Short description of the contract or contractZiti / acquisitions. Free admission for preschoolers in kindergartens with progr. normally 4 hours of authorized / accredited state and private accredited and also for students from primary and secondary state and private UHT-yoghurt milk, by prod. of bakery: alternative horn with dry biscuits and apples and / or pears, in lim. a daily / preschool / student value. Lim. daily cup valuerenders the full purchase price of the products, including VAT, expenses. transport, distribution and storage, as appropriate. Note: the framework agreement will include 3 subsequent contracts per year for each type of products (bakery, dairy and vegetables / fruits) over the entire 22-month framework agreement (2 school years 2020-2021 and 2021-2022). Main Site: State and private educational units authorized / accredited by the Ministry of National Education in the municipality and county of Tulcea (according to the delivery schedules attached to the specification) .

Granting gratuit for preschoolers in kindergartens with a normal 4-hour authorized / accredited and private accredited state program and for students in primary and secondary state education and in particular of bakery products: alternative horn with dry biscuits, within a daily / preschool / student. The daily value limit includes the full purchase price of the products, including the tax pis the added value, their transport, distribution and storage costs, as the case may be.

Note: the framework agreement will include 3 subsequent contracts per year for lot 3 and for the entire period of the 22-month framework agreement (2 school years 2020) -2021 and 2021-2022). The estimated timetable does not constitute a firm commitment from the contracting authority.

Lot 3 bakery productsernative with dry biscuits

Estimates of the minimum and maximum quantities that could be requested during the entire framework agreement; minimum quantities = 397 360 pieces and maximum quantities = 7 827 992 pieces.

Framework agreement: minimum value: 206 627.20 RON, excluding VAT; maximum value: RON 4 070 554.84, excluding VAT

Estimates of the minimum and maximum quantities that could be the subject of a single contractnone of the following to be awarded during the framework agreement: minimum quantities: 198 680 pieces and maximum quantities: 3 298 088 pieces.

The value of the largest subsequent contract: RON 1 715 005.76, excluding VAT. no. 1 must be fulfilled for LOT 1, LOT 2 and LOT 3:

Bidders / Supporting third parties / Subcontractors participating in the procedure must not be found iin the situations provided in art. 164, art. 165 and art. 167 of Law no. 98/2016, as subsequently amended and supplemented.

Information and formalities necessary for assessing compliance with the requirements:

1. Failure to comply with the provisions of art. 164 of Law no. 98/2016 regarding public procurement, with subsequent amendments and completions, will be completed DUAE,

2. Failure to comply with the provisions of art. 165 dinLaw no. 98/2016 regarding public procurement, with subsequent amendments and completions, will be completed DUAE,

3. Failure to comply with the provisions of art. 167 of Law no. 98/2016 regarding public procurement, with subsequent amendments and completions, will be completed DUAE,

4. Failure to comply with the provisions of art. 59 of Law no. 98/2016 on public procurement, with subsequent amendments and completionsthe DUAE will be completed.

Fitting in the situation provided in art. 59 of Law no. 98/2016, as subsequently amended and supplemented, entails the exclusion of the tenderer from the procedure for awarding the framework agreement. Form no.1 - Declaration according to art. 60 of Law no. 98/2016, with the subsequent amendments and completions, will be presented by all participants once the DUAE has been submitted. The method of fulfillment:

The DUAE will be completed by all economic operators paparticipants in the award procedure (bidders / associates / subcontractors / third party supporters) with the information that characterizes their capacity. At the request of the contracting authority only the bidders classified after the electronic auction stage on the first 3 places in the ranking drawn up at the end of the evaluation of the tenders will present the supporting documents proving the fulfillment of the assumed ones.is by completing the DUAE. These documents can be:

a) Certificates confirming the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of submission;

b) The criminal record of the respective economic operator or of those who have power of representation, decision or control within it, aas it results from the certifying certificate issued by the ONRC / the constitutive document, valid at the time of presentation;

c) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98/2016, with the subsequent modifications and completions;

d) other edifying documents, as the case may be.with the DUAE submission the following documents: the firm commitment of the supporting third party from which results the effective way in which it will materialize its support Form no. 2, Form no. 3 or Form no.11, of the subcontracting agreement / and or of the association agreement Form no. 4, as the case may be

Lots: 1, 2, 3. Specify the average annual turnover. The average global turnover of the bidder over the last 3 years, respectively 2016, 2017, 2018, which should be the oneslightly equal:

- with 710 281.00 RON for lot 1,

- with 1 605 334.40 RON for lot 2 and

- with 1 715 005.76 RON for lot 3.

a) Given that AC will sign the framework agreement only with op ec located on the first, second, third place, as the case may be, the way of dividing the offers with equal scores will be done as follows: 1. In case the commission finds that more than 2 eligible offers have been submitted / introduced in SICAPequal scores to the bidders ranked 1st, AC will request the submission of new improved financial proposals (by 2 decimal places), and op ec will send their response in SICAP, in which case the framework agreement will be assigned to the first 3 bidders who have the score larger.2. If the commission finds that more than 2 admissible offers with equal scores have been submitted by the biddersranked on the second place, the way of separating them will be done by requesting the submission in SICAP of new improved financial proposals (with 2 decimals), and op ec will send their answer, so that the bidder ranked on the first place is not affected, respectively the new financial proposal shall not be equal to or less than the offer ranked in the first place. If the new financial proposalimproved as a result of the request of the AC will influence the ranking of the higher places, this will not be taken into account, keeping the initial offer submitted in the SICAP to the procedure.3. In case the commission finds that more than 2 admissible offers have been submitted with equal scores by the bidders ranked on the third place, the way of dividing them will be done by requesting the submission in SICAP of a new improved financial proposal (by 2 decimal places), and op ec will transmit their response, so that the bidders ranked on the 1st and 2nd place will not be affected, respectively the new improved financial proposal presented as a result of the AC request will influence the ranking of places I and II, this will not be taken into account, keeping the initial offer submitted in SICAP to the procedurea. In case chas no 3 options with admissible offers the agreement - the framework will conclude with 2 options. In case there are no 2 opec with admissible offers, the framework agreement will be concluded with 1 economic operator. d) The economic operators ranked on the first, second and third place, which submit a common offer to the procedure, will present the legalized Association Agreement before the conclusion of the contract.

Without prejudice to the provisionsof the areas of Law no. 182/2002 regarding the protection of classified information, with subsequent amendments and completions, the economic operator will specify in the submitted offer those information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right insofar as, objectively, the disclosure of this informationit would harm the legitimate interests of the economic operator, especially with regard to trade secret and intellectual property.
