Determination of the item and size or range of orders:

Main Site: IRZiBŻ PAN in Olsztyn, 10-748 Olsztyn, ul. Tuwima 10 and other locations according to Annex No. 3 to the ToR- model agreement - 3 para. 4

1. The supply of specialized materials and accessories to continue scientific and research work for the needs of the IRZiBŻ PAN in Olsztyn. The order was divided into 7 parts:

Part 1: Accessories and consumables according to the TPP catalog

The detailed description of the subject of the order contains an offer form for a given part. The Contractor may submit one offer for more than one Part.

2.General terms and conditions of delivery of the order:

1.1. The contractor, together with the supply of materials and accessories for testing, attaches safety data sheets and / or quality specifications containing basic data as well as physical and chemical requirements. Conditions for warranty service:

The warranty period for materials and accessories may not be shorter than 12 months. Checking and confirming procedurethe accuracy of the order delivered and the manner of reporting complaints in accordance with the provisions in Annex 3 to the Terms of Reference - template contract.

4. The contract with the Contractor will be concluded for a period of 15 months from the date of signing the contract. The deadline for delivery of the subject of the order from submitting the partial order by the Ordering Party, in accordance with the date offered by the Contractor on the offer. The delivery date is one of the criteria foroffer price.

5. Due to ensuring repeatability of results in conducted scientific research, the Ordering Party in the description of the subject of the order, indicated in addition to the description, also the manufacturer and catalog numbers. Indication of the manufacturer, catalog numbers does not indicate directly to the Contractor of delivery. The offer may be submitted by any Contractor interested in obtaining and processing the order.

6. Ordering party, fromaccording to art. 29 para. 3 of the Act on Public Procurement Law, allows the possibility of equivalent offers with parameters and properties not worse than those specified by the Employer. In the above case, the Contractor is obliged to submit to the ordering party's request: safety data sheets and / or quality specifications, quality or other equivalent certificates, and deliverysamples. A detailed description of the assessment of equivalence is contained in Chapter III of the ToR.

1. The contractor is obliged to submit in electronic form, on the day of submitting bids, a statement made on the form of a single European order document (EED), drawn up in accordance with the standard form provided in the Commission Implementing Regulation, including in detailinformation:

1) about the fact that the Contractor meets the conditions for participation in the proceedings specified by the awarding entity in Chapter V of the Terms of Reference. The Ordering Party informs that in Part IV, EED permits the possibility of completing this document only in the section α (alpha) "general statement" and therefore the Contractor does not have to fill in any of the other sections in Part IV EAT,

2) about the fact that the Contractor does not subjectexclusion from the reasons indicated in art. 24 sec. 1 item 13-22 and para. 5 point 8 of the Act on Public Procurement,

3) about other entities for the resources referred to in order to demonstrate fulfillment of the conditions of participation in the proceedings,

4) parts of the orders that the Contractor intends to entrust to subcontractors,

5) about subcontractors, on the resources of which the contractor does not rely if it is already known to the contractors for which subcontractshe wants to entrust the execution of part of the order.

Instructions for filling in and submitting the electronic version of the EAT declaration are contained in the ToR.

2. The Awarding Entity will evaluate the offers and fulfill the conditions for participation in the proceedings under Art. 24aa of the Public Procurement Law.

3. In the event of a joint application by the Contractors, a single document shall be submitted by each of the contractors jointly applyingI am about to order. The document confirms fulfillment of the conditions of participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

4. In the case where the Contractor relies on the capacities of another entity on the terms set out in Article 22a of the Public Procurement Law, the Contractor submits the undertaking of this entity-to hand over to the Contractor the necessary resources for the needs of the order.

5. Contractor within 3 days from the date of posting on the website information referred to in art. 86 par. 5 of the Public Procurement Law, will provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. With submission-statements, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure. This declaration is made in the form of an original. In the case of joint application by Contractors (also Contractors of civil partners), each Contractor submits a declaration.

6. For orderingand Contractors may apply, who are not subject to exclusion from the proceedings due to one of the circumstances indicated in art. 24 sec. 1 uPzp, which occurred in the appropriate period specified in art. 24 sec. 7 uPpp.

