (local budget, state budget, etc.) at the time- The criminal record of the economic operator and the members of the management, management or supervisory body of the respective economic operator, or of those who have the power to represent, decide or control it, as it results from the certifying certificate issued by the ONRC / constitutive act,

- According to the case, documents proving that the workthe economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement,

- Other editorial documents, as appropriate.

Note no. 1

By the deadline set for the submission of tenders, the participating economic operators will present the DUAE (Unique European Procurement Document) attached to the full tender documentation• Prior to the award of the public procurement framework agreement, the contracting authority will ask the tenderer ranked first after application of the award criterion to submit the supporting documents confirming it meeting all the qualification criteria, in compliancewith the requirements established by the DUAE and the awarding documentation. 2

The bidder must not fall within the situations provided by art. 60 lit. d) and e) of the Law no. 98 / 2016.

A Declaration will be submitted under your own responsibility regarding non-compliance with the provisions of art. 60 lit. d) and e) of the Law no. 98 / 2016. The DUAE will be completed. 2

By way of exception to the provisions of Note no.1, by the deadline set for the submission of tenders, together with the DUAE, the participating economic operators will also present the declaration on non-compliance with the provisions of art. 60 lit. d) and e) of the Law no. 98/2016. In this respect, the bidder must not be in conflict with the following decision-makers within the contracting authority and the service providerand - auxiliary to the acquisition, involved in organizing, carrying out and finalizing the award procedure:

Operathe economic agents can complete the DUAE by using the editable form attached to this documentation.

I) When two or more admissible offers have equal prices, in order to divide them, the contracting authority will ask the respective tenderers to recharge the price by loading in S.I.C.A.P. of new files / documents. Requests for clarification of potential bidders sthey will address exclusively in S.I.C.A.P. to the "Questions" section of the award procedure conducted by electronic means. The answers to the clarification requests will be posted within the "Documentation, clarification and decision" section of the tender notice published on the website www.e-licitatie .com. The contracting authority will not respond to the requests addressed by alta way of communication. The evaluation committee will submit requests for clarification of the submitted offers, in S.I.C.A.P. at the "Questions" section. The economic operators will send the answers to the clarifications and any documents requested during the evaluation of the offers through the S.I.C.A.P. ("Questions" section), fully in the section corresponding to the respective applicantin the form of one or more separate signed / signed electronic documents / files. In the case of foreign legal persons, equivalent documents issued in accordance with the legislation of the country of residence of the economic operator, together with their translation into Romanian, shall be required. Under the legal basis referred to in Art. 123 par.
