Acquisition of credit granting services in the amount of 41 572 000 RON in order to finance some investment objectives:

1) Modernization of the streets in the Mir districtthe town of Călăraşi - lot 2;

2) The sewerage and sewerage network Magureni, Calarasi;

3) Modernization of the streets of Magureni neighborhood; 4) Landscape planning and modernization Nicolae Titulescu Boulevard, between Cornişa Street and Locomotive Street;

5) Rehabilitation and modernization Str. Grivita, Calarasi municipality, Calarasi county

6) Pluvial sewerage network Str. locomotion

The number of days until which clarifications can be requested before the deadline for submitting bids is 20 days and the deadline by which the Contracting Authority will respond clearly and fully to all clarification requests is 11 days ahead of the deadline set for the submission of tenders in the tender notice. Bidders, third parties and subcontractorstanks should not be found in the situations provided by art. 164, 165 and 167 of Law no. 98 / 2016.

The contracting authority will exclude from this award procedure the tenderer who falls within the provisions of art. 164, 165 and 167 of Law 98 / 2016.

Methods of fulfillment and applicability in the procedure:

Economic operators participating in the procedure (tenderer, associate, third partysupporting and subcontractor) will complete and present the DUAE with the information related to their situation

The supporting documents / proof that the fulfillment of the qualification and selection criteria as declared and assumed in the DUAE will be mandatory submitted by the bidder ranked I after the application of the award criterion, at the request of the contracting authorityjustifying evidence / supporting evidence for the fulfillment of the assumed obligations by completing the DUAE:

(a) The tax attestation certificate (debts to the general consolidated budget) and the Local Taxes (local budget debts) or equivalent documents from which the tenderer / third party / subcontractor has no overdue debts at the time of their submission,

(b) Documentswhich demonstrates that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement, (c) the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator or those having the power to represent them(d) other editing documents, as appropriate.

If in the country of origin or in the country where it is located established tenderer / third party / subcontractor does not issue documents of the nature mentioned above or the documents do not cover all situations prevazute at art. 164, 165 and 167, the contracting authority has the obligation to accept a declaration on its own responsibility or, if in that country there are no legal provisions on the declaration on its own responsibility, a genuine declaration given to a notary, an administrative or judicial authority or a professional association with competence in this respect; operatorsthe economic participants in the procedure (leader, associate, third party and subcontractors) should not be in a situation of conflict of interest, as provided by art. 59 60 of the Law no. 98 / 2016.

The way of doing the procedure:

The economic operators participating in the procedure (leader, associate, supporting third parties and subcontractors) will present together with the formthe DUAE and the declaration of non-compliance with the situations stipulated in art. 60 of Law 98 / 2016.

The persons holding decision-making positions within the contracting authority are the following:

Information on the Association: any economic operator has the right to participate in the awarding procedure as a tenderer, individually or jointly with other operatorsincluding in forms of temporary association established for the purpose of participating in the award procedure, proposed subcontractor or third party, under the conditions provided by Law no. 98/2016. The offer submitted by an association of economic operators must meet the following requirements:

(a) be signed by each legal representative of each of the associated economic operatorsi, (b) include an Association Agreement of the economic operators who have joined in order to submit the joint tender. The association agreement will be legalized prior to the signing of the contract, if the joint tender is declared winning, (c) the structure of the association will not be altered during the entire duration of the contract except with the prior approval of the contracting authority.supporting third parties: the economic and financial capacity of the bidder can be sustained for the fulfillment of the contract by one or more third parties, under the conditions provided by art. 182 of Law 98/2016. If the tenderer demonstrates his economic and financial situation by invoking the support of a third / third party, then he has the obligation to prove to the contracting authoritythat it has taken all necessary measures to gain access to the necessary resources at any time by presenting a commitment from the third party / third parties. By firm commitment, the third party / third party confirms that they will / will support the bidder in order to fulfill the contractual obligations, either by specifying the way in which they / they will concretely intervene to carry out the respective performanceor the financial resources it will make available to the bidder (describing how it will do it). If the economic operator encounters difficulties during the executionthe Purchaser shall have the right to pursue any claim for damages that the economic operator may have against the third party (s) for non-compliance with the obligations assumed by the firm commitment of support. In this respect, the economic operator assigns, as collateral, to the Purchaser, any right to indemnity against the third party / third partyustinator (s) for non-observance of the obligations assumed by the firm commitment of support (art. 50 par. (2) of GD 395/2016]. The economic operator and the third party / third party / supporter will be jointly and severally liable for the performance of the contract. The joint and several liability of the third party / supporter / supporter will be committed under the condition that he / she fails to fulfill his / her obligations

The interaction with the bidders and the evaluation process of the bids will be carried out according to the following rules:

The offer and the documents that accompany it will be signed with the electronic signature, otherwise the provisions of art. 137 par. (2) lit. j) of GD 395 / 2016.

Communication and data transmission rules: requests for clarification and responseit will be addressed exclusively in the SEAP.

Note:

1) The way of awarding the bids ranked first after applying the award criteria :

If equal opportunities are found in the first place, the cothe trader will ask for re-submission, online in SEAP, in order to divide the bids. The new financial proposal will be submitted only after the request of the contracting authority; 2) If the tender is submitted by a group of economic operators, the tender must include an association agreement. In the case of the winning bid, before the conclusion of the purchase contract puthe contracting authority will require the future contractor to legalize the association agreement; 3) In the case of an appeal, the contestant has the obligation to observe the provisions of Law 101 / 2016.
