Supply of Euro 5-SR EN 590/2010 diesel fuel and lead-free Premium petrol based on secured power cardsPIN code (minimum 35 000 liters maximum 103 000 liters of diesel fuel, minimum 3 000 liters maximum 9 000 liters of gasoline) within 30 (thirty) months for passenger cars fitted to the General Directorate Intermediate Body for Transport, by frame-agreement, in the budget approved under the Financing Agreement no. 2.1.061 / 07.06.2018. Tendered products will have to comply with the required requirements∎ The Main Terms of Service: Ministry of Transport, Dinicu Golescu Boulevard no. 38, sector 1, Bucharest.

In order to carry out in good conditions the specific activities, the Ministry of Transport intends to purchase automotive fuels (gasoline and diesel) based on PIN secured security cards.The aim is to designate the economic operator who will provide motor fuels (diesel and gasoline) for a period of 30 months. The estimated quantity of products to be supplied during the entire frame agreement is minimum 35, 000 liters maximum 103, 000 liters of diesel, minimum 3, 000 liters maximum 9, 000 liters of gasoline

- Bidders (economic operator or members of the association of economic operatorsi), the supporting third parties and the subcontractors (if any) shall not be present in the situations referred to in art. 164 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented,

- The bidders (economic operator or members of the association of economic operators), the supporting third parties and the subcontractors (if any) should not be present in the pre-seen at art. 165 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented,

- The tenderers (economic operator or members of the association of economic operators), the supporting third parties and the subcontractors (if any) must not find themselves in the situations provided by art. 167 of the Law no. 98/2016 on public procurement with subsequent amendments and completions- The bidders (economic operator or members of the association of economic operators), the supporting third parties and the subcontractors (if any) must not be present in the situations provided by art. 59 60 of the Law no. 98/2016 on public procurement, with subsequent amendments and completions, they will fill out a declaration (Form 3), which will be filed with the DUAE.which demonstrates the fulfillment of the requirements: the economic operators participating in the award procedure will be filled in by the economic operators participating in the award procedure.

Prior to the award of the framework agreement, the contracting authority will ask the tenderer ranked first after applying the award criterion admissible to submit supporting documents ato demonstrate the fulfillment of all the qualification and selection criteria, according to the information contained in the DUAE (art. 196 par. (2) of the Law no. 98/2016 on public procurement, as amended and supplemented]. These documents may be:

- tax certificates regarding the absence of overdue debts in respect of the payment of taxes, taxes or concessions(local budget, state budget, etc.) at the moment of presentation, - the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC / constitutive document, - documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, as subsequently amended and supplemented, - other editing documents, as the case may be.

For non-resident tenderers, according to the provisions of art. 168 par. (3) ofLaw 98/2016 on public procurement, as subsequently amended and supplemented, if in the country of origin or in the country in which the tenderer / candidate is established, no documents of the kind provided in paragraph (1) or the respective documents do not cover all the situations provided in art. 164, 165 and 167, a statement is accepted on your own responsibility or, if in the country of respectthere are no legal provisions regarding the declaration on own responsibility, a genuine statement made before a notary, an administrative or judicial authority, or a professional association with competence in this respect.

In order to ensure that economic operators have the economic capacity and bethe contracting authority requires the tenderers to provide proof of annual turnover for the last 3 (three) years, 2016, 2017, 2018 respectively, at least equal to the amount of 504 000 RON, representing the value of the most large succession contract. For calculation of turnover expressed in currency other than RON, the m rate will be appliedannual edition communicated by the NBR.

The communication on the outcome of the procedure will be sent to S.E.P. Where two or more economic operators whose offers have been declared legally, technically and economically-financially admissibleby the contracting authority, offered the lowest equal prices, the contracting authority will require only those operators submitting new price offers on the SEAP in the "Clarifications" section. The economic operators have the right to improve the previously offered price, contains the new lowest price to be declared winner
