Economic operators participating in the procedure (individual bidder, member of an association, subcontractor, third party supporter) should not be found in the situations provided by art. 177, 178, 180 of Law no. 99/2016.

The way the bidder fulfills the requirement: as a preliminary proof to demonstrate that the minimum qualification requirement is met, the economic operators participating in the procedure (individual bidder, member of an association, subcontractor, third party supporter) will complete DUAE with information related to their situation. After applying the award criterion, following the request of the contracting entity, the tenderer whose bid is ranked first in the intermediate rankings drawn up at the completion of the tender evaluation will have to demonstrate the absence of the exclusion situations in the procedure by submitting to himself and to the third party, subcontractorst, associated (where applicable) the supporting documents of the information included in the DUAE. Such documents may be, but are not limited to: (a) Finding certificates for the absence of overdue debts, taxes or contributions to the consolidated general budget at the time of presentation; (b) The judicial record of the economic operator and to each member of theadministration or management or supervision of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, (c) as the case may be, documents which demonstrates that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. 99/2016 regarding the sector acquisitions, (d) other editorial documents, as the case may be.

If for any reason the required supporting documents are not in the Romanian language, the economic operators must submit, following the express request of the contracting entity, the translated version of the respective documents in the Romanian language. 2-operatoeconomic participants participating in the procedure (individual bidder, member of an association, subcontractor, third party supporter) should not find themselves in the situations provided by art. 72 73 of the Law no. 99/2016 regarding the conflict of interest.

The way the bidders meet the requirement: To demonstrate that the minimum qualification requirement has been met, the participants in the award procedure(individual bidder, member of an association, subcontractor, third party supporter) will complete the DUAE with the information related to their situation and will present together with the DUAE a declaration on their own responsibility regarding the non-compliance with the situations provided in art. 72 73 of the Law no. 99/2016 on conflict of interest.

1) This procurement procedure is organized by the contracting entity Engie Romania SA, in its own name, as well as inand for Distrigaz Sud Networks S.R.L., for Engie Services S.R.L. and for Engie Building Solutions S.R.L., based on mandates / mandates in this respect. All listed companies are part of the Engie Romania Group;

2) By submitting a tender, the tenderer accepts in advance the general and particular conditions governing this procedureaward procedure as the sole basis for this procedure, regardless of the tenderer's own sales conditions. The bidders have the obligation to carefully analyze the awarding documentation and to prepare the tender according to all instructions, forms, contractual provisions and technical specifications contained in this documentation. There will be no expression of any kindand reservations in the tender regarding the awarding documentation. No costs incurred by the economic operator for the preparation and submission of the tender may be charged to the contracting entity.
