Reference Number: WZP-421-16 / 2019

1.1. The subject of the Basic Order are insurance services for Units subordinate to or supervised by the Minister of Justice: common courts, organizational units of the prosecutor`s office, juvenile detention centers and juvenile shelters, probation centers, CZDSIGB, during the period of 36 months from 1 April 2020 to 31 March2023, with the proviso that the insurance period for individual Units will start in accordance with Annex 9 to the ToR, in the following scope:

Task (Part) I Property insurance in the scope of:

a) property insurance against all risks,

b) insurance of electronic equipment against all risks;

the Purchaser recognizes the condition of having the authorization to operate a specificprofessional activity satisfied, if the Contractor demonstrates that he is entitled to perform insurance activity specified in the provisions of the Act of 11 September 2015 on insurance and reinsurance activity (consolidated text from 2019, item 381, as amended), called hereinafter the "Act on insurance and reinsurance"; it is required that the Contractor whosubmits an offer for a given Task (Part), was entitled to one or more classes of insurance in relation to this part, i.e.: - for Task (Part) I - at least in insurance group 8 and 9 of Section II of the Annex to the Act on insurance and reinsurance activities,

- for Task (Part) II at least in the insurance group 13 Section II of the Annex to the Act on

Note: In the case of submitting an offer by Contractors jointly applying for the award of the contract, each of the Contractors acting jointly must independently fulfill the condition of having the right to conduct specific professional activity.

1. In order to assess the fulfillment of the conditions of participation by proceedings and no groundsto be excluded, the Employer requires that the Contractor together with the offer valid as of the day of submitting bids, a preliminary statement in the form of a standard single European order document (hereinafter referred to as "EAT")

2. In order to demonstrate compliance with the conditions for participation in the procedure, the Contractor shall submit:

- regarding the rights to conduct specific professional activities referred to in the ChapterVII points 1 point 1.2 point 1.2.1 of the Terms of Reference, for Task (Part) I - permission of the competent authority to carry out insurance activity at least

in insurance group 8 and 9 of Section II of the Annex to the Act on insurance and reinsurance activity;

- regarding entitlements to conduct specific professional activity, about referred to in Chapter VII point 1 point 1.2 point 1.2.2 Terms of Reference, forTasks (Parts) II - permission of the competent authority to carry out insurance activity at least

In the insurance group 13 Section II of the Annex to the Act on insurance and reinsurance activities; confirming that he can carry out insurance activities and has the authorization to carry out insurance activities related to the subject of the Order;

the Employer does not specifythe condition of participation in the proceedings.

1.Ordering - the Court of Appeal in Krakow, represented by CZDSIGB, acts on its own behalf and on behalf of common courts on the basis of the authorization of the Minister of Justice made by the Order of 28 March 2017. on the organization of purchases of supplies and services in common courts and the indication of the contracting authority (Official Journal of the Ministry of Justice. 2017r., item 122 later changes) and for common organizational units of the prosecutor`s office, correctional facilities, juvenile shelters, probation centers based on the authorization of the Minister of Justice made by the Ordinance of 4 July 2019 on the appointment of the contracting authority to conduct proceedings and award public contracts for insurance services powszechne organizational units of the prosecutor`s office, juvenile detention centers and juvenile shelters, probation centers and regional courts (Official Journal of the Ministry of Justice of 2019, item 151):

2. Communication between the Employer and Contractors, in particular the submission of bids and statements, including the initial statement on the JEDZ form, takes place using an electronic system at: https: // ezamowienia.ms.gov.pl

3. Grounds for excluding the contractor: art. 24 paragraph 1 and paragraph 5 points 1 and 8 of the Public Procurement Law

4. In order to confirm the lack of grounds for exclusion from the procedure, the Awarding Entity requests the following documents indicated in the Regulation of the Minister of Development on the types of documents which the awarding entity may request from contractors in the procurement procedure (Journal of Laws 27.7.2016poz.1126) indicated

5. The Contractor, who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion for them, also submits the EAT to those entities as well as documents or statements aboutreferred to in point 4 point 4.1. - point 4.7.

6. The offer is the completed Offer Form - Annex 1 to the ToR and the completed Form - Cost calculation, settlement periods - Annex 9 to the ToR. Documents submitted with the offer are indicated in Chapter X point 8.2 of the ToR.

7. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of documents, referred to in point 4

7.1. item 4.1 - submits documents in accordance with par. 7 clause 1 point 1 of the Regulation

7.2. item 4.2 - 4.3 - submits documents in accordance with par. 7 clause 1 point 2 a) of the Regulation

7.3. item 4.4 - submits documents in accordance with par. 7 clause 1 point 2 b) of the Regulation

8. If in the country in which the Contractor has its registered office or place of residence or domicile, there is a person whose documentrefers to, do not seem documents referred to in paragraph 7 paragraph 1 of the Regulation, they shall be replaced by a document containing, respectively, a statement by the Contractor, with an indication of the person or persons authorized to represent him, or a statement of the person whom the document was to concern, submitted to a notary or body judicial, administrative or a body of professional or economic self-governmentappropriate for the seat or place of residence of the Contractor or the place of residence of that person.

9. The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in paragraph 5 point 1 of the Regulation applies, submits the document referred to in paragraph 7 paragraph 1 point 1 of the Regulation, to the extent specified in art. 24 paragraph 1 point 14 and 21 of the Public Procurement Law

10. The PPL Act should be understood as the Act of 29 January 2004 Public Procurement Law (Journal of Laws of 2019, item 1843).
