Framework agreement-with a maximum of 3 economic operators

The duration of the framework agreement: 18 months

The framework agreement will comprise 3 contracts per year, according to Order 19/37/2018. The timetable does not constitute a firm commitment on the part of the contracting authority regarding the expected dates for the application of the procedure, meaning that the proposed data is the intention of the contracting authority, starting from the hypothesis of lthat unexpected events / circumstances that could not be taken into account at the time of the initiation of the procedure, and the necessary financial resources will also be provided. Within each subsequent contract, bread products will be supplied and distributed only during actual school days.

Frame Agreement: Estimates of minimum and maximum quantities that could-be requested throughout the entire framework agreement. Minimum quantity: 16 461 795 pcs; maximum amount 16 912 735 pcs

Frame Rate: Minimum: 8, 560, 133 RON without VAT; maximum value: RON 8 794 622, 20 without VAT - Estimates of the minimum and maximum quantities that may be the subject of a single subsequent contract of the following to be awarded during the framework agreement: Quantities mhoney: 8, 174, 530; maximum quantities 8 512 735 pcs

Value of the largest subsequent contract RON 4 426 622, 20.

The bidders / third parties / the subcontractors participating in the procedure must not find themselves in the situations provided by art. 164, 165 and 167 of Law no. 98/2016, with further amendments and completions.

Information and formalities for evaluating if requirements are met:

1) Failure to comply with the provisions of art. 164 of Law no. 98/2016 regarding the public acquisitions, with the subsequent modifications and completions - will be filled in DUAE; 2) Non-compliance with the provisions of art. 165 of Law no. 98/2016 regarding the public acquisitions, with the subsequent modifications and completions - it will be completed with DUAE; 3) Non-compliance with the provisions of art. 167 of Law no. 98/2016 on the acquisitionwith the subsequent modifications and completions - will be filled in DUAE; 4) Non-compliance with the provisions of art. 59 of the Law no. 98/2016 regarding the public acquisitions, with the subsequent modifications and completions - it will be completed by the DUAE.

Incorporation in the situation stipulated in art. 60 of Law no. 98/2016, with the subsequent modifications and completions, leads to the exclusion of the bidder from the attribute procedureframework agreement. The declaration according to art. 60 of Law no. 98/2016, with subsequent amendments and completions, will be submitted by all participants with the submission of the DUAE.

Mode of accomplishment:

The DUAE will be filled by all economic operators participating in the award procedure (bidders / associate bidders / subcontractors / thirds supporters) with the information that characterizes their capacity. When you drivethe contracting authority uses the electronic auction will consider the request of the supporting documents as proof of the information contained in the DUAE, only to the bidders placed on the 3 places, as a result of the result obtained after the electronic auction was completed

These documents may be: Finding on the lack of debts regarding the payment of taxes, taxes(b) The judicial record of the respective economic operator or those having the power of representation, decision or control within it, as it results (c) where appropriate, documents demonstrating that the operatoreconomic benefits may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016, with subsequent modifications and completions, (d) other editorial documents, as appropriate.

The following documents will be deposited with the DUAE depositary: The firm commitment of the third supporter, resulting in the effective manner in which its support will materialize, the agreementsubcontracting / and / or association agreement, as the case may be. The average turnover for the last 3 years, respectively 2015, 2016 and 2017, must be at least equal to: Lot 1 - 4 426 622, 20 RON, Lot 2 - 1 927 296, 80 RON.

DUAE East documentis available in electronic form via the online service, made available free of charge by the European Commission, available at https://ec.europa.eu/growth/tools-databases/espd/filter. Considering that the contracting authority will sign the framework agreement only with the economic operators placed in the 1st, 2nd and 3rd place, as the case may be, the way of ranking the tenders with equal prices will be-do so:

1) If the commission finds that after the completion of the electronic auction more than 2 admissible tenders with equal prices were placed / introduced in the SEAP, the contracting authority will request the submission of new financial proposals improved (with 2 decimal places), and economic operators will send their answer in a closed envelope, in which case-the framework agreement will be awarded to the first 3 bidders who have the lowest price; 2) If the commission finds that following the completion of the electronic auction more than two admissible tenders with equal prices were submitted by the second rank bidders, the way they will be allocated will be by requesting enclosed envelopes with new improved financial proposals (with2 decimal places) and the economic operators will send their answer so that the first ranked bidder is not affected, ie the new financial proposal will not be equal to or lower than the ranked first place.

If the new financial proposal improved as a result of the request of the contracting authority will influence the rankings of the higher seats, it will not be taken-keeping in mind the initial offer submitted to SEAP in the procedure; 3) If the commission finds that following the completion of the electronic auction, more than two admissible tenders with equal prices were submitted by the third-ranked bidders, the module will be made by requesting the deposit in a closed envelope of a new improved financial proposal (by 2decimals), and the economic operators will send their answer, so that the bidders ranked first and second place will not be affected, respectively the new financial proposal will not be equal or lower than the ranked I and II respectively. If the new improved financial proposal submitted as a result of the request of the contracting authority will influence the rankings of Iand II, this will not be taken into account, keeping in mind the initial offer submitted to SEAP in the procedure. The deadlines / dates for the submission of the new financial proposals will be communicated in the request sent by the contracting authority.

Note: The assignment of the subsequent contracts will be done with the resumption of the competition, by the submission of an invitation to the reopening, to the promised suppliersof the framework agreement without prejudice to the provisions of Law no. 182/2002 on the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right to the extent thatobjectively, the disclosure of such information would prejudice the legitimate interests of the economic operator, in particular as regards commercial secrecy and intellectual property.
