The way the bidder fulfills the requirement: as a preliminary proof to demonstrate that the minimum qualification requirement is met, the economic operators participating in the procedure (individual bidder, member of an association, subcontractor, third party supporter) will complete DUAE with information related to their situation. After applying the award criterion, following the request of the contracting entity, the tenderer whose bid is ranked first in the intermediate rankings drawn up at the completion of the tender evaluation will have to demonstrate the absence of the exclusion situations in the procedure by submitting to himself and to the third party, subcontractorst, associated (where applicable) the supporting documents of the information included in the DUAE. Such documents may be, but are not limited to: (a) Finding certificates for the absence of overdue debts, taxes or contributions to the consolidated general budget at the time of presentation; (b) The judicial record of the economic operator and to each member of theadministration or management or supervision of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, (c) as the case may be, documents which demonstrates that the economic operator may benefit from the derogations provided in art. 179 par. 1) This procurement procedure is organized by the contracting entity Engie Romania SA, in its own name, as well as inand for Distrigaz Sud Networks S.R.L., for Engie Services S.R.L. and for Engie Building Solutions S.R.L., based on mandates / mandates in this respect. All listed companies are part of the Engie Romania Group;

2) By submitting a tender, the tenderer accepts in advance the general and particular conditions governing this procedureaward procedure as the sole basis for this procedure, regardless of the tenderer's own sales conditions.
