Supply and maintenance of aerial columns on the territory of the Community of Cannes Pays de Lerins

This contract concerns the needs in aerial supply columns for the selective collection of household packaging, paper, cardboard, ordinuhousehold and glass, for municipalities adhering to the CACPL:

Main Site: For lots A, B and C, deliveries will be made on the territory of the CACPL, to the following address: community of agglomeration Cannes Pays de Lerins Pole Environnement allee de C.

This lot concerns the provision of voluntary aerial columns for the selective collection ofrecyclable (household packaging, cardboard and paper), glass and household garbage for new establishments intended to densify the network as well as the renewal of existing columns. The candidate may propose a price for the supply of an aerial column for bio-waste if he has this reference; however, the lack of information of this price in the BPU will not be penalized.

The admissibility of the application is assessed in view of the rules for access to public procurement, set out in particular by the following articles of the public procurement code (CCP): L. 2141-1 a L. 2141-5 (reasons for automatic exclusions from the award procedure), L. 2142-1 and R. 2142-1 to R. 2142-27 (conditions of participation), R. 2143-3 (items to be produced speakcandidate),

R. 2143-11 and R. 2143-12 (supporting documents and other means of proof relating to the conditions of participation). In application of these provisions, the candidate will provide all the information relating to the application mentioned below:

- a letter of application presenting the candidate (name and address of the head office of the company or companies in case of groupement, legal form of the grouping, identification of the members of the grouping and distribution of the services, representative appointed by the members of the grouping);

- a declaration on honor to justify that it does not enter in any of the cases mentioned in articles L. 2141-1 to L. 2141-5 and L. 2141-7 to L. 2141-11 of the code of the public order, in particular that it meets the obligations concerningthe employment of disabled workers defined in articles L. 5212-1 to L. 5212-11 of the labor code.

- Declaration concerning the candidate`s overall turnover and the turnover of the field of activity making the subject of the public contract, relating to the last 3 financial years available depending on the date of creation of the business or the start of activity of the economic operator, to the extent that information on these turnover figures is available;

- Information on the subscription to a relevant professional risk insurance.

- 1) The market is passed according to the procedure of open call for tenders, conf. to the provisions of articles L. and R. 2124-1, L. and R. 2124-2, R. 2161-2 a R.2161-5 of the public procurement code (CCP);

- 2) Complement to the rubricii.2.5 (award criteria): the award criteria as well as their assessment elements are specified in the RC;

- 3) The documents mentioned in sections III.1.1, III.1.2 and III.1.3 of this notice must be drawn up by each candidate and by each of the co-contractors for a group. The economic, financial, technical and professional capacities of a candidategenerally taking into account, where appropriate, all the capacities of the members of the group. Applicants can also assert the capacities of other entities regardless of the legal nature of the links existing between themselves and these entities (subcontractors, subsidiary, parent company, third-party company, etc.). Applicants must, in this case, demonstrate capabilities of this or thatoperators by producing, for example, the parts referred to in sections III.1.1, III.1.2 and III.1.3 and providing proof that they will have them for the performance of the contract, by any appropriate means (for example a written commitment from the `economic operator). Applicants will find more information on the legal form to be taken by the applicant and the conditions of participation.n in the CR;

- 4) Supplement to sections II.2.10 (variants): the RC mentions the minimum requirements that the variant (s) must meet as well as the presentation modalities (only for lots 1 to 3, variants being refused for lot 4);

- 5) Complement to section IV.1.3 (information on the framework agreement): the contract is awarded in the form of a framework agreement setting out alls the contractual stipulations, concluded without minimum and without maximum in quantity, to purchase orders in application of article R. 2162-1 and following of the CCP. The framework agreement will be concluded with a single economic operator;

- 6) Supplement to section IV.2.7 (procedure for opening tenders): the date is given for information;

- 7) Conditions of sending and delivery of folds: devron foldst be transmitted electronically. Paper delivery is prohibited. The files which would be delivered after the date and time fixed in section IV.2.2 will not be retained. Applicants will find all the information regarding the procedures for submitting their mail in the Rc;

- 8) Supplement to section IV.2.4 (official languages): if the documents referred to must be crazyprovided by the candidates are not written in French, it is requested that these documents be accompanied by a translation into French;

- 9) The monetary unit is the euro;

- 10) Supplement to section II. 2.7 (duration of the contract): the duration is from the date of notification of the contract;

- 11) Within the framework of the technical value of the offer, tenderers are required to supplyr for lots 1 to 3 of the samples in support of their offer;

- 12) Review clause (extracts): the CACPL and the holder agree to approach the request of one or the other after verification, audit or presentation of the annual activity report provided for in this contract to verify the correct adaptation of remuneration to technical and economic conditions, in the following cases:

—— significant changes to the consistency and conditions of performance of the overall service, calling into question the economy of the contract;

—— possibilities to improve profitability of the service, of equal quality, capable of influencing practical costs;

—— in the event of significant changes in law, in particular tax, labor, safety or environmental protection rulesent;

—— when the application of the price variation formula shows a variation over 12 months of more than 3% when one of the indices varies by more than 3%.
