(Requirement 1 - continued)

1. The presence of prothe public procurement cession is initiated under the following conditions: - The conclusion of the public procurement contract is conditioned by obtaining / approving the financing of the works from the state budget funds and / or European non-reimbursable funds, the signing of the contract being possible only in the situation where it is observed the provisions relating to the commitment of expenditure in the budgetswhich fall under the scope of public finance legislation. In the event that, for any reason, obtaining / approval of the financing of works from funds from the state budget and / or European non-reimbursable funds is not realized, the Contracting Authority shall apply the provisions of art. 212 alin (1) lit. c) the second sentence of Law 98/2016, which is impossible to conclude the public procurement contractic. The Contracting Authority estimates that it will obtain the financing required to sign the contract in the second semester of 2019.

2. The deadlines specified in the Payment Agreement are justified by the complexity of the road infrastructure project (major interest projects), as well as by the financial circuits of funds involving several state institutions. Contract durationand is 96 months and includes: 12 months design period, 24 months execution period of the works and 60 months warranty period of the works. The duration of the works contract may vary depending on the warranty period offered by the designated economic operator. In order to complete the DUAE, the bidders will use the editable form provided by the Contrac Authorityin the SEAP, according to the model published by ANAP by the notification of 01.09.2016. A person who considers himself prejudiced by an act of the contracting authority may refer the matter to the Council for the annulment of the act of the Contracting Authority, for its obligation to issue an act or to take remedial measures, as well as for recoursethe declaration of the claimed right or of the legitimate interest, within 10 days, according to the provisions of art. 8 par. (1) lit. a) of Law 101/2016. For the judicial settlement, the person who considers himself / herself injured can appeal to the competent court, according to the provisions of art. 49 of Law 101/2016. To resolve the objection formulated in the conditions of art. 8 or art. 49 of Leg. 101/2016, under the sanction of its rejection, the person who considers himself / herself injured must be a pre-caution under the conditions provided by art. 61 index 1 of Law 101 / 2016.