7. Contractors who are not subject to exclusion from the proceedings due to one of the circumstances indicated in art. 24 sec. 5 pt 8 uPzp, and the nominationsie: 1) who has violated obligations relating to payment of taxes, fees or social security or health insurance premiums, which the orderer is able to demonstrate by means of appropriate evidence, except in the case referred to in art. 24 sec. 1 point 15 of the PPL, unless the contractor has made payment of taxes due, fees or social security or health insurance contributions with interestfines or have a binding agreement on the repayment of these debts.

8. Criteria for ordering:

a) Price-Weight: 60

b) Delivery date of partial order-Weight: 40

9. The ordering party calls the contractor whose tender has been the highest rated before submitting the order, to submit it within the deadline set, not shorter than 10 days, current as of the date of submission of the following statements or documents (the following documents should not be submitted with the offer):

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids,

2) a certificate from the competent head of the tax office confirming that inthe contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the prescribed rightsem waiving, postponing or spreading overdue payments into installments or suspending the implementation of the decision of the competent authority in full;

3) certification of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance premiums, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the procedure, or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of these receivables with possible interest or fines, in particular obtained the legally required exemption, postponing or spreading installments into installmentspayments or suspension in full of the implementation of the decision of the competent authority;

4) the contractor's statement on the lack of issuing a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or - in the event of such a decision or decision - documents confirming the paymentreceivables with possible interest or fines or a binding agreement regarding the repayment of such receivables;

5) the contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2016, item 716);

6) the contractor's statement about the lack of a ruling against him as a preventive measurea ban on applying for public orders.

In the case of applying for contractors by the Contractors of the civil company, the information and the certificate from items 1-3 should be submitted separately for each civil partner and the company itself. In the case of applying for orders by the contractors, the civil partners of the statement under points 4-6 shall submit each cocivilian donut separately.

In case of joint application by the Contractors (consortium), information and certificate from items 1-6 is submitted by each of the Contractors jointly applying for the order.

10. The Contractor is not obliged to submit declarations or documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion from the proceedings if the Employerhas statements or documents related to this contractor or may obtain them through free and publicly available databases, in particular public registers within the meaning of the Act of 17.2.2005 on computerization of entities operating public tasks (Journal of Laws from 2014). item 1114 and as of 2016 item 352). If the Purchaser has valid statements or documentsregarding this Contractor. In this case, the Employer may call the Contractor to confirm the validity of the statements and documents held by the Employer.

11. The Ordering Party does not require the Contractor, who intends to entrust the execution of a part of the order to subcontractors, showed that there are no grounds for exclusion from participation in the proceedings.

12. Contractor from outside the territory of the Republic of PolandItej Polska.

1) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in point 8, submit:

a) regarding point 1) information from the relevant register, or in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of destinationthe person concerned or the document to the extent specified in art. 24 sec. 1 items 13, 14, and 21 of the Public Procurement Law.

b) regarding item 2) and 3) a document or documents issued in the country in which the Contractor has his registered office or place of residence, confirming that he is not in arrears with paying taxes, fees, social security or health insurance contributions or that he / shean agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension of the execution of the decision of the competent authority in full.

2) Documents referred to in point a) should be issued not earlier than 6 months before the submission deadlinebids, while the documents referred to in point b) should be issued no earlier than 3 months before the submission of bids.

3) If in the country in which the Contractor has his seat or place of residence has the person concerned, no documents are issued, referred to in point 1), they are replaced by a document containing a statement from the Contractor, with an indication of the person or persons authorized to represent it, or a statement of the person whose document was to be submitted, submitted to a notary or before a judicial, administrative or self-regulatory or economic self-governing authority with regard to the place of residence or place of residence of the person. Point 2) applies accordingly.

13. Contractor havingy established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in point 8 item 1), submits the document referred to in point 11 item 1a) to the extent specified in art. 24 sec. 1 points 14 and 21, issued not earlier than 6 months before the submission of offers. If in the country where it is locatedthe person to whom the document was to relate does not appear to be such, it is replaced by a document containing a statement made by the person before a notary or before a judicial, administrative or professional self-regulatory or economic self-regulatory body.

14. In the case where the Contractor whose offer has been evaluated oni above, relies on the resources of other entities on the principles set out in art. 22a of the Public Procurement Law, the Employer requests submission of documents referred to in point 8 concerning these entities.
