Purpose of tRavaux: design and implementation of renovation and extension works for the communal pool of the Orient in Tournai.

Place of execution: Communal pool of the Orient (Aqua Tournai), Rue de l`Orient in 7500 Tournai.

Comments: the contracting authority wishes to provide, through the market, on the Carriere de l`Orient site, for the renovation and extension of the communal swimming pool, used for school, sport and entertainment.

This project is part of the planswimming pool 2014 - 2020 in the Walloon Region. Indeed, the City of Tournai has submitted a request for subsidies for the renovation of the Orient pool.

Given the nature of the market, the contracting authority has decided not to divide the market into lots.

The contractor will insure the design, renovation, extension and complete equipment of the complex, guaranteeing its energy and functional performance. Thus, after its provisional reception, the swimming pool will be returned to the disposal of the ville de Tournai which will continue to manage it, but the contractor will be responsible for performance damage via technical monitoring during the warranty period (two years). It is only at the end of this guarantee period that the contractor will be released from its contractual performance guarantee.

This contract has two sections:

- a firm section on the renovation and extension of the communal swimming pool:

Funding: 2014 - 2020 swimming pool plan for the Walloon Region.

Timing of allocation: within the framework of the context of the Covid 19 pandemic, the subsidizing power has agreed to postpone the deadline for awarding this contract to 29.9.2020.

The timing of allocation is indicative and does not bind the contracting authority. However, the overall delay cannotbe extended, except with the agreement of the subsidizing power. In fact, in the event of non-compliance with this, the subsidies for carrying out the work could be lost.

Budget (honorary work team of project coordinators health and safety coordination): 6, 975, 000 EUR excl. VAT.

—— development of the wellness area;

—— special technical interventions;

- restaurant:

—— demolition reconstruction (closed covered);

—— PMR accessibility;

Part III of the ESPD - Grounds for exclusion points A to C of the ESPD, whereby the tenderer declares that he is not in one of the exclusion situations referred to in articles 67 to 69 of the law of 17.6.2016 .

Seuthe bids of tenderers who meet the selection criteria are taken into consideration in order to participate in the comparison of the offers on the basis of the award criteria set out in this special specification, insofar as these offers are regular. ) Grounds for exclusion relating to social and fiscal debts

Pursuant to article 68 of the law of 17.6.2016 and articles 62, § 2 and 63, §2 of the royal decree of 18.4.2017, the power process adjudicatorra to the verification of the tenderer`s situation in terms of social and tax debts within twenty days of the final date for the submission of requests to participate or tenders on the basis of the certificates available via the Telemarc application for the Belgian tenderer or via other equivalent electronic applications which are accessible free of charge in other Member States for foreign tenderers. The certificate relates to the last fiscal period elapsed before the deadline for receipt of tenders.

Any tenderer with social and / or fiscal debts greater than 3, 000 EUR will be consideredre as being in good standing if it establishes:

- before the decision to award the contract, which it possesses, at the end of the period referred to with regard to a contracting authority within the meaning of Article 2, 1, of the law or of a public enterprise within the meaning of article 2, 2, of the law, one or more certain claims, due and free from any commitment towards third parties for an amount at least equal, at 3, 000 EUR near, to the one for which he is in arrears of payment;

- that he obtained for these debts delays ofpayment which he strictly observes before the deadline for receipt of tenders.
