The object of the procedure is the acquisition of the design and conversion / refunctional services.existing shipyard unfinished for the project "Space development recreational services on the Sfantu Gheorghe Canal / Plants". For this purpose, intervention works are proposed on an existing ship, unfinished, belonging to the City Hall of Giurgiu Municipality, currently in conservation in the yard of the Naval Shipyard ATG Giurgiu and its transformation into a floating construction, uspropelled for recreational services (mainly themed exhibitions / museums, conference / meeting / training rooms, etc.) and mooring (pontoon for recreational ship).

Currently, Giurgiu municipality owns the tangible fixed assets in execution, registered in the inventory of tangible fixed assets and the name of "river ship ofcommand, project 2916 "unfinished.

The ship being executed was taken over without payment from the Ministry of Internal Affairs General Inspectorate of Border Police based on HCL no. 6556 of 17.2.2015. At the time of the elaboration of the award documentation, the ship is docked in the SC Shipyard ATG shipyard.Giurgiu.

By the contract of design and conversion / refunctionalization services, it is desired to transform this unfinished ship, into an unpowered floating construction adapted for recreational services (themed exhibition / museum halls, conference rooms, meetings, trainings, etc.). ) and berth: (pontoon for the passenger ship), according to the technical requirements of the European Committee onFor the elaboration of the standards in the field of inland navigation (CESNI) and the ANR requirements in force, to be registered in Romania. related to the exploitation of the tourism potential of the FLAG Giurgiu territory fishing traditionDanube, bounded on the whole southern side by a length of approx. 55 km from the Danube river: lack of spaces and facilities for recreational services in the Danube.

1) The bidders / third party supporters / subcontractors must not be found in the situations provided in art. 164, 165, 167 of Law 98/2016, with subsequent amendments and completions.

Method of demonstrating the fulfillment of the requirement: offerantii (including associates / subcontractors / third party supporters) have the obligation to complete and initial presentation of DUAE, as the first proof of non-inclusion in the situations of exclusion and of meeting the capacity requirements. proof of non-inclusion in the situations of exclusion, by presenting it, upon requestbad CA, of the following information and supporting documents:

- as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 with the completions and modifications ulthird parties regarding public procurement,

- other supporting documents, as the case may be.

Framing in the situation provided in art. 164, 165, 167 of Law no. 98/2016 with the subsequent completions and modifications regarding acquisitionsthe public, attract the exclusion of the tenderer from the procedure applied for the award of the public procurement contract.

Note:

(a) Non-resident economic operators (foreigners) have the right to present any edifying documents issued by the authorities of the country of origin (certificates, judicial filings, other supporting documents) to prove membership / registration with the organs of the countryand to prove the fulfillment of the obligations of payment of taxes, taxes and contributions to the budget of the respective state. Specify the average annual turnover. The minimum level of the average turnover for the last three years (2016, 2017, 2018) should be at least equal to the sum of: 5 800 000 RON. The reference course that will be considered for calculating equivalence for contracts whose valueis expressed in another currency than lei is the average annual exchange rate of lei / currency communicated by the NBR for each year separately. In order to fulfill this requirement, the bidder can benefit from the firm commitment by another person according to art. 182 of Law no. 98/2016 and of art. 48 of the GD no. 395/2016. The economic operator has the right to invoke the support of a third party / third parties in this regardregarding the fulfillment of the requirement regarding turnover. In this case, together with the support commitment, the bidder / candidate has the obligation to submit documents transmitted to him by the third party / supporters / supporters, from which to show the effective way in which the third party / supporters / supporters will ensure the fulfillment of his own commitment. supporting documents that willconstitute annexes to the respective commitment art. 182 of Law no. 98/2016 regarding public procurement. For the communications subsequent to the submission of tenders: for the purpose of verifying the conformity of the technical proposal with the specifications of the specifications or for the purpose of verifying the financial proposal and the qualification documents, the contracting authority may request the presentation of certain clarifications / completions art. 62 paragraph (1) of H.G. no. 395/2016.
