Framework agreement for the supply and distribution of apples, milk and dairy products and bakery products to students in educationState and private primary and secondary schools, as well as preschools in the state and private kindergartens with a normal 4-hour program in Iasi County, for the 2019-2022 school years, within the Program for Schools of Romania lot 3 zone III bakery products.

Framework agreement for the supply and distribution of apples, milk and dairy products and dairy productsbakery to students from primary and secondary state and private schools, as well as to preschools from state and private kindergartens with a normal 4-hour program in Iasi County, for the 2019-2022 school years, within the Program for Schools of Romania lot 3 area III produced of bakery.

The necessary products are presented in Annex no. (2) of the specification quantities (minime and maximum) of products of the subsequent contract, the quantities (minimum and maximum) of products of the framework agreement, as well as the values associated to it, the distribution of the quantities on the batch 3 bread products zone III related to the delivery locations and the type of products included in the contract, possibly in subsequent subsequent contracts.

During the week, a preschool / student is grantedFree 2 servings of apples, 2 servings of milk, one serving of dairy products and 5 servings of bakery products

For the sake of diversity, the serving of apples will be accompanied by a serving of biscuits and / or dry meats, and the serving of milk and dairy products will be accompanied by horn and / or baton.

The contracting authority establishes the following weekly supply and distribution scheme for the product.seals to the school institutions:

- every Monday, Tuesday and Thursday: each portion of the preschool / student is given a portion of milk or a portion of dairy products accompanied by a horn and / or a stick, given that on During the week, a preschooler / student is given free 2 servings of milk and a serving of dairy products,

- every Wednesday and Friday: every preschooler / pupila portion of apple fruit, accompanied by a portion of biscuits and / or dry muffins, is provided free of charge. 164, art. 165 and art. 167 of Law no. 98/2016, as subsequently amended and supplemented.

Information and formalities necessary to assess compliance with the requirementsor:

1) failure to comply with the provisions of art. 164 of Law no. 98/2016 regarding the public procurement, with the subsequent modifications and completions, the DUAE will be completed;

2) failure to comply with the provisions of art. 165 of Law no. 98/2016 regarding public procurement, with the subsequent modifications and completions, the DUAE will be completed;

3) failure to comply with the provisions of art. 167 of Law no. 98/2016 regarding the acquisitionspublic, with the subsequent modifications and completions the DUAE will be completed;

4) the non-compliance with the provisions of art. 59 of Law no. 98/2016 regarding the public procurement, with the subsequent modifications and completions, the DUAE will be completed.

Framing in the situation provided in art. 60 of Law no. 98/2016, as subsequently amended and supplemented, entails the exclusion of the tenderer from the award procedureof the framework agreement. (a) Given that the contracting authority will sign the framework agreement only with the economic operators located on the first, second, third place, as the case may be, the way of bidding with equal scores it will be done as follows:

1) If the commission finds that more than 2 admissible offers have been submitted / entered in SEAP with equal scores of the bidders ranked on the first place, athe contracting authority will request the submission of new improved financial proposals (by 2 decimal places), and the economic operators will send their response in SEAP, in which case the framework agreement will be assigned to the first 3 bidders who have the highest score;

2) If the commission finds that more than 2 admissible tenders were submitted with equal scores by the bidders ranked on the firstocul II, the way of separating them will be done by requesting the submission in SEAP of new improved financial proposals (by 2 decimal places), and the economic operators will send their answer, so that the bidder ranked in the first place is not affected, respectively the new proposal not to be equal to or lower than the offer ranked on the 1st place. If the new financial proposalimproved as a result of the request of the contracting authority will influence the ranking of the higher places, this will not be taken into account, keeping the initial offer submitted in the SEAP to the procedure;

3) If the commission finds that more than 2 admissible tenders have been submitted with equal scores by the bidders ranked on the third place, the way of dividing them will be made prin requesting the submission in SEAP of a new improved financial proposal (by 2 decimal places), and the economic operators will send their answer, so that the bidders ranked on the 1st and 2nd place are not affected, respectively the new improved financial proposal presented as a result of the request of the authority contracting will influence the ranking of places I and II, it will not be taken into accountsiderare, keeping the initial offer submitted in SEAP to the procedure. The deadlines / dates of submission of the new financial proposals will be communicated in the request sent by the contracting authority,

(b) In order to complete the DUAE, the ANAP notification regarding the use of the DUAE integrated in the SEAP is considered,

(c) The contracting authority will conclude a framework agreement with maximum 3 economic operatorswhose offers are admissible and which are in the first, second and third place. In case there are no 3 economic operators with admissible offers, the framework agreement will be concluded with 2 economic operators. In case there are no 2 economic operators with admissible offers, the framework agreement will be concluded with 1 economic operator,

(d) The bidders ranked on the first, second and third place who submit a common offer lthe procedure, will present the association agreement in the original before the conclusion of the contract,

(e) The awarding of the subsequent contracts will be done with the resumption of the competition, by sending an invitation to re-offer, to the promising suppliers-signatories of the framework agreement. Following the transmission of the invitation to re-bid, the promising suppliers will participate / will send the financial offer in an envelopeclosed according to the information contained in the invitation. The item that is the subject of the re-offer refers to the total price of each lot, related to the maximum quantities of products of the framework agreement and specified in the invitation to re-offer. The prices offered by the promising suppliers will not exceed the prices provided in the financial proposal that was the basis for the conclusion of the framework agreement.If following the re-offer 2 or more promising suppliers have offered the same lowest price, they will be asked for a new financial proposal in a sealed envelope.
